DEBT SETTLEMENT CONS PRO ACT

Creates the Debt Settlement Consumer Protection Act. Provides that it shall be unlawful for any person to operate as a debt settlement provider or engage in debt settlement service except as authorized by the Act and without first having obtained a license under the Act. Contains provisions concerning the (1) application for a license, (2) qualifications for licensure, (3) renewal of a license, (4) display requirements for a license, (5) temporary licensed locations, (6) denial of a license, (7) revocation or suspension of a license, (8) maintenance of records by a licensee, (9) examination of a licensee, (10) maintenance of trust funds by a licensee, and (11) other licensee businesses. With respect to the Director of Financial Institutions, contains provisions concerning the (1) adoption of rules by the Director, (2) penalties for violations of the Act, (3) procedure the Director may take to obtain an injunction, (4) review of decisions, (5) issuance of cease and desist orders. Contains provisions concerning (1) advertising practices, (2) individualized financial analysis, (3) required disclosures, (4) debt settlement contracts, (5) fees, (6) consumer settlement accounts, (7) cancellation of contracts, (8) obligations of good faith, (9) prohibited practices and noncompliance with the Act, and (10) civil remedies. Amends the Debt Management Service Act to exclude "debt settlement service" and attorneys engaged in specific practices from the Act. Amends the State Finance Act to provide that moneys collected under the Debt Settlement Consumer Protection Act shall be deposited into the Financial Institution Fund. Contains a severability clause. Amends the Consumer Fraud and Deceptive Business Practices Act to specify that a violation of the Debt Settlement Consumer Protection Act is a violation of the Act. Effective immediately.

WAGE PAYMENT-PENALTIES

Amends the Code of Criminal Procedure of 1963. Provides that 2 or more acts or transactions in violation of certain provisions of the Illinois Wage Payment and Collection Act may be joined in a single count of an indictment, information, or complaint. Amends the Illinois Wage Payment and Collection Act. Subject to appropriation, provides that the Department of Labor shall establish an administrative procedure to adjudicate claims or specific categories of claims. Establishes procedures for an employee who has not been paid the wage the employee is entitled by the Act to recover by filing a claim with the Department or in a civil action, but not both.

FAM PRAC RES - PSYCHIATRIST

Creates the Psychiatry Practice Incentive Act. Provides for the establishment by the Department of Public Health of a program under which programs of grants, loans, and loan forgiveness are established to recruit and retain psychiatric service providers in designated shortage areas of the State. Sets forth the powers and duties of the Department in the establishment and administration of the programs. Requires the Department to annually report to the General Assembly and the Governor the results and progress of all programs established under the Act. Sets forth penalties for a recipient of assistance under a program who fails to fulfill his or her practice obligation under the Act. Amends the Family Practice Residency Act. Provides that any monetary penalties imposed after December 31, 2009 and before the effective date of the amendatory Act upon a scholarship recipient who has been found by the Department of Public Health to have failed to fulfill his or her obligation under the Act, but who has been practicing as a psychiatrist within a designated shortage area during that time, must be declared null and void by the Department, and any payments made to the Department by the scholarship recipient must be returned to that scholarship recipient within a reasonable amount of time, as determined by the Department.

CHILD-SAFE CHEMICALS ACT

Creates the Child-Safe Chemicals Act. Regulates the sale and distribution of children's products or product components containing cadmium and priority chemicals of high concern. Designates cadmium as a priority chemical. Requires manufacturers and trade associations to report to the Environmental Protection Agency. Sets forth the responsibilities of the Agency. Provides for exemptions. Requires the Agency to create an interstate clearinghouse. Contains provisions for implementation and enforcement. Contains other provisions. Effective immediately.

MEDICAID-BREAST/CERVICL CANCER

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that subject to appropriation, any uninsured person as defined by the Department of Healthcare and Family Services in rules residing in Illinois who is younger than 65 years of age, who has been screened for breast and cervical cancer in accordance with standards and procedures adopted by the Department of Public Health for screening, and who is referred to the Department by the Department of Public Health as being in need of treatment for breast or cervical cancer is eligible for medical assistance benefits that are consistent with the benefits provided to those persons who are eligible for medical assistance pursuant to the federal Breast and Cervical Cancer Prevention and Treatment Act of 2000. Provides that medical assistance coverage for such persons is not dependent on federal approval, but federal moneys may be used to pay for services provided under that coverage upon federal approval. Effective immediately.

COMMUNITY YOUTH EMPLOYMENT ACT

Creates the Community Youth Employment Act. Provides that, subject to appropriation, the Department of Commerce and Economic Opportunity shall administer a competitive grant program to provide 2,500 youths with stipends and supervision over a 6-week summer work period. Sets forth criteria for receiving grants under the Act. Provides a budget for the use of grant moneys awarded. Effective immediately.

DANGEROUS ANIMALS-PRIMATES

Amends the Illinois Dangerous Animals Act. Prohibits a person from having a right of property in, keeping, harboring, caring for, acting as custodian of or maintaining in his or her possession any primate, except at a properly maintained zoological park, federally licensed exhibit, circus, college or university, scientific institution, research laboratory, veterinary hospital, hound running area, or animal refuge in an escape-proof enclosure. Provides that this provision does not prohibit a person who had lawful possession of a primate before January 1, 2011, from continuing to possess that primate if the person registers the animal by providing written notification to the local animal control administrator on or before April 1, 2011. Provides for other notification requirements.

BRIAN'S LAW

Creates the Developmental Disability Institutional Safety Act ("Brian's Law"). Requires the Illinois Department of Human Services and the Illinois Department of Public Health to develop teams of monitors to ensure the safety and well-being of individuals residing at State-operated developmental disability institutions. Authorizes these teams to conduct site visits at these institutions and to report on their observations. Requires the Departments to develop and implement action plans to respond to these reports. Requires the Departments to develop a team of experts to investigate and report on the deaths of individuals who are under the care of these institutions. Requires the Departments to develop plans of prevention within 90 days after the completion of an investigation into the death of an individual at one of these institutions. Requires the Department of Human Service to provide certain information to individuals with developmental disabilities and their families. Amends the Abused and Neglected Long Term Care Facility Residents Reporting Act. Provides that neglect includes the failure to follow medical and personal care protocols, such as dietary restrictions, regardless of whether that failure causes injury, and that abuse includes inadequate medical care that, regardless of the final cause of death, compromises an individual's health or leads to serious medical consequences followed by the individuals' death.

MR/DD COMM CARE ACT-FCLTY SIZE

Amends the MR/DD Community Care Act. Includes the size of the facility licensed under the Act to the list of factors the Director of Public Health is to consider when making a determination as to possible penalties for a violation. Effective July 1, 2010.

CHILD ABUSE REPORTS

Amends the Abused and Neglected Child Reporting Act. Changes the definition of the term "subject of report" to mean any child reported to the central register of child abuse and neglect as an alleged victim of child abuse or neglect and the parent or guardian of the alleged victim (rather than any child reported to the central register of child abuse and neglect and his or her parent, guardian, or other person responsible who is also named in the report). Provides that "subject of report" also includes a person responsible for the child's welfare who is also named in the report as an alleged perpetrator of child abuse or neglect. Further provides that within a specified time frame a subject of a report who is indicated for child abuse and neglect may request the Department of Children and Family Services to amend the record or remove the record of the report from the central register.
