Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.
Amends the Telecommunications Article of the Public Utilities Act. Makes a technical change in a Section concerning injunctive relief.
Amends the State Finance Act. Provides that each appropriation for a legislative member initiative must be by a separate line item appropriation that fully describes the legislative member initiative. Provides that no legislative member initiative may be funded through a lump sum appropriation. Provides that a bill making an appropriation for a legislative member initiative must be heard by a standing committee of each chamber and each initiative must be individually approved by the committee. Defines "legislative member initiative".
Amends the Code of Criminal Procedure of 1963. Provides that a statement of a witness is not excluded at the trial or hearing of any defendant by the hearsay rule or as a violation of any right to confront witnesses if the witness was killed, bribed, kidnapped, secreted, intimidated, or otherwise induced by a party, or one for whose conduct such party is legally responsible, to prevent the witness from being available to testify at such trial or hearing. Provides that the party seeking to introduce the statement shall disclose the statement sufficiently in advance of trial or hearing to provide the opposing party with a fair opportunity to meet it. Provides that the disclosure shall include notice of an intent to offer the statement, including the identity of the declarant. Provides that prior to ruling on the admissibility of a statement under this provision, the court shall conduct a hearing outside the presence of the jury. Provides that except in cases where a preponderance of the evidence establishes that the defendant killed the declarant, the party seeking to introduce the statement shall be required to show by a preponderance of the evidence that the party who caused the unavailability of the witness did so with the intent or motive that the witness be unavailable for trial or hearing. Provides that the court is not required to find that the conduct or wrongdoing amounts to a criminal act. Provides that nothing in this provision shall be construed to prevent the admissibility of statements under existing hearsay exceptions. Provides that the provisions of the Act are severable.
Amends the Medical Corporation Act. Requires officers, directors, and shareholders of medical corporations to be licensed under the Medical Practice Act of 1987 or the Podiatric Medical Practice Act of 1987 (rather than the Medical Practice Act of 1987 only). Effective immediately.
Amends the Toll Highway Act. Provides that no person or entity, other than the Illinois State Toll Highway Authority, may operate or administer a system, other than the 9-1-1 emergency telephone system, for responding to calls from persons seeking emergency or non-emergency assistance on toll highways. Provides that the Authority may not operate or administer a system, other than the 9-1-1 emergency telephone system, for responding to calls for emergency assistance. Provides that the Authority may operate its own system for responding to calls for non-emergency assistance, if the number to be dialed by persons utilizing the system does not contain the digit "9". Provides that the Authority may not promote, by means of signs or by any other means, the use of any system other than the 9-1-1 system by any person seeking emergency or non-emergency assistance on toll highways. Effective July 1, 2008.
Amends the Illinois Municipal Code. Authorizes non-home rule municipalities to impose a real estate transfer tax. Requires referendum approval to impose or increase the rate of the tax. Effective immediately.
Amends the Illinois Public Labor Relations Act. Provides that no employee may be considered a "managerial employee" because he or she belongs to a classification of employees to whom executive and managerial functions may be delegated, unless the labor board in a hearing finds actual delegation on a regular basis. Provides that no employee may be classified a "managerial employee" because he or she performs professional duties. Provides that in determining an employee's status, the labor board shall consider the employee's actual job duties and responsibilities and the extent to which the employee has actual authority concerning the overall operations and governance of the employee's office or workplace. Provides that an employee of the Cook County States Attorney shall not be considered a "managerial employee" if that employee is not directly responsible for wages, fringe benefits, hours, holidays, vacations, sick leave, or other conditions of employment. Effective immediately.
Declares a statement of budgetary intent that any proceeds to the State from any sale, long-term lease, or transfer of rights over the Illinois State Lottery, or any other revenue-generating sources created for a significant State capital construction program, be applied first to clearing any unpaid debts owed by the State to providers of health care services under the Medicaid program and other State-funded health-care programs.
