Creates the Termination of Parental Rights of Perpetrators of Sexual Assault Act. Provides that if a child was conceived as a result of an act of sexual assault, the parent who is the victim of the act of sexual assault may file a petition with the court to terminate the child's parent-child relationship with the alleged perpetrator of the act of sexual assault. Provides that a verified petition filed under the Act must contain specified allegations and be supported by a showing by clear and convincing evidence that the alleged perpetrator committed an act of sexual assault against the petitioner. Provides that the court shall terminate the parent-child relationship if the court finds: (i) by clear and convincing evidence, that the allegations in a petition filed under Act are true; and (ii) that termination of the parent-child relationship is in the best interest of the child. Provides that conception as a result of sexual assault may be proven by a final judgment of conviction of a an alleged parent of a child under the Act who has been convicted of or who has pled guilty or nolo contendere to a violation of Sections of the Criminal Code of 2012 concerning: criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault, criminal sexual abuse, aggravated criminal sexual abuse, sexual relations within families, or a similar statute in another jurisdiction, for his conduct in fathering that child.
Amends the Alternative Health Care Delivery Act and the Hospital Licensing Act. Sets forth the General Assembly's findings concerning the screening of newborns for congenital heart defects. Provides that all birth centers and hospitals must test every newborn for congenital heart defects via a screening test in line with the current standard of care, such as pulse oximetry screening, according to congenital heart defect screening protocols developed by the Department of Public Health in consultation with relevant medical practitioners and stakeholders. Provides that exceptions to mandatory congenital heart defect screenings shall be limited to cases in which the parents object to the screening, or as directed by the congenital heart defect screening protocol.
Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that if the court finds that it is in the best interest of the child and awards joint custody or visitation rights, the court shall find that both parties have the right of first refusal to care for the minor children if the absence of either party is necessary during the party's normal parenting time. Provides that the use of baby-sitters, family members, or subsequent spouses is secondary to the right of first refusal. Provides that "right of first refusal" means that in the event that either parent intends to leave the minor children for a period of 4 hours or longer, that parent shall first offer the other parent an opportunity for additional time with the children before making other arrangements for the temporary care of the children. Contains provisions concerning the setting of parameters regarding distance, transportation, and time constraints which may make the offering of additional parenting time impractical and therefore not required. Provides that the parent leaving the children with the other parent or with a temporary child care provider shall notify the other parent of the duration of the parenting time or temporary care of the children by other persons. Contains procedural requirements regarding the offering and acceptance of additional parenting time. Provides that the parent exercising additional parenting time shall provide the necessary transportation unless the parties agree otherwise. Provides that the new provisions are enforceable under the Section of the Act concerning visitation abuse. Provides that the right of first refusal shall be terminated upon the termination of custody or visitation rights.
Amends the School Code. Creates the Young Adults Heroin Use Task Force to address the growing problem of heroin use in high schools across this State. Sets forth the membership of the Task Force. Requires the Task Force to conduct a study on the heroin use problem in high schools and suggest programs for high schools to use to address the problem, which programs may involve local law enforcement agencies. Requires the Task Force to report its findings and recommendations to the General Assembly and Governor on or before June 30, 2014. Abolishes the Task Force and repeals these provisions on July 1, 2014. Effective immediately.
Amends the Illinois Horse Racing Act of 1975. Provides that, in addition to certain charitable contributions to non-profit organizations that provide medical and family, counseling, and similar services to persons who reside or work on the backstretch of Illinois racetracks, organization licensees shall provide funding for no less than one Automated External Defibrillator (AED) to be placed in the paddock of their racing facilities and no less than one AED to be placed in the barn area of their racing facilities. Requires that the AEDs be accessible at all times to industry workers. Provides that qualified charitable organizations receiving the charitable contributions shall provide annual AED training, in English and Spanish, to horsemen and racetrack personnel. Requires the Board to conduct periodic checks on the AEDs and notify organization licensees to replace or repair them as needed. Effective immediately.
Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning the short title.
Amends the School Code. In the Teacher Certification Article, provides that a person who holds an active license issued by the State as a marriage and family therapist shall be deemed to have satisfied the continuing professional development requirements to renew a school service personnel certificate. In the Educator Licensure Article, includes marriage and family therapist as a school support personnel endorsement area that may be affixed to a Professional Educator License. Effective immediately.
Amends the Criminal Identification Act and the Unified Code of Corrections. Provides that upon a petition by a person who has been convicted of a Class 3 or Class 4 felony and who has served in the United States Armed Forces or in the National Guard of this or another state and has received an honorable discharge from the Armed Forces or National Guard and who meets specified requirements, the Prisoner Review Board shall hear by at least 3 members and, with the unanimous vote of a panel of 3 members, issue a certificate of eligibility for expungement recommending that the court order the expungement of all official records of the arresting authority, the circuit court clerk, and the Department of State Police concerning the arrest and conviction for the Class 3 or 4 felony. Excludes a person convicted of a sex offense, crime of violence, or firearm offense. Provides that if a person has applied to the Board for a certificate of eligibility for expungement and the Board denies the certificate, the person must wait at least 4 years before filing again or filing for a pardon with authorization for expungement from the Governor unless the Governor or Chairman of the Prisoner Review Board grants a waiver. Effective immediately.
