Amends the Illinois Public Aid Code. In provisions concerning education, training, and employment programs for TANF recipients, provides that, subject to a specific appropriation for this purpose, the Department of Human Services shall create a tiered-reimbursement rate system for child care providers. Provides that the purpose of this tiered-reimbursement rate system is to establish a set of performance standards that help children grow and learn. Directs the Department to convene a working committee of its standing Child Development Advisory Council to create the tiered-reimbursement rate system. Effective immediately.
Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.
Amends the Criminal Code of 1961. Provides that the offense of child abduction also includes intentionally luring or attempting to lure a child under the age of 16 into an aircraft, watercraft, or isolated area without the consent of the parent or lawful custodian of the child for other than a lawful purpose. Effective immediately.
Amends the Illinois Public Aid Code and the Family Caregiver Act. Provides that a family caregiver who provides in-home care to an older adult who is a frail individual and who claims that frail individual as a dependent for federal and State income tax purposes is eligible for cash assistance based on the frail individual's needs, not to exceed $2,000 per month. Requires the Department of Public Aid to apply for a waiver of federal law and regulations to allow the use of Medicaid funds to fund this cash assistance program, and requires the Department on Aging to cooperate with the Department of Public Aid to secure Medicaid funding. Effective immediately.
Amends the School Code. Authorizes school districts to establish and implement tutorial programs whereby qualified, able noncertificated volunteers assist students with their studies and course work. Amends the Illinois Income Tax Act. Allows a $500 income tax credit for individual taxpayers who volunteer for 100 or more hours during the taxable year with a volunteer tutorial program. Provides that the credit may not be carried forward or back and may not reduce the taxpayer's liability to less than zero. Effective immediately.
Amends the Public Aid Code. Provides that, pursuant to the implementation of a federal Medicare prescription drug benefit, the Department of Public Aid shall develop a new supplemental coverage program to help cover out-of-pocket expenses of individuals enrolled in the Medicare prescription drug benefit program. Provides guidelines for coverage under and eligibility for the program. Effective immediately.
Amends the Animal Control Act. Provides that the County Board shall (now, is authorized to) require the registration of dogs and cats. Provides that a microchip number may (now, shall) serve as the registration number. Deletes a requirement that microchips operate at a certain frequency.
Appropriates $350,000 from the General Revenue Fund to the Board of Higher Education for a course transferability program. Effective July 1, 2005.
Amends the Public Utilities Act. Provides that every telephone directory distributed to the general public in this State, which lists the calling numbers of telephones, of any telephone exchange located in this State, shall also contain a contact number that may be called by any person who is a victim of domestic violence and has an order of protection, as defined in the Illinois Domestic Violence Act of 1986, to have the victim's number removed from the directory. Provides that, upon contact by a victim of domestic violence, and presentation of the restraining order if required by the telephone directory company, the telephone directory company shall remove the victim's name and telephone number from the directory listing. Provides that every local exchange telephone corporation shall, without charge, change a customer's telephone number to an unlisted number, upon the request by a customer who has obtained an order of protection due to domestic violence under the Illinois Domestic Violence Act of 1986 and has presented a copy of that order to the local exchange telephone corporation. Amends the Illinois Domestic Violence Act of 1986. Provides that a victim of domestic violence who has obtained an order of protection under this Act may request an unlisted telephone number, to be changed without charge, as provided in the Public Utilities Act, from his or her local exchange telephone corporation. Provides that the local exchange telephone corporation may require that the victim of the domestic violence provide a copy of the order of protection to the company prior to the company granting the unlisted telephone number without a charge. Makes an exception to the requirement to change the telephone number without charge for emergency orders of protection and 30-day interim orders of protection. Effective immediately.
