Amends the Mortgage Foreclosure Article of the Code of Civil Procedure. Defines "omitted subordinate interest". Provides that certain persons holding real estate encumbered by an omitted subordinate interest may file a strict foreclosure complaint consisting substantially of certain specified information. Provides that subject to the objection of the defendant, the court shall enter a judgment extinguishing the omitted subordinate interest by vesting absolute title to the mortgaged real estate in the plaintiff. Provides procedures by which a holder of an omitted subordinate interest may redeem the interest. Provides that a person whose omitted subordinate interest was not terminated by a prior foreclosure action does not have a right to file a strict foreclosure action. Effective immediately.
Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health's required publication of advance directive law must include the practitioner (instead of "physician") orders for life-sustaining treatment (POLST) form. Provides that the Department of Public Health shall develop and publish a uniform form for practitioner cardiopulmonary resuscitation (CPR) or life-sustaining treatment orders (instead of "physician do-not-resuscitate orders") that may be used in all settings. Changes references to the Department of Public Health DNR Advance Directive Form to references to the Department of Public Health Uniform POLST form. Makes corresponding changes in the Nursing Home Care Act, the Emergency Medical Services (EMS) Systems Act, the Hospital Licensing Act, and the Health Care Surrogate Act. Further amends the Health Care Surrogate Act. Provides that any attending health care practitioner (instead of "physician") may execute a POLST form or advance directive form. Defines "attending health practitioner" as an individual who (1) is an Illinois licensed physician, advanced practice nurse, physician assistant, or licensed resident after completion of one year in a program; (2) is selected by or assigned to the patient; and (3) has primary responsibility for treatment and care of the patient. Provides that nothing in the Section concerning POLST forms or do-not-resuscitate advance directive forms shall be construed to affect the ability of an individual to include instructions in an advance directive, such as a power of attorney for health care. Deletes language concerning the form of a DNR Advance Directive.
Creates the Uniform Electronic Legal Material Act to provide for the utilization of legal material in an electronic record. Applies to all legal material designated as official under the Act and published after its effective date. Defines legal material and other terms. Includes court reports, statutes, session laws, rules, and agency decisions. Provides for an official publisher for the material, including the Supreme Court and the Secretary of State. Provides for authentication of official electronic records and for their preservation. Establishes standards for implementing the Act.
Amends the Illinois Nuclear Facility Safety Act. Makes a technical change in a Section on legislative findings.
Amends the Illinois Rural/Downstate Health Act. Provides that moneys from fees shall be deposited into the Rural/Downstate Health Access Fund. Provides that moneys in the Rural/Downstate Health Access Fund may be used for programs for the medically underserved. Provides that fees may be collected by the Center for Rural Health and deposited into the Fund for the purpose of administering the J-1 Visa Waiver Program for international medical graduates and that the fees shall be dedicated to funding the J-1 Visa Waiver Program and may not be subject to the Fund's distribution formula. Makes other changes.
Amends the Unified Code of Corrections. Provides that the court may extend a term of probation or conditional discharge that was concurrent to, consecutive to, or otherwise interrupted by a term of imprisonment for the purpose of providing additional time to complete an order of restitution.
Amends the Criminal Code of 2012 concerning criminal fortification of a residence or building. Includes in the definition of "fortified condition" preventing or impeding entry through the use of video surveillance, motion sensing devices, or booby traps. Defines "booby traps" for purposes of the offense.
Amends the Illinois Highway Code. Makes a technical change in a Section concerning a county board's use of tax moneys.
Amends the Code of Civil Procedure. Provides that if a person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address, service of process may be effectuated by having the person serving the process mail a copy of the process via both regular and certified mail. Provides that service of the process shall meet the requirements of the Code set forth in Sections concerning forms of process and persons authorized to serve process; place of service; and failure to make return. Provides that the person serving the process shall execute and submit an affidavit confirming that the person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address and that the person serving the process has served the process in accordance with the new provisions.
