Amends the Capital Development Board Act. Upon the effective date of the amendatory Act, abolishes the Illinois Building Commission (IBC), transfers all of its powers, duties, and functions to the Capital Development Board (CDB), and terminates all appointments to the Commission. Provides that CDB is the successor agency to IBC. Requires CDB to establish and administer an Ad Hoc Advisory Board on Building Codes and Regulations with members appointed by the Executive Director of CDB. Provides that members shall serve without compensation. Requires CDB to serve as a forum for resolution of conflicts between State agencies, or between State agencies and another entity that consents to the forum, concerning State building requirements and requires the Board to impose fees for the purpose of administering the dispute resolution forum. Repeals the Illinois Building Commission Act. Effective immediately.

Amends the Property Tax Code. Provides that a member of the armed forces of the United States, other than a reserve component, on active duty on the due date of any installment of taxes due under the Property Tax Code shall not be deemed delinquent in the payment of the installment until 90 days after the due date or, if the member is deployed outside the continental United States, 90 days after the member is redeployed to the continental United States. Provides that members of the reserve components of the armed forces of the United States or members of the National Guard who are on active duty shall not be deemed delinquent in the payment of the installment until 90 days (now, 30 days) after the member returns from active duty. Deletes provisions concerning an amnesty period in Cook County for certain National Guard members for taxes on homestead property due and payable in 1991 or 1992. Effective immediately.
Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Requires the Department of State Police to develop a statewide emergency alert system for missing endangered seniors, to develop a community outreach program to promote awareness among State citizens of senior endangerment prevention and response, and to appoint a Child and Senior Safety Coordinator (rather than a Child Safety Coordinator). Requires the Department to prepare a report containing certain information when it receives a notification of a missing endangered senior and to forward the report to certain other parties. Requires the Department to begin an investigation concerning the missing endangered senior no later than 24 hours after receiving notification of the missing endangered senior. Provides a definition of "missing endangered senior". Amends the Illinois Police Training Act to require the Illinois Law Enforcement Training Standards Board to provide a training program for law enforcement personnel of local governmental agencies in the statewide coordinated child abduction and missing endangered senior alert system (rather than the child abduction alert system). Effective January 1, 2006.
Amends the Downstate Teacher Article of the Illinois Pension Code. Provides that a teacher who (i) has been receiving a disability, occupational disability, or disability retirement benefit for at least one year and (ii) remains unable to resume regular full-time teaching due to disability, but is able to engage in limited or part-time employment as a teacher, may engage in such limited or part-time employment as a teacher without loss of the disability, occupational disability, or disability retirement benefit, provided that the teacher's earnings for that limited or part-time employment, when added to the amount of the benefit, do not exceed 100% of the salary rate upon which the benefit is based. Effective immediately.
Amends the IMRF Article of the Illinois Pension Code. Makes a provision added by Public Act 87-850 (which provided survivor's benefit eligibility for certain spouses who were married during the member's retirement) apply to a member who retired before March 26, 1992 but dies on or after the effective date of this amendatory Act. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Creates the Identity Theft Notification Act. Requires any data collector that owns or uses personal information in any form that includes personal information concerning an Illinois resident, to disclose any breach of the security of the system following discovery or notification of the breach in the security of the data, without regard for whether the data has been accessed by an unauthorized third party for legal or illegal purposes. Provides that notice may be provided in one of the following ways: (1) written notice; (2) electronic notice; or (3) substitute notice if the person or business demonstrates that the cost of providing notice would exceed $250,000, or the affected class of persons to be notified exceeds 500,000, or the person or business does not have sufficient contact information. Provides a private right of action for a violation of the Act.
Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Increases the death benefit from $3,000 to $5,000. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Downstate Police Article of the Illinois Pension Code. Allows a police officer to establish creditable service for up to 5 years of service in the military, naval, or air forces of the United States entered upon prior to becoming an active police officer of a municipality. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Creates the Blind Vendors Act. Provides that the Department of Human Services, Bureau of Blind Services, shall operate and promote the Business Enterprise Program for the Blind. Sets forth that the federal Randolph-Sheppard Act and the regulations adopted pursuant to that Act shall serve as the minimum standards for the operation of the Business Enterprise Program for the Blind. Provides that under the Program: (1) blind vendors have priority in the operation of all vending facilities on State property; (2) vending machine income from all vending machines on State property shall be assigned to the blind vendor on the property or to the Blind Vendors Trust Fund; (3) no State agency may impose any commission, service charge, rent, or utility charge on a blind vendor operating on State property; (4) sales made at a blind vendor's vending facility are exempt from all occupation and use taxes; and (5) State agencies may not allow competition with a blind vendor. Sets forth that the Bureau Director for the Bureau of the Blind and the Committee of Blind Vendors shall jointly develop regulations to ensure that priority is given to blind vendors in the operation of vending facilities on State property. Provides that the Department may provide for set-asides of the net proceeds of vending operations under certain conditions. Requires set-aside funds to be deposited in the Blind Vendors Trust Fund, a separate account managed by the Department for the State's blind vendors. Sets forth provisions for the distribution of vending machine income from vending machines on State property. Provides certain conditions for the licensing of blind vendors. Creates the Committee of Blind Vendors to jointly participate in the development and implementation of all policies, plans, and major decisions affecting the Business Enterprise Program for the Blind. Sets forth provisions for the composition of the Committee. Provides certain procedures for the resolution of disputes arising within the Program. Provides for the promulgation of regulations relating to the operation of this Act. Requires the Department to make regular surveys and reports on State property and vending facilities. Sets forth conditions and information to be contained in the surveys and reports. Preempts home rule powers. Repeals the Blind Persons Operating Vending Facilities Act. Amends the Use Tax Act, Service Use Tax Act, Service Occupation Tax Act, and Retailers' Occupation Tax Act to provide that personal property purchased from a blind vendor's vending facility licensed by the Department of Human Services under the Blind Vendors Act is exempt from the taxes imposed by those Acts and that these exemptions are not subject to the sunset provisions of those Acts.
Amends the Firearm Owners Identification Card Act. Provides that the $5 fee for the issuance of a Firearm Owner's Identification Card may not be increased until January 1, 2010 and the General Assembly may not pass any law increasing such fee until January 1, 2010. Effective immediately.
