FORECLOSURE-PETITION-JUDGMENT

Amends the Code of Civil Procedure. Provides that a foreclosure complaint shall include a copy of all documents that demonstrate the capacity (instead of a statement of the capacity) in which the plaintiff brings the foreclosure (such as legal holder of the indebtedness, pledgee, agent, trustee under a trust deed, or otherwise). Provides that at a foreclosure trial, an allegation of fact that is not denied (instead of not denied or if the party has no knowledge to form a belief as to the truth of the allegation) must be proved by a verified complaint or separate affidavit. Provides that a foreclosure judgment shall include: tangible evidence of the indebtedness, who holds the indebtedness and, if the plaintiff is not the original mortgagee, specific findings of fact concerning the plaintiff's capacity to bring the foreclosure action and a determination of whether this capacity legally entitles the plaintiff to bring the action. Effective immediately.

HOME LOAN PREPAYMENT PENALTIES

Amends the Residential Mortgage License Act of 1987, the High Risk Home Loan Act, and the Interest Act. Limits the imposition of prepayment penalties in connection with high risk home loans. Limits the size of balloon payments in connection with high risk home loans. Limits the imposition of late fees. Effective January 1, 2013.

INC TX-ENT ZONE-MORTGAGE

Amends the Illinois Income Tax Act. For taxable years ending on or after December 31, 2009, creates a deduction for financial organizations in an amount equal to the amount included in the organization's adjusted gross income as interest income from a residential mortgage loan if the mortgagor is a person with at least a 50% ownership interest in a business located in an Enterprise Zone or a River Edge Redevelopment Zone. Provides that the financial organization must apply the Illinois income tax savings to the principal of the loan. Allows the organization to file amended returns. Effective immediately.
