Amends the Currency Exchange Act. Provides that all funds received by currency exchanges for remittance to utility and other companies be deposited into an escrow account no later than the next business day and the escrow account may not be used for any other use. Increases a community currency exchange license application fee to $1,500 (rather than $500) and increases the annual license fee to $500 (rather than $200). Requires that the community currency exchange retain a annual surety bond of $50,000 (rather than $10,000) or the community currency exchange may be covered by a blanket bond in a principal aggregate sum of not less than $10,000,000 (rather than $2,000,000). Requires that the community currency exchange maintain a minimum of $5,000 of its own cash funds to be available for the uses and purposes of its business. Requires that the community currency exchange deposit into an escrow account all funds received as payment for money orders no later than the next business day. Provides that the Secretary of Financial and Professional Regulation may fine a licensee an amount not to exceed $10,000 per violation, revoke, or suspend any license issued if the licensee fails to comply with any provision of this Act or any order, decision, finding, rule, regulation, or direction of the Secretary. Makes other changes. Effective January 1, 2012.
Amends the Criminal Code of 1961. Provides that financial exploitation of an elderly person or a person with a disability is a Class 1 felony if the value of the property is $50,000 (rather than $100,000) or more but less than $100,000 or if the elderly person is over 70 years of age and the value of the property is $15,000 or more but less than $50,000 or if the elderly person is 80 years of age or older and the value of the property is $5,000 or more but less than $25,000 and a Class X felony if the value of the property is $100,000 or more or if the elderly person is over 70 years of age and the value of the property is $50,000 or more or if the elderly person is 80 years of age or older and the value of the property is $25,000 or more.
Amends the Criminal Code of 1961. Creates the offense of false personation of a peace officer while serving process. Provides that a person commits the offense when he or she, not being a peace officer, knowingly wears a coat, hat, or other clothing while serving process that reasonably creates the impression that the person is a peace officer. Amends the Code of Civil Procedure. With respect to the requirement that a person who is a licensed or registered private detective or a registered employee of a private detective agency must supply the sheriff of any county in which the person serves process with a copy of the person's license or certificate, deletes language providing that the failure of a person to supply a copy of the license or certificate to the sheriff does not impair the validity of process served by the person. In a provision that allows a court to appoint a certified private detective agency as a special process server, deletes language allowing any employee of the private detective agency to serve the process under the appointment.
Amends the Criminal Code of 1961 relating to the offense of disorderly conduct at a funeral or memorial service. Increases the time period for which the conduct at the funeral or memorial service is prohibited before and after the service from 30 minutes to 60 minutes and increases the distance from which the conduct is prohibited from 200 feet to 1,000 feet of any ingress or egress of the funeral site. Effective immediately.
Amends the Abuse of Adults with Disabilities Intervention Act. Provides that the Office of Inspector General shall file with the Governor and the General Assembly, no later than January 1 following the end of each fiscal year (rather than within 90 days after the end of each fiscal year), a report concerning its implementation of the Domestic Abuse Project. Defines the terms "mental abuse" and "financial exploitation". Removes the definition of the term "exploitation". Redefines "abuse" to mean the causing of any physical, sexual, or mental abuse (rather than mental injury) to an adult with disabilities. Expands the definition of "physical abuse" to include directing another person to physically abuse a person with disabilities. Expands the definition of "sexual abuse" to include acts of sexual exploitation including, but not limited to, facilitating or compelling an adult with disabilities to become a prostitute, or receiving anything of value from an adult with disabilities knowing it was obtained in whole or in part from the practice of prostitution. Effective immediately.
Amends the Illinois Insurance Code. Provides that accident and health insurance policies that provide coverage for prescribed orally-administered cancer medications and intravenously administered or injected cancer medications shall ensure that the applicable financial requirements and treatment limitations are no more restrictive than the financial requirements and treatment limitations applied to intravenously administered or injected cancer medications that are covered by the policy. Provides that an insurer cannot achieve compliance with the coverage mandate by increasing financial requirements or imposing more restrictive treatment limitations on prescribed orally-administered cancer medications or intravenously administered or injected cancer medications covered under the policy. Effective immediately.
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the unlawful sale of public conveyance travel tickets to a minor.
Amends the Adoption Act. Provides a form of waiver of parental rights to be used by a putative or legal father of a born or unborn child.
