CRIM CD-FINAN EXPLOIT-ELDERLY

Amends the Criminal Code of 1961. Provides that financial exploitation of an elderly person or a person with a disability is a Class 1 felony if the value of the property is $50,000 (rather than $100,000) or more but less than $100,000 or if the elderly person is over 70 years of age and the value of the property is $15,000 or more but less than $50,000 or if the elderly person is 80 years of age or older and the value of the property is $5,000 or more but less than $25,000 and a Class X felony if the value of the property is $100,000 or more or if the elderly person is over 70 years of age and the value of the property is $50,000 or more or if the elderly person is 80 years of age or older and the value of the property is $25,000 or more.

CD CORR, SEX OFFENDER-DNA

Amends the Unified Code of Corrections and the Sex Offender Registration Act. Includes in the requirements to submit specimens of blood, saliva, or tissue to the Illinois Department of State Police for inclusion in the DNA database: (1) a person required by an order of the court to submit a DNA specimen; (2) on or after the effective date of the amendatory Act, any person arrested for any of the following offenses, after a determination by a judge or a grand jury that probable cause exists for the arrest: (A) first degree murder, (B) home invasion, (C) predatory criminal sexual assault of a child, (D) aggravated criminal sexual assault, (E) criminal sexual assault; and (3) any person required to register as a sex offender under the Sex Offender Registration Act, regardless of the date of conviction. Increases the DNA analysis fee from $200 to $250. Increases from a Class A misdemeanor to a Class 4 felony, the penalty for a person who is required to submit specimens of blood, saliva, or tissue to the Illinois Department of State Police for inclusion in the DNA database and who impedes such submission. Provides that the detention, arrest, or conviction of a person based upon a database match or database information is not invalidated if it is determined that the specimen was obtained or placed in the database by mistake. Makes other changes. Contains a severability provision.

EMERGENCY EPINEPHRINE ACT

Creates the School Access to Emergency Epinephrine Act. Provides that the purpose of the Act is to allow schools to have access to life-saving emergency epinephrine auto-injectors if and when a student has an anaphylaxis reaction and to allow the school to have personnel trained to administer an emergency epinephrine auto-injector. Provides that a school district may provide emergency epinephrine auto-injectors to trained personnel, and trained personnel may utilize those epinephrine auto-injectors to provide emergency medical. Provides that each public and private elementary and secondary school in the State may make emergency epinephrine auto-injectors and trained personnel available at its school and may designate one or more school personnel to receive initial and annual refresher training. Sets forth provisions concerning trained personnel, minimum standards and training, school plan, and limitation of liability. Effective immediately.

LOCAL GOVT CONSOLIDATION COMSN

Creates the Local Government Consolidation Commission Act of 2011. Establishes a commission of legislative members appointed by the legislative leaders and local government representatives appointed by the Governor to report to the General Assembly on consolidating local governments. Provides for support of the commission by the Department of Commerce and Economic Opportunity. Repeals the Local Government Consolidation Commission Act. Effective immediately.

EXAM OF FIREFIGHTER APPLICANTS

Amends the Illinois Municipal Code and the Fire Protection District Act. Sets forth alternative procedures for appointments to full-time fire departments. Provides for the creation of a register of eligibles for original appointments to fire departments. Sets forth the requirements for placement on the register of eligibles. Provides that a local commission may also hire from a statewide master register of eligibles for original appointments. Sets forth the requirements for placement on the master register. Provides that no person under 21 years of age shall be eligible for employment as a firefighter. Provides for the award of preference points for eligible persons. Sets forth the procedure for awarding preference points for fire cadet, veteran, paramedic, educational, experience, and residency preferences. Denies home rule powers. Contains other provisions. Effective immediately.

MOVABLE SOCCER GOALS SAFETY

Creates the Movable Soccer Goal Safety Act. Requires any organization that sets up, moves, or stores a movable soccer goal to follow all applicable guidelines for anchoring, securing, and counterweighting a movable soccer goal as those guidelines are set forth in "Guidelines for Movable Soccer Goal Safety", a publication of the U.S. Consumer Product Safety Commission. Provides that beginning on the effective date of the Act, no commercial dealer, manufacturer, importer, distributor, wholesaler, or retailer may manufacture, re-manufacture, retrofit, distribute, sell at wholesale or retail, contract to sell or resell, lease, or sublet, or otherwise place in the stream of commerce, a movable soccer goal that is not tip-resistant. Requires movable soccer goals with specified measurements to comply with applicable ASTM standards. Provides that a violation of the Act is a petty offense for which a fine not to exceed $500 may be imposed. Effective immediately.

VEH CD-CORPORATE SPECIAL PLATE

Amends the Illinois Vehicle Code. Provides that the Secretary of State shall contract with a private entity to develop a system for generating and administering corporate-sponsored license plates. Provides that the corporate-sponsored license plates shall display the name, likeness, or logo of Illinois companies, and the corporate-sponsored license plate may not display the name, likeness, or logo of more than one company. Provides that the private entity and the company displaying its name, likeness, or logo shall submit a design for the plate to the Secretary of State, who shall have the authority to approve or reject any design. Provides that an applicant for the special plate shall be charged a $25 fee for original issuance and renewal in addition to the appropriate registration fee. Provides that for each original issuance and renewal, the private entity shall be charged $75, and the private entity may collect this fee from the company displaying its name, likeness, or logo on the plate. Provides that the Secretary of State is not required to issue corporate-sponsored license plates until a sufficient number of applications have been received to cover the total costs of issuance.

EDUC OPP FOR MILITARY CHILDREN

Amends the School Code, the Illinois School Student Records Act, and the Educational Opportunity for Military Children Act. Provides that until June 30, 2015 (instead of June 30, 2012), if a student is an out-of-state transfer student and does not have proof of having had either the required health examination or immunizations before October 15 of the current year or whatever date is set by the school district, then he or she may only attend classes (i) if he or she has proof that an appointment for the required vaccinations has been scheduled with a party authorized to submit proof of the required vaccinations. Provides that until June 30, 2015 (instead of June 30, 2012), out-of-state transfer students may use unofficial transcripts for admission to a school until official transcripts are obtained from his or her last school district. With respect to the Educational Opportunity for Military Children Act, provides that the State Council shall be comprised of the Illinois P-20 Council, representatives appointed by the Illinois P-20 Council from the 3 school districts in this State with the highest percentage of children from military families, and one non-voting representative appointed by each active-duty military installation commander in this State (instead of having the Illinois P-20 Council and representatives appointed by the Illinois P-20 Council from the 3 school districts in this State with the highest percentage of children from military families constituting the State Council). Provides that the Act is repealed on June 30, 2015 (instead of June 30, 2012).

CRIM CD-AGG ASSAULT-JUV DETENT

Amends the Criminal Code of 1961. Includes in the offense of aggravated assault, the assault of an employee of a county juvenile detention center who provides direct and continuous supervision of residents of a juvenile detention center, including an employee of a county juvenile detention center who supervises recreational activity for residents of a juvenile detention center. Effective immediately.
