Amends the Genetic Information Privacy Act. Adds several definitions. Provides that the Act applies to the State and local governments. Provides that an employer, employment agency, labor organization, and licensing agency shall not directly or indirectly do any of the following: (1) solicit, request, require or purchase genetic information of a person or administer a genetic test to a person as a condition of employment, preemployment application, labor organization membership, or licensure; (2) affect the terms, conditions, or privileges of employment, preemployment application, labor organization membership, or licensure, or terminate the employment, labor organization membership, or licensure of any person because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); (3) limit, segregate, or classify employees in any way that would deprive or tend to deprive any employee of employment opportunities or otherwise adversely affect the status of the employee as an employee because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); or (4) retaliate through discharge or in any other manner against any person alleging a violation of this Act. Makes other changes. Preempts home rule.
Amends the Township Code. Provides that a township may lease a wireless telecommunications tower for up to 25 years (instead of 10 years) at fair market value. Effective immediately.
Amends the State Finance Act. Transfers specified amounts from various State treasury funds into the Audit Expense Fund. Effective immediately.
Amends the Private Sewage Disposal Licensing Act. Provides that the Department of Public Health may evaluate existing Experimental Use Permits and issue site specific approval for performance-based systems, but may not issue any new Experimental Use Permits. Provides that the Department may review alternative technology and operational data from the appropriate state agency of another state, from another government entity, or from an independent testing organization to determine whether approval of components or private sewage disposal systems within the State is appropriate. Provides that the Director of Public Health shall authorize the use of appropriate new innovative wastewater treatment systems to best protect public health, the environment, and the natural resources of the State. Effective immediately.
Amends the Podiatric Medical Practice Act of 1987, the Professional Service Corporation Act, and the Limited Liability Company Act. Replaces certain references to the practice of medicine in all of its branches with references to practice under the Medical Practice Act of 1987.
Congratulates Charles M. Hill Sr. for 25 years of service and dedication as a member of the Illinois FAIR Plan Association Governing Committee and the Illinois Mine Subsidence Insurance Fund Board of Directors.
Amends the Illinois Act on the Aging. Makes a technical change in the definition of "Director".
Amends the Covering ALL KIDS Health Insurance Act. Provides that there shall be no co-payment or coinsurance required for any services under the Covering ALL KIDS Health Insurance Program (now, children enrolled in the Program are not required to provide a co-payment or coinsurance for well-baby or well-child health care, including, but not limited to, age-appropriate immunizations as required under State or federal law). Requires the Department of Healthcare and Family Services to report to the General Assembly no later than September 1 of each year beginning in 2007 on the number of professionals serving in the primary care case management program and the number of individuals enrolled in the Program according to certain demographics. Requires the Department to ensure adequate access to specialty physician care for Program participants allowing referrals to be accomplished without undue delay. Provides Program standards for disease management programs and performance measures implemented by the Department and requires the Department to adopt variance procedures for the application of any disease management program or any performance measures to an individual enrollee. Makes other changes.
Amends the Children with Disabilities Article of the School Code. Provides that when a child who is eligible for special education reaches the majority age of 18 years, rights accorded to the child's parents transfer to the child. Provides that rights shall not transfer from the parents to the child if the child has been determined to be incompetent under State law or the child has not been determined to be incompetent, but does not have the ability to provide informed consent with respect to the child's educational program. Requires the State Board of Education to adopt rules establishing criteria for school districts to determine if a child lacks the ability to provide informed consent and uniform procedures for allowing the parents of the child, another adult caregiver, or another responsible adult to exercise rights on behalf of the child. Effective immediately.
