ED LABOR-EDUCATIONAL EMPLOYEE

Amends the Illinois Educational Labor Relations Act. Provides that notwithstanding the definition found in the Act or any other law to the contrary, for the purposes of the Act, any individual with an administrative certificate issued pursuant to the School Code and employed full-time or part-time as an administrator, principal, or assistant principal by the Chicago school district is an "educational employee" or an "employee". Amends the State Mandates Act to require implementation without reimbursement.

PUB AID-APPLICATION ASSISTANCE

Amends the Illinois Public Aid Code. Provides that the Department of Human Services shall form a workgroup comprised of representatives of the Department of Human Services, the Illinois Department of Public Aid, and nonprofit community-based organizations that serve individuals and families with incomes at or below 200% of the federal poverty level to create policies and procedures and a reimbursement methodology for partnerships with nonprofit community-based organizations for the purpose of outreach and initiation of applications for benefit programs. Requires the Department to adopt rules to implement the workgroup's recommended policies and procedures, to take effect no later than July 1, 2007. Provides that nonprofit community partners shall be reimbursed for the application assistance provided to eligible individuals and families in the form of a one-time technical assistance payment (TAP) of a minimum of $50 for a successful application; provides that this TAP is in addition to any TAP received in connection with a successful KidCare application. Requires the Department of Human Services to adopt rules providing that, effective no later than January 1, 2006, (i) if an applicant for a particular assistance program has already submitted documents and information for another assistance program, the applicant need not resubmit the same documents and information in support of the new application and (ii) the Department shall use the already-submitted documents and information in ruling on the new application. Effective immediately.

CRIM CD-PROSTITUTION PROBATION

Amends the Criminal Code of 1961. Provides that whenever any person who has not previously been convicted of or placed on probation for felony prostitution or any law of the United States or of any other state relating to felony prostitution pleads guilty to or is found guilty of felony prostitution, the court, without entering a judgment and with the consent of such person, may sentence the person to probation. Provides that when a person is placed on probation for felony prostitution, the court shall enter an order specifying a period of probation of 24 months and shall defer further proceedings in the case until the conclusion of the period or until the filing of a petition alleging violation of a term or condition of probation. Provides that the conditions of probation shall be that the person: (1) not violate any criminal statute of any jurisdiction; (2) refrain from possessing a firearm or other dangerous weapon; (3) submit to periodic drug testing at a time and in a manner as ordered by the court, but no less than 3 times during the period of the probation, with the cost of the testing to be paid by the probationer; and (4) perform no less than 30 hours of community service, provided community service is available in the jurisdiction and is funded and approved by the county board. Provides that the court may impose other conditions of probation. Provides that upon fulfillment of the terms and conditions of probation, the court shall discharge the person and dismiss the proceedings against him or her. Provides that there may be only one discharge and dismissal under this provision. Provides that if a person is convicted of prostitution within 5 years subsequent to a discharge and dismissal under this provision, the discharge and dismissal shall be admissible in the sentencing proceeding for that conviction as evidence in aggravation. Effective immediately.

ED LABR-CHI-BARGAINING SUBJECT

Amends the Illinois Educational Labor Relations Act. Provides that the list of subjects of collective bargaining between the Chicago School District and the exclusive bargaining representative of its employees that is now permissive is instead mandatory. Amends the State Mandates Act to require implementation without reimbursement.

GOVT-ST POLICE-AMBER ALERT

Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Requires the Department of State Police to develop a statewide emergency alert system for missing endangered seniors, to develop a community outreach program to promote awareness among State citizens of senior endangerment prevention and response, and to appoint a Child and Senior Safety Coordinator (rather than a Child Safety Coordinator). Requires the Department to prepare a report containing certain information when it receives a notification of a missing endangered senior and to forward the report to certain other parties. Requires the Department to begin an investigation concerning the missing endangered senior no later than 24 hours after receiving notification of the missing endangered senior. Provides a definition of "missing endangered senior". Amends the Illinois Police Training Act to require the Illinois Law Enforcement Training Standards Board to provide a training program for law enforcement personnel of local governmental agencies in the statewide coordinated child abduction and missing endangered senior alert system (rather than the child abduction alert system). Effective January 1, 2006.

IDENTITY THEFT NOTIFY ACT

Creates the Identity Theft Notification Act. Requires any data collector that owns or uses personal information in any form that includes personal information concerning an Illinois resident, to disclose any breach of the security of the system following discovery or notification of the breach in the security of the data, without regard for whether the data has been accessed by an unauthorized third party for legal or illegal purposes. Provides that notice may be provided in one of the following ways: (1) written notice; (2) electronic notice; or (3) substitute notice if the person or business demonstrates that the cost of providing notice would exceed $250,000, or the affected class of persons to be notified exceeds 500,000, or the person or business does not have sufficient contact information. Provides a private right of action for a violation of the Act.

SUPREME COURT CAMPAIGN REFORM

Creates the Supreme Court Campaign Reform Act. Provides that candidates for the Supreme Court may apply for a public financing benefit in connection with their campaign. Sets the amount of the public financing benefit at $750,000 for the general primary and general election cycle. Sets requirements for qualifying for the public financing benefits. Limits the amount of private contributions qualified candidates may accept. Limits the amounts that non-participating candidates may accept from private sources during campaign periods to $1,000 in the aggregate. Provides that qualified candidates must be distributed a line of credit from the Illinois Supreme Court Democracy Trust Fund to be used for lawful political expenditures. Provides for the increase of the line of credit if non-complying candidates make certain expenditures. Sets penalties for violations of the Act. Provides that the Illinois Supreme Court may require attorneys to contribute money to the Fund not to exceed $25 annually. Contains other provisions. Amends the Election Code. Provides that a payment for electioneering communications is an "expenditure". Provides that a group that "accepts contributions or makes expenditures during any 12-month period in an aggregate amount exceeding $3,000 for the purpose of electioneering communications" is a political committee. Allows the Board of Elections to impose a fine against a committee that fails to report expenditures that could trigger matching funds under the Supreme Court Campaign Reform Act. Amends the State Finance Act. Creates the Illinois Supreme Court Democracy Trust Fund. Amends the Illinois Income Tax Act. Requires the Department of Revenue to print on its standard individual income tax form a provision by which the taxpayer may make a contribution (not less than $1) to the Illinois Supreme Court Democracy Trust Fund. Amends the Clerk of the Courts Act. Requires circuit court clerks to transfer $1 from each appearance fee paid to the State Treasurer for deposit into the Supreme Court Democracy Trust Fund and, to defray that expense, the county board may, by resolution, require the clerk of the circuit court in the county to charge and collect a Supreme Court Democracy Trust Fund fee of not more than $1, which shall be paid at the time that any appearance fee is paid. Effective immediately.

CERTIFIED MIDWIVES PILOT PRGM

Creates the Certified Professional Midwives Pilot Program Act to permit Certified Professional Midwives who are nationally certified direct-entry midwives to practice in designated shortage areas. Provides that the Department of Public Health shall establish and administer the 5-year pilot program by rule. Effective immediately.

ETHICAL ST PRIVATIZATION ACT

Creates the Ethical Public Service Accountability Act. Establishes requirements for privatization contracts between contractors and State agencies. Provides for the monitoring and enforcement of privatization contracts. Establishes penalties for violations. Effective immediately.
