GOV BDS-DEMOGRAPHIC INFO

Amends the Gubernatorial Boards and Commissions Act. Provides that an application for appointment to a gubernatorial board or commission shall include a data field where an applicant shall disclose his or her ethnicity, gender, and disability status for reporting purposes. Provides that by May 1 of each year, the Governor shall file a report with the General Assembly and the Legislative Research Unit detailing (1) the demographic information (ethnicity, gender, and disability status) of each appointment made by the Governor during the prior year, (2) the aggregate demographic information for those persons who applied for an appointment with the Governor's office, but were not appointed during the prior year, and (3) the demographic composition of the gubernatorial appointees on each board, commission, and task force as of the date of the report. Requires the Legislative Research Unit to publish an annual report detailing the demographic composition of the gubernatorial appointees on each board, commission, and task force as of the date of the report.

SCH CD-CHI-CLOSURE MORATORIUM

Amends the Chicago School District Article of the School Code. Provides that there shall be a moratorium on school closings, consolidations, and phase-outs in the school district in the 2013-2014 school year. Provides that any of these actions that are subsequently appropriate must be carried out no sooner than the end of the 2014-2015 school year, subject to any new set of requirements adopted by the General Assembly. During this moratorium period, requires the district to establish polices that address and remedy the academic performance of schools in which Illinois Standards Achievement Test scores reflect students performing at or below 75%. Requires these policies to establish clear criteria or processes for establishing criteria for making school facility decisions and include clear criteria for setting priorities with respect to school openings, school closings, school consolidations, school turnarounds, school phase-outs, school construction, school repairs, school modernizations, school boundary changes, and other related school facility decisions, including the encouragement of multiple community uses for school space. Effective immediately.

MEDICAID-PERSONAL NEEDS-ID/DD

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that subject to appropriation, for a person who is a resident in a facility licensed under the ID/DD Community Care Act for whom payments are made throughout a month and who is determined to be eligible for medical assistance, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act so that the person's total monthly personal needs allowance from both State and federal sources equals $50. Effective immediately.

MEDICAID PRIOR AUTHORIZATION

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that no later than November 1, 2013, the Department of Healthcare and Family Services shall promulgate and file a regulation defining criteria utilized for granting prior authorization for non-preferred medications; criteria utilized for denying a request for prior authorization; criteria utilized for approval or denial of a request for prior authorization made to any managed care entity under contract with the State to administer pharmaceutical drug benefits to any recipient of medical assistance benefits; and other matters. Provides that prior to promulgating this regulation, the Department shall consult with recipients of aid, health care advocates, including mental health care advocates, and providers. Grants the Department the authority to use preemptory rulemaking, in accordance with the Illinois Administrative Procedure Act, to place into the Illinois Administrative Code the criteria, appeal process, and policies set forth. Effective immediately.

FINANCE-STATE BD OF EDU-GRANTS

Amends the State Finance Act. Permits the State Board of Education to make payments for grants provided by the United States Department of Agriculture, the United States Department of Education, or any other federal agency for any fiscal year without regard to the fact that the services being compensated for by such payment may have been rendered in a prior fiscal year. Effective July 1, 2014.

UNEMPLOYMENT-NEWSPAPER DELIVER

Amends the Unemployment Insurance Act. Provides that the term "employment" does not include the delivery or distribution of newspapers or shopping news to the consumer, rather than to the ultimate consumer. Deletes provisions relating to delivery to the ultimate consumer. Effective immediately.

NURSING HOME CARE-GUARDIAN

Amends the Nursing Home Care Act. Provides that to protect a resident's funds, a facility shall place any monthly allowance to which a resident is entitled in that resident's personal account, or give it to the resident, unless the facility has written authorization from the resident or the resident's guardian (now, the resident or the resident's guardian or if the resident is a minor, his parent) to handle it differently. Effective immediately.
