LOTTERY-AFTER SCHOOL RESCUE

Amends the Illinois Lottery Law. Requires the Department of Revenue, beginning on January 1, 2011 or as soon thereafter as is practical, to offer a special instant "After-School Rescue" scratch-off game. Requires the net revenue from that game to be deposited into the After-School Rescue Fund for appropriation by the General Assembly solely to the Illinois State Board of Education for the making of grants to at-risk schools for the promotion of extracurricular and after-school programs. Authorizes the Department, after consulting with the Illinois State Board of Education, to adopt rules necessary to implement and administer the game. Defines "net revenue". Amends the State Finance Act to create the After-School Rescue Fund. Effective immediately.

STATE EMPLOYMENT APPLICATION

Creates the State Employment Application Act. Provides that an application for State employment may not contain any question as to whether the applicant was convicted of or placed on supervision for a non-violent criminal offense but must contain a question as to whether the applicant for State employment has ever been convicted of a violent offense that is classified as a felony. Provides that nothing in the Act shall be construed to prohibit a State agency from conducting a criminal background check of an applicant for State employment. Provides that if a federal or State law disqualifies a person convicted of certain offenses from holding a position, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that if an applicant is applying for a position of peace officer, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that nothing in the Act prohibits a decision to refuse to hire on the basis that the applicant has been convicted of a criminal offense. Effective immediately.

TRANS FAT RESTRICTION ACT

Creates the Trans Fat Restriction Act. Sets forth definitions for "food facility" and "trans fat". Provides that every food facility shall maintain the manufacturer's documentation for any food or food additive that is or includes any fat, oil, or shortening for as long as the food or food additive is stored, distributed, or served by the food facility or used in the preparation of food within the food facility. Provides that beginning on July 1, 2010, no oil, shortening, or margarine containing trans fat for use in spreads or frying, except for the deep frying of yeast dough or cake batter, may be stored, distributed, or served by a food facility or used in the preparation of food within a food facility. Provides that beginning on July 1, 2011, no food containing trans fat, including oil and shortening that contains trans fat for use in the deep frying of yeast dough or cake batter, may be stored, distributed, or served by a food facility or used in the preparation of food within a food facility. Provides that the Department of Public Health shall adopt rules to administer and enforce the Act.

CIGARETTE TAX INCREASE

Amends the Cigarette Tax Act and the Cigarette Use Tax Act. Provides that, beginning July 1, 2009, an additional tax of 50 mills per cigarette ($1 per package of 20) shall be imposed. Effective immediately.

CHILD SUPPORT-INCARCERATED

Amends the Illinois Public Aid Code, the Unified Code of Corrections, and the Illinois Marriage and Dissolution of Marriage Act. Provides that an incarcerated person obligated to pay child support who has gross income of less than $200 per month is presumed to have no ability to pay child support. Provides that the Department of Human Services shall initiate an action to modify a support obligation if either the obligor or the obligee receives child support enforcement services. Provides that the Department of Corrections shall develop and establish a program in the Adult Division designed to permit committed persons who are obligors to request assistance from the Department of Healthcare and Family Services in obtaining a child support order modification.

Amends the Code of Civil Procedure. Provides that in a foreclosure action while the municipality within which the property is located shall not be joined as a party unless joined under other provisions of the Code, the municipality shall be added to the service list in the foreclosure action and all parties shall provide the clerk of the municipality with a copy of any document or notice filed in the foreclosure action. Effective immediately.
