ENERGY ASSIST-HFS-TAX CHECKOFF

Amends the Illinois Economic Opportunity Act, the State Finance Act, the Illinois Income Tax Act, the Illinois Municipal Code, the Public Utilities Act, the Energy Assistance Act, and the Good Samaritan Energy Plan Act. Makes provisions concerning transfers to the General Revenue Fund from other funds not applicable to the Supplemental Low-Income Energy Assistance Fund, the Good Samaritan Energy Trust Fund, and the Energy Assistance Program Fund. Creates an Illinois income tax checkoff whereby a taxpayer may make a contribution to the Energy Assistance Program Fund. Prohibits the termination of gas or electric utility service to residential users who participate in or are eligible for the energy assistance program, and provides for reconnection of utility service to such households. Provides for administration of the energy assistance program and the Good Samaritan Energy Trust Fund by the Department of Healthcare and Family Services instead of the Department of Commerce and Community Affairs (now Department of Commerce and Economic Opportunity); requires the Department to adopt rules providing for enhanced enrollment for eligible consumers to receive energy assistance, and requires gas and electric utility companies and cooperatives to assist in coordinating low-income energy assistance. Provides that the annual eligibility level for the energy assistance program may not be lower (instead of higher) than 150% of the federal poverty level. Deletes the repeal of provisions concerning the Supplemental Low-Income Energy Assistance Fund scheduled for December 31, 2007. Makes other changes. Effective immediately.

REVENUE-ROAD APPROPRIATIONS

Proposes to amend the Revenue Article of the Illinois Constitution. Specifies the State and local highway purposes for which moneys derived from motor vehicle and motor vehicle fuels fees, excises, and license taxes may be used. Limits each fiscal year's total appropriations for State traffic law enforcement, administration of motor vehicle laws, and administration and collection of motor vehicle and motor vehicle fuel fees, excises, and license taxes to 5% of the amount of those fees, excises, and taxes collected in the previous fiscal year. Effective upon being declared adopted.

VEH CD-TEMP DISABILITY PARKING

Amends the Illinois Vehicle Code. Provides that a licensed physician or qualified physician assistant or advanced practice nurse, if he or she certifies that an applicant is eligible for disability license plates or a disability parking decal or device, may issue that applicant a temporary disability parking pass, which the applicant may use for 30 days or until he or she receives disability parking plates or a disability parking decal or device, whichever is earlier. Provides that the Secretary of State shall issue these temporary parking passes to licensed physicians and qualified physician assistants and advanced practice nurses upon request and without charge and shall adopt rules for implementing the provision. Makes corresponding changes in other provisions of the Vehicle Code and the Motor Fuel Sales Act. Provides that it is a violation of the Code to possess, issue, manufacture, or transfer a fictitious or fraudulent temporary disability parking pass or to alter a temporary pass or to provide false information to obtain a pass. Imposes the same penalties as apply to fictitious or fraudulent disability license plates and parking devices.

RESTRICT MAILING REGISTRY ACT

Creates the Restricted Mailing Registry Act. Provides that, beginning January 1, 2007, mailings to residents of this State soliciting the sale of consumer goods or services are prohibited if the address has been placed on the Restricted Mailing Registry. Provides that the Illinois Commerce Commission shall establish and provide for the operation of a Restricted Mailing Registry, which shall contain a list of the mailing addresses of residential residents who do not wish to receive mailing solicitations. Provides that the Illinois Commerce Commission shall work to notify residents about the availability of and instructions for requesting Registry information from the Illinois Commerce Commission. Provides that the Illinois Commerce Commission shall include, on its Internet web site, information for residents regarding their right to be included in the Registry and the various methods of being included in the Registry. Requires the Illinois Commerce Commission to make the information available on its web site no later than January 1, 2007. Creates exceptions. Provides for administrative penalties to be imposed by the Illinois Commerce Commission. Amends the State Finance Act to create the Restricted Mailing Registry Fund. Provides for fines and fees to be deposited into the Fund and for the use of the Fund to administer the Act. Effective immediately.
