Amends "An Act making appropriations", Public Act 95-348. Restores and increases a vetoed appropriation to the Department of Agriculture for deposit into the State Cooperative Extension Service Trust Fund, and adds language providing that the appropriation is for 4-H Youth Development Educators. Effective immediately.

TEACHER CERT-CRIM HIST REC CK

Amends the School Code and the Department of State Police Law of the Civil Administrative Code of Illinois. Requires the State Board of Education to develop a streamlined system in which school boards report to the State Board on instances in which misconduct by a teacher that involves a child leads to the teacher's dismissal or resignation. Requires a school board to report to the State Board all instances in which misconduct by a teacher that involves a child leads to the teacher's dismissal or resignation. Provides that the State Board shall require that each person seeking a teaching certificate in this State or renewing a teaching certificate in this State, as part of the issuance and renewal process, authorize an investigation to determine if the person has ever been convicted of a crime and, if so, the disposition of those convictions. Provides that the investigation shall consist of a fingerprint-based criminal history records check. Provides that any criminal convictions and their disposition information obtained by the State Board is confidential; provides for a penalty for violating this provision. Amends the State Mandates Act to require implementation without reimbursement.

PRISON LITIGATION

Creates the Prison Litigation Reform Act. Provides that the court, on its own motion or on the motion of a party, shall dismiss any inmate suit relating to the conditions of confinement or the effects of actions by government officials on the lives of persons confined in prison if the court is satisfied that the action is frivolous, is malicious, seeks monetary relief from a defendant who is immune from such relief, or fails to state a cause of action based upon which relief can be granted. Provides that if the court makes a determination to dismiss a suit based on the content, or lack thereof, of the complaint, the court may dismiss the underlying claim without first requiring the exhaustion of administrative remedies. Provides that before service of process on the defendants, the court shall review the complaint in any civil action in which an inmate seeks redress from a governmental entity or officer or employee of a governmental entity. Provides that in any inmate suit in which attorney's fees are authorized, such fees shall be awarded only to the extent they were directly and reasonably incurred in proving an actual violation of the plaintiff's rights protected by a statute pursuant to which fees may be awarded, and the amount of the fee is proportionately related to the court-ordered relief for the violation or the fee was directly and reasonably incurred in enforcing the relief ordered for the violation. Provides that an inmate may not bring a civil action or appeal a judgment in a civil action or proceeding in forma pauperis if the inmate has, on 3 or more prior occasions while incarcerated or detained in any facility, brought an action or appeal in a State court that was dismissed on the grounds that it was frivolous or malicious, unless the inmate is in imminent danger of serious physical injury.

NURSING BOARD-MEDICATION AIDE

Creates the Medication Aide Pilot Program Act. Directs the Board of Nursing to establish a pilot program in assisted living establishments to determine the impact on resident health and safety of allowing certified nursing assistants acting as pilot study medication aides to administer medications under educational requirements and conditions prescribed by the Board. Prohibits assisted living establishments participating in the pilot program from replacing existing registered nurse and licensed practical nurse positions with certified nursing assistants or pilot study medication aides. Requires the pilot program to be completed by December 1, 2010, and requires the Board to report the results to the Governor and the General Assembly. Effective immediately.

PREVAILING WAGE-FACILITIES

Amends the Prevailing Wage Act. Provides that workers at a facility dedicated exclusively, or nearly so, to performance of the contract or project and located in such proximity to the actual construction location that it would be reasonable to include them, or that perform work specifically designated for installation on a public works project, shall be deemed to be employed on public works. Provides for coverage of "the transportation of aggregate and excavated materials and equipment operated to haul to or from the site". Provides that workers who are paid a set amount for truck expense and take-home wage and are deemed to be employed on the public works project are entitled to the proper prevailing wage for the equipment being operated, and provides for the determination of the take-home wage. Provides that the transportation by sellers and suppliers or the manufacture of non-aggregate materials or equipment in the execution of a contract for public works with a public body are not deemed to be employment on public works. Makes other changes.

MERCURY-AD PRDCTS-COSMETICS

Amends the Mercury-added Product Prohibition Act. Provides that no person shall distribute or sell any cosmetics, toiletries, or fragrances containing mercury. Provides that any person who knowingly sells or distributes mercury-containing cosmetics, toiletries, or fragrances in this State commits a petty offense and shall be fined up to $500. Provides that a manufacturer that distributes cosmetics, toiletries, or fragrances containing mercury to persons in this State must disclose the level of mercury in its cosmetics, toiletries, or fragrances. A manufacturer who fails to disclose the level of mercury in its cosmetics, toiletries, or fragrances commits a business offense and shall be fined $10,000. Effective January 1, 2009.
