PEN CD-CHGO TCHR-SALARY

Amends the Chicago Teacher Article of the Pension Code. Provides that salary received on or after July 1, 2003 for overtime, summer school, and other optional service shall be included in the calculation of salary for pension purposes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

ST PROMPT PAYMENT ACT-PENALTY

Amends the State Prompt Payment Act. Provides that if a State official or agency is late in payment of a vendor's bill or invoice for goods or services furnished to the State and the vendor is forced to borrow money to make up for the late payment from the State, in addition to any other payment the State is required to make to the vendor, the State must pay the vendor an amount equal to the vendor's debt service costs related to the money the vendor borrowed as a result of the late payment.

PEN CD-ST POL-RETMT AT ANY AGE

Amends the State Employee Article of the Illinois Pension Code. Provides that persons under the alternative (State police) retirement formula may retire at any age after having established service sufficient to provide an alternative formula annuity equal to at least 80% of final average compensation. Effective immediately.

SOS-INSPECTOR GENERAL

Amends the Secretary of State Act. Requires the Secretary of State to appoint, with the advice and consent of the Senate, an Inspector General. Provides that the Secretary of State may designate the Inspector General and members of the Inspector General's office as peace officers after those persons have completed basic police training. Allows the Inspector General to conduct investigations and make reports concerning fraud, corruption, and mismanagement in the Office of the Secretary of State; subpoena witnesses and evidence necessary to carry out the duties of the Inspector General, within specified limitations; and have direct access to the Secretary of State. Provides that a person who knowingly and intentionally fails to comply with a subpoena issued by the Inspector General is guilty of a Class A misdemeanor. Prohibits reprisals against employees of the Secretary of State who make complaints to or disclose information to the Inspector General. Requires the Secretary of State to adopt rules establishing requirements for investigations. Provides that any employee of the Secretary of State who is subject to investigation or inquiry by the Inspector General must be informed of his or her right to remain silent and to be represented by a representative of a labor organization. Provides that any employee of the Secretary of State who is subject to investigation or inquiry by the Inspector General must be informed of his or her right to remain silent and to be represented by a representative of a labor organization. Amends the Secretary of State Merit Employment Code. Provides requirements for the qualification of certain employees as inspectors. Effective immediately.

INCOME TAX ACT-PREPAID TUITION

Amends the Illinois Income Tax Act. Provides that, for taxable years beginning on or after January 1, 2003, moneys contributed during the taxable year by the taxpayer for the purchase of an Illinois prepaid tuition contract, excluding moneys rolled over from another qualified tuition program account, may be deducted from the taxpayer's federal adjusted gross income in arriving at base income for Illinois income tax purposes. Exempts the deduction from the sunset provisions of the Act. Amends the Illinois Prepaid Tuition Act to include a reference to the deduction. Effective immediately.

HEALTH FACIL PLAN-EXTND SUNSET

Amends the Illinois Health Facilities Planning Act. Defines "change of ownership of a healthcare facility", "related person", and "technical assistance". Precludes appointment of any person to the Illinois Health Facilities Planning Board on or after January 1, 2004, if that person has served more than 2 consecutive 3-year terms as a board member, except for ex-officio, non-voting members. Provides that a majority (now, 8) of the members of the board who currently hold office constitutes a quorum and that the affirmative vote of a majority (now, 8) of the voting members who currently hold office is required for action requiring a vote by the board. Provides for disqualification of a board member from consideration of an application under certain circumstances. Provides that an increase of 15 (now, 10) beds or 15% (now, 10%) of total bed capacity, by moving beds from one facility to another, over a defined 2-year period, requires a permit or exemption. Makes changes concerning exceptions to the permit or exemption requirement. Provides that an exemption shall be approved when information required by the board by rule is submitted. Provides that certain projects are eligible for an exemption, rather than a permit. Provides that the Director of the Department (now, the State Board) shall appoint a hearing officer within 30 days after the Director (now, the Chairman of the Illinois Health Facilities Planning Board) schedules a hearing to appeal an action by the board. Makes changes concerning the length of the hearing and the time in which the Board's final determinations must be made. Requires the Department of Public Health to issue a permit where the application receives positive findings on all of the Board's review criteria and the application is not objected to by any member of the public. Makes changes concerning data collection from health care facilities by the Department of Public Health and the way in which regulations, standards, criteria and state norms are reviewed, revised, promulgated, and posted. Extends the repeal date to January 1, 2008 (now, January 1, 2003). Makes other changes.
