Amends the Illinois Vehicle Code. Provides for the issuance of Iraqi Freedom license plates at an additional initial charge of $40 and an additional renewal charge of $27 with eligibility requirements to be determined by the Secretary of State. Provides that $15 of the initial charge and $2 of the renewal charge shall be paid into the Secretary of State Special License Plate Fund and $25 of the initial charge and $25 of the renewal charge shall be paid into the Illinois Veterans Assistance Fund. Amends the Illinois Lottery Law. Provides that the moneys deposited into the Illinois Veterans Assistance Fund from the sale of Iraqi Freedom license plates may, subject to appropriation, be used by the Department of Veterans' Affairs to provide grants to assist in the financial and educational support of minor and dependent children of veterans who died or were disabled in the line of duty.

Amends the Illinois Renewable Fuels Development Program Act. Provides that a recipient of Program grants must be constructing, modifying, altering, or retrofitting an (i) ethanol plant (now, just plant) that has annual production capacity of no less than 30,000,000 gallons of renewable fuel per year or a (ii) biodiesel plant. Requires the Department of Commerce and Economic Opportunity to establish and administer grant programs including: the Illinois Renewable Fuels Majority Blended Ethanol Program, the Illinois Corn Grain to Fuel Research Consortium Assistance Program, the Illinois Renewable Fuels Corn-to-Hydrogen Fuel Cell Research Program, the Illinois Renewable Fuels Biodiesel Infrastructure Grant Program, the Illinois Renewable Fuels Ethanol Development Intergovernmental Assistance Program. Sets forth the purposes and conditions for these grant programs. Provides that subject to appropriation (now, subject to appropriation from the Build Illinois Bond Fund), the Director is authorized to award Renewable Fuels Development Program Fund grants. Sets forth that the annual aggregate amount for these grants shall not exceed $25,000,000 in Fiscal year 2007 and 2008 and $15,000,000 thereafter (now, may not exceed $15,000,000). Specifies how these grant funds shall be allocated. Sets forth certain limitations on spending on the various Program grants including for research conducted at the National Corn-to-Ethanol Research Facility at SIU-Edwardsville not to exceed $1,000,000 annually, and a one-time grant in FY 2007 not to exceed $3,000,000 for construction, remodeling, and expansion of the National Corn-to-Ethanol Research Facility at SIU-Edwardsville. Provides that normal operating and execution of renewable fuels programs in existence on January 1, 2006 within the Department from the Renewable Fuels Development Program Fund shall not exceed $5,000,000 annually. Amends the State Finance Act to create the Renewable Fuels Development Program Fund as a special fund in the State treasury to fund these grant programs. Sets forth certain conditions for the operation of this Fund. Provides for certain annual payments from the General Revenue Fund to the Renewable Fuels Development Program Fund. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act, to provide that on or after July 1, 2006 and on or before June 30, 2016, those tax rates apply to 90% of the proceeds of sales made on gasohol (now, apply to 80% of the proceeds of sales made on gasohol). Amends the Motor Fuel and Petroleum Standards Act to provide that beginning January 1, 2008 a minimum of 10% of all motor fuel sold or offered for sale in Illinois must be denatured ethanol and that beginning January 1, 2012 a minimum of 15% of all motor fuel sold or offered for sale in Illinois must be denatured ethanol. Effective July 1, 2006.
Amends the Recreational Use of Land and Water Areas Act. Provides for State-owned or managed lands and waters to be included in the Act. Provides new definition for "recreational or conservation purpose" to include numerous activities or combinations of activities such as hunting, hiking, rock climbing, trapping, fishing, swimming, boating or any activity undertaken for resource management, exercise, education, pleasure, and the operation of any off-highway vehicle to pursue any of those activities. Effective immediately.
Amends the Municipal Code. In a Section that provides that a non-home rule unit shall not assign a fireman to perform police duties or a policeman to perform firefighting duties, provides that the Section does not apply to municipalities with a population of less than 60,000. Effective immediately.
Amends the Real Estate Transfer Tax Law in the Property Tax Code. Requires the Department of Revenue to establish a system to allow a recorder or registrar of titles of a county to purchase revenue stamps electronically from the Department and to deliver the electronically-purchased stamps to the recorder or registrar of titles.
