PTELL-SCHOOL SAFETY LEVIES

Amends the Property Tax Extension Limitation Law in the Property Tax Code. Provides that a school board may, with referendum approval, elect to provide that the aggregate extension of the school district does not include any extension made: (i) for fire prevention and safety purposes under the School Code; and (ii) to pay the principal and interest on fire prevention and safety bonds issued under the School Code or on bonds issued to refund any fire prevention and safety bonds. Sets forth requirements for the referendum. Effective immediately.

CIGARETTE TX-SALES REP LICENSE

Amends the Cigarette Tax Act and the Cigarette Use Tax Act. Defines "Manufacturer's sales representative". Provides that a manufacturer's sales representative may be licensed as a secondary distributor provided that (i) the representative does not possess a quantity in excess of 125 cartons of stamped packages of cigarettes for resale to retailers and (ii) a representative licensed as a secondary distributor is subject to recordkeeping requirements and other restrictions.

INS CD-RBC-SURPLUS LINE

Amends the Illinois Insurance Code. Includes within the meaning of a company action level event the filing of a risk-based capital (RBC) report by an insurer that indicates that the insurer, if a property and casualty insurer, has total adjusted capital that is greater than or equal to its company action level RBC, but less than the product of its authorized control level RBC and 3.0 and triggers the trend test determined in accordance with the trend test calculation included in the property and casualty RBC Instructions. In the provisions concerning surplus line insurance and domestic surplus line insurers, makes changes to current definitions and sets forth additional definitions. Sets forth requirements for licensed surplus line producers concerning the procurement of surplus line insurance. Deletes certain provisions concerning surplus line producer licensure and provides instead that the State shall participate in the national insurance producer database of the National Association of Insurance Commissioners, or any other equivalent uniform national database, for the licensure of surplus line producers and the renewal of such licenses. Sets forth surplus line tax rates for surplus line insurance policies and contracts. Provides that for the purposes of the federal Nonadmitted and Reinsurance Reform Act of 2010, a domestic surplus line insurer shall be considered a nonadmitted insurer, as the term is defined in that Act, with respect to risks insured in the State. Contains a severability provision. Effective immediately.

ENTERPRISE ZONE-EXTEND 20 YEAR

Amends the Illinois Enterprise Zone Act, the Retailers' Occupation Tax Act, and the Public Utilities Act. Provides that the corporate authorities of a county or municipality may extend an Enterprise Zone for an additional 20-year period. Effective immediately.

RENEWABLE ELECTRICITY RESOURCE

Provides that the amendatory Act may be referred to as the Illinois Renewable Electricity Resources Act. Amends the Illinois Power Agency Act. Defines "bundled renewable energy resources", "delivery services", "delivery services non-eligible retail customers", "excluded renewable energy resources contract costs", and "service area". Provides that procurement plans for periods beginning on or after June 1, 2012 shall include procurement of renewable energy credits in amounts projected to be sufficient to meet the renewable energy resources standard with respect to the kilowatthour usage of delivery services non-eligible retail customers. Provides that the Illinois Power Agency Renewable Energy Resources Fund shall be terminated upon depletion of all its funds through the purchase of renewable energy credits. Makes changes to provisions concerning the renewable portfolio standard. Makes other changes. Amends the Public Utilities Act. Provides that beginning on June 1, 2012, an electric utility shall be entitled to recover through its tariffed charges for delivery services the costs of any renewable energy credits purchased to meet certain renewable energy resource standards under the Illinois Power Agency Act and any excluded renewable energy resources contract costs as defined under the Illinois Power Agency Act. In a provision concerning renewable portfolio standards for alternative retail electric suppliers and electric utilities operating outside their service territories, provides that until May 31, 2012 an alternative retail supplier shall be responsible for procuring cost-effective renewable energy resources as required under the Act (previously, no date cut-off for the requirement). Provides that certain obligations of alternative electric suppliers and electric utilities operating outside their service territories and certain obligations of the Commission shall terminate effective May 31, 2012, provided, that the alternative electric suppliers and electric utilities operating outside their service territories shall be obligated to make all alternative compliance payments that they were obligated to pay for periods through and including May 31, 2012, but were not paid as of that date. Makes other changes. Includes a severability provision. Effective immediately.
