Amends the Older Adult Services Act. In provisions concerning the development of a plan to restructure the State's service delivery system for older adults, provides that the Department on Aging and the Departments of Public Health and Healthcare and Family Services shall develop the plan no later than September 30, 2010. Provides that the plan shall protect the rights of all older Illinoisans to services based on their health circumstances and functioning level, regardless of whether they receive their care in their homes, in a community setting, or in a residential facility. Provides that financing for older adult services shall take into account individual preference but shall not jeopardize the health, safety, or level of care of nursing home residents. Effective immediately.

Amends the Property Tax Extension Limitation Law in the Property Tax Code. Provides that, beginning in levy year 2011, the definition of "aggregate extension" does not include special purpose extensions made for the purposes of a county or community mental health board, or a county or township board for care and treatment of persons with a developmental disability, when the applicable board has filed a written direction for a separate limiting rate with the county clerk. Provides that provisions concerning the calculation of a separate limiting rate for (i) community mental health funds and (ii) funds for persons with a developmental disability apply through levy year 2010. Effective immediately.
Creates the Afterschool Youth Development Project Act. Provides that because it is the policy of this State to provide all young people between the ages of 6 and 19 with access to quality afterschool programs through a State commitment to sufficient and sustainable funding for programs that promote positive youth development, the Illinois Youth Development Council is created. Provides that the purpose of the Council is to provide oversight and coordination to the State's public funds currently invested to support positive youth development programs and activities and to set system-wide policies and priorities to accomplish 5 specified objectives. Provides that the Council shall be governed by a board of no less than 28 and no more than 32 members and that the Council shall reflect the regional, racial, socio-economic, and cultural diversity of the State to ensure representation of the needs of all Illinois youth. Contains provisions concerning Council member appointments; the establishment of an independent Youth Advisory Group; the major objectives of the Council; afterschool demonstration programs; reporting requirements; and other matters. Provides that the Council shall be created within the Department of Human Services and that the Department shall provide resources to the Council including administrative services and data collection. Effective immediately.
Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning certificates of title.
Creates the Mercury Thermostat Collection Act. Requires thermostat manufacturers to establish an out-of-service mercury thermostat collection program that meets certain requirements. Requires thermostat manufacturers to submit certain reports on their collection programs to the Agency. Sets goals for the collection of out-of-service mercury thermostats. Provides that if those goals are not met, then the manufacturers must revise their collection programs as necessary to achieve the applicable goal. Requires contractors, service technicians, thermostat wholesalers, thermostat manufacturers, and thermostat retailers to handle and manage out-of-service mercury thermostats in a manner that is consistent with the provisions of the universal waste regulations adopted by the Illinois Pollution Control Board. On and after January 1, 2011, prohibits (i) thermostat wholesalers from selling, offering to sell, distributing, or offering to distribute thermostats unless certain requirements are met and (ii) contractors from removing, replacing, or otherwise taking mercury thermostats out of service unless the contractors deliver those thermostats to a collection site. On and after January 1, 2011, prohibits thermostat manufacturers that are in violation of the Act from selling, offering to sell, distributing, or offering to distribute thermostats in the State. Requires the Agency to post certain information on its website and to report certain information to the General Assembly. Provides for prosecution by the Attorney General or the State's Attorney of the county in which a violation occurs. Requires the Agency to make certain recommendations to the Governor and General Assembly by January 1, 2012. Effective immediately.
Amends the Property Tax Code. In a Section concerning the returning veterans' homestead exemption, provides that the veteran may apply the exemption for the taxable year after he or she returns if (i) he or she first acquires a principal residence during the taxable year in which he or she returns, but after January 1 of that year, and (ii) if the property is owned and occupied as a principal residence by the veteran on January 1 of the next taxable year. Effective immediately.
Amends the Illinois Vehicle Code. Provides that it is either an offense against the regulations governing the movement of vehicles or a Class A misdemeanor, depending on which provision applicable, for a person to accompany or provide instruction to a driver who is a minor and driving a motor vehicle pursuant to an instruction permit, while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof.

Amends the Criminal Code of 1961. Provides that aggravated assault of a peace officer, community policing volunteer, private security officer, fireman, employee of a police or sheriff's department, or person who is employed by a municipality and whose duties include traffic control is also a Class 4 felony (rather than a Class A misdemeanor) when a knife with a blade of at least 3 inches in length, dagger, dirk, switchblade knife, stiletto, axe, hatchet, bludgeon, black-jack, slungshot, sand-bag, sand-club, metal knuckles, billy, or other dangerous weapon of like character is used in the commission of the assault.
Amends the Unified Code of Corrections. Provides that the Department of Corrections must also make identification information and a recent photo of the inmate being released accessible on the Internet by means of a hyperlink labeled "Community Notification of Inmate Early Release" on the Department's World Wide Web homepage. Provides that the identification information shall include the inmate's: name, any known alias, date of birth, physical characteristics, residence address, commitment offense and county where conviction was imposed. Provides that the identification information shall be placed on the website within 3 days of the inmate's release and the information may not be removed until either: completion of the first year of mandatory supervised release or return of the inmate to custody of the Department. Effective immediately.