Amends the Human Skeletal Remains Protection Act to authorize the Historic Preservation Agency and Illinois State Museum to release human skeletal remains and artifacts to a unit of local government for reburial if the Agency determines that the release promotes and complies with the purposes of the Act.
Amends the Illinois Renewable Fuels Development Program Act. Makes a technical change in a Section concerning the findings of the General Assembly.
Amends the Public Utilities Act. Requires each electric utility to submit to the Illinois Commerce Commission a non-emergency vegetation management schedule for the utility's service areas that is no more than 4 years in duration and that ensures that trees in all parts of the utility's service areas are trimmed at least once every 4 years. Requires the Commission to post the schedule on its web site. Requires each electric utility to submit an annual report to the Commission indicating the percentage of the utility's vegetation management schedule that has been completed along with an affidavit from a representative of the utility that lists the number and nature of all complaints for the previous calendar year related to the ANSI A300 standards. Requires compensation for affected customers if more than 0.8% of the electric utility's total customers (now, more than 30,000 of the electric utility's customers) are subject to (i) a continuous interruption of power lasting 4 hours or more that results in the transmission of power at less than 50% of the standard voltage or that results in the total loss of power transmission or (ii) a power surge or other fluctuation that causes damage. Provides that the Illinois Commerce Commission shall require certain electric utilities or alternative retail electric suppliers to submit certain data concerning non-supervisory employees. Requires Commission rules to set forth (i) standards for inspecting, maintaining, and repairing certain electric generation facilities and electric transmission or distribution facilities and (ii) safety and reliability standards for certain electric generation facilities and electric transmission and distribution facilities. Deletes a provision that certain requirements apply only to an electric public utility having 1,000,000 or more customers.
Amends the Nursing Home Care Act. Requires that the State Long Term Care Ombudsman be provided with (1) a copy of a notice of involuntary transfer or discharge of a resident from a nursing home, (2) notice of the emergency removal of a resident from a nursing home, and (3) notice of the voluntary closing of a nursing hame. Provides that the State Long Term Care Ombudsman shall have the opportunity to file a request for a hearing with the Department of Public Health within 10 days following receipt of a written notice of the involuntary transfer or discharge of a resident by a nursing home. Effective immediately.
Creates the Blind Vendors Act. Provides that the Department of Human Services, Bureau of Blind Services, shall operate and promote the Business Enterprise Program for the Blind. Sets forth that the federal Randolph-Sheppard Act and the regulations adopted pursuant to that Act shall serve as the minimum standards for the operation of the Business Enterprise Program for the Blind. Provides that under the Program: (1) blind vendors have priority in the operation of all vending facilities on State property; (2) vending machine income from all vending machines on State property shall be assigned to the blind vendor on the property or to the Blind Vendors Trust Fund; (3) no State agency may impose any commission, service charge, rent, or utility charge on a blind vendor operating on State property; (4) sales made at a blind vendor's vending facility are exempt from all occupation and use taxes; and (5) State agencies may not allow competition with a blind vendor. Sets forth that the Bureau Director for the Bureau of the Blind and the Committee of Blind Vendors shall jointly develop regulations to ensure that priority is given to blind vendors in the operation of vending facilities on State property. Provides that the Department may provide for set-asides of the net proceeds of vending operations under certain conditions. Requires set-aside funds to be deposited in the Blind Vendors Trust Fund, a separate account managed by the Department for the State's blind vendors. Sets forth provisions for the distribution of vending machine income from vending machines on State property. Provides certain conditions for the licensing of blind vendors. Creates the Committee of Blind Vendors to jointly participate in the development and implementation of all policies, plans, and major decisions affecting the Business Enterprise Program for the Blind. Sets forth provisions for the composition of the Committee. Provides certain procedures for the resolution of disputes arising within the Program. Provides for the promulgation of regulations relating to the operation of this Act. Requires the Department to make regular surveys and reports on State property and vending facilities. Sets forth conditions and information to be contained in the surveys and reports. Preempts home rule powers. Repeals the Blind Persons Operating Vending Facilities Act. Amends the Use Tax Act, Service Use Tax Act, Service Occupation Tax Act, and Retailers' Occupation Tax Act to provide that personal property purchased from a blind vendor's vending facility licensed by the Department of Human Services under the Blind Vendors Act is exempt from the taxes imposed by those Acts and that these exemptions are not subject to the sunset provisions of those Acts.
