Amends the Illinois Vehicle Code. Authorizes municipalities to adopt procedures for the impoundment of vehicles used in the commission of a reckless driving offense (a) as part of a funeral procession or (b) in such a manner that interferes with a funeral procession. Effective immediately.

Amends the Communicable Disease Prevention Act. Makes changes to the provision concerning children of school age who are reported as having been diagnosed as having AIDS or HIV. Provides that the information contained in the notification to be required of the Department of Public Health with regard to a child enrolled in a public school in kindergarten through fifth grade who is diagnosed as being infected with HIV must not be recorded in the child's permanent record. Provides that if the information is in the child's permanent school record, the information must be purged from the child's record before the child enters the sixth grade. Provides that if the child is enrolled in a public school, the principal shall disclose (instead of disclose the identity of the child) to the superintendent of the school district in which the child resides and specifies that the disclosure shall be that a child has been infected with HIV. Provides that all provisions of the AIDS Confidentiality Act shall apply, including penalties for violation of that Act.
Amends the Prevention of Tobacco Use by Minors and Sale and Distribution of Tobacco Products Act. Provides that a person, either directly or indirectly by an agent or employee, or by a vending machine owned by the person or located in the person's establishment, may not sell, offer for sale, give, or furnish any alternative nicotine product, or any cartridge or component of an alternative nicotine product, to a person under 18 years of age. Provides that before selling, offering for sale, giving, or furnishing an alternative nicotine product, or any cartridge or component of an alternative nicotine product, to another person, the person selling, offering for sale, giving, or furnishing the alternative nicotine product shall verify that the person is at least 18 years of age by: (1) examining from any person that appears to be under 27 years of age a government-issued photographic identification that establishes the person is at least 18 years of age or (2) for sales made though the Internet or other remote sales methods, performing an age verification through an independent, third-party age verification service that compares information available from public records to the personal information entered by the person during the ordering process that establishes the person is 18 years of age or older. Establishes penalties.
Amends the Wildlife Code. Makes a technical change in a Section concerning the short title.
Creates the Violence Prevention Task Force Act. Establishes the Violence Prevention Task Force consisting of 6 members, one each appointed by legislative leaders and 2 appointed by the Governor. Provides that the Task Force shall: (1) increase awareness of resources, jobs, and opportunities to prevent violence in the State; (2) assist violence prevention groups, religious institutions, social lodges, community groups, block clubs, and other groups in providing safe havens for children, youth, young adults, and seniors; (3) create, develop, and implement recreational, social, and educational initiatives for at-risk youth; (4) train all interested persons to become community organizers, field organizers, neighborhood leaders, data coordinators, and event coordinators; and (5) assist in providing jobs, resources, and opportunities for at-risk youth so as to prevent them from committing crimes. Provides that the members of the Task Force shall serve without compensation but shall be reimbursed for their reasonable and necessary expenses from funds appropriated for that purpose. Provides that the Task Force shall receive the assistance of legislative staff, may employ skilled experts with the approval of the chairperson, and shall receive the cooperation of those State agencies it deems appropriate to assist the Task Force in carrying out its duties. Provides that the Department of Children and Family Services shall provide administrative and other support to the Task Force.
Amends the Illinois Income Tax Act. In a Section concerning a credit for wages paid to ex-felons, removes a provision providing that the credit may not exceed $600 for each qualified ex-offender. Provides that the credit is exempt from the Act's automatic sunset. Amends the Economic Development for a Growing Economy Tax Credit Act. Provides that each Agreement entered into on or after the effective date of the amendatory Act shall contain a provision stating that the Applicant shall establish a goal of hiring qualified ex-offenders so that no less than 10% of the jobs created or retained under the Agreement are filled by qualified ex-offenders. Effective immediately.
Creates the Privacy in the School Setting Act. Defines "school" as an institution of higher learning as defined in the Higher Education Student Assistance Act, a public elementary or secondary school or school district, or a nonpublic school recognized by the State Board of Education. Provides that it is unlawful for a school to request or require a student or prospective student or his or her parent or guardian to provide a password or other related account information in order to gain access to the student's or prospective student's account or profile on a social networking website or to demand access in any manner to a student's or prospective student's account or profile on a social networking website. Provides that a school or an agent of a school who violates the Act is guilty of a petty offense.
Amends the Unified Code of Corrections. Amends the definition of "imprisonment" to include electronic home detention served by an offender after the offender has been committed to the custody of the sheriff to serve the sentence and the sheriff has placed the offender in an electronic home detention program. Provides that when an offender is sentenced under a provision of law that requires the sentence to include a minimum term of imprisonment and the offender is committed to the custody of the sheriff to serve the sentence, the sheriff may place the offender in an electronic home detention program for service of that minimum term of imprisonment unless the offender was convicted of an excluded offense as defined in the Electronic Home Detention Law or the court's sentencing order specifies that the minimum term of imprisonment shall be served in a county correctional facility.
Amends the Criminal Identification Act. Allows a person to petition the court and the court to order the sealing of: (1) Class 2 felony conviction records for burglary, delivery of a controlled substance, and possession of a stolen motor vehicle; (2) Class 3 felony conviction records for theft, retail theft, deceptive practices, and forgery; and (3) Class 4 felony conviction records for possession of cannabis, possession of a controlled substance, violation of the Methamphetamine Precursor Control Act, violation of the Steroid Control Act, prostitution, theft, retail theft, deceptive practices, forgery, and possession of burglary tools (rather than only Class 4 felony convictions for possession of cannabis, possession of a controlled substance, Methamphetamine Precursor Control Act, Steroid Control Act, and prostitution). The sealing is allowed 4 years after termination of the person's last sentence. Requires a person petitioning to seal a drug offense to pass a drug test within the 30 days preceding the filing of the petition to seal.
Amends the Regulatory Sunset Act. Extends the repeal of the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004 from January 1, 2014 to January 1, 2024. Amends the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004. Makes changes to provisions concerning definitions, legislative intent, issuance of license, unlawful acts, exemptions, qualifications for licensure under the Act, training for private security contractors and employees, uniforms, consumer protection, inspection of facilities, renewal of licenses, employee requirements, employment requirements, requirement for a firearm control card and training, armed proprietary security forces, injunctive relief, discipline, submission to physical or mental examination, complaints, investigations, and hearings, suspension of licenses, restoration of licenses, unlicensed practice, the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Board, powers and duties of the Department of Financial and Professional Regulation, and confidentiality. Effective immediately.
