IFA-DISTRESSED PROVIDERS

Amends the Illinois Finance Authority Act and the State Finance Act. Provides that the Illinois Finance Authority must establish a financially distressed provider revolving loan program. Provides that the Authority may issue bonds in an aggregate principal amount not to exceed $300,000,000 for the purpose of providing short-term, no-interest loans to qualified health care and human services providers. Provides that certain amounts shall be transferred from cigarette tax receipts into the Financially Distressed Provider Debt Service Fund, and amends the State Finance Act to create the Financially Distressed Provider Debt Service Fund. Amends the Cigarette Tax Act to make conforming changes. Amends the State Comptroller Act to provide that delinquent loan amounts may be offset from warrants. Effective immediately.

CEMETERY CARE-CARE FUNDS

Amends the Cemetery Care Act to require a cemetery association holding $75,000 or less in its care funds to file a report with the Comptroller in lieu of other annual report requirements and to require that the Comptroller examine at least annually every licensee who holds $750,000 or more (now, $250,000 or more) in its care funds. Effective immediately.

DRUG PARAPHERNALIA

Amends the Drug Paraphernalia Control Act. Provides that "drug paraphernalia" includes individual tobacco wrappers, known as blunt wraps, whether in the form of a single tobacco leaf, sheet or tube, that typically consists of reconstituted tobacco leaf or flavored tobacco leaf; Provides that "blunt wrap" does not include a tobacco leaf wrap that is used in the manufacturing of a cigar with a pre-tax retail price of $3 or more. Effective immediately.

EMERGING TECHNOLOGY INVESTMENT

Creates the Emerging Technology Industries Act. Requires the Department of Commerce and Economic Opportunity to establish and maintain a program to award grants to emerging-technology enterprises in the State. Sets forth eligibility requirements and funding priorities for awarding the grants, and sets forth procedures for awarding the grants. Requires written contracts in which the emerging-technology enterprise guarantees that it will perform the actions expected to be performed. Sets dollar limits on matching funds for federal Small Business Innovative Research (SBIR) grants and total grant matching funds per year. Limits total credits to $15,000,000 in any one State fiscal year. Amends the State Finance Act to create the Emerging Technology Grant Fund. Amends the Illinois Income Tax Act. Creates an income tax credit for qualified investors who make an investment in an emerging technology enterprise in the State. Provides that the Department of Commerce and Economic Opportunity must certify the amount of the credit and sets forth the procedures for the application and certification of the credit. Sets forth provisions for the revocation and recapture of the tax credit. Contains other provisions. Effective immediately.

TAXPAYER TRANSPARENCY ACT

Creates the Taxpayer Transparency Act. Provides that a bill making an appropriation may not be considered for final passage by either the House of Representatives or the Senate unless a copy of that bill, in its final form, has been made conveniently available on the General Assembly's Internet website for at least 4 days before the bill is considered for final passage by that chamber and provides that a motion adopted by a record vote of at least three-fifths of the members elected, the House of Representatives or the Senate may provide that this restriction does not apply to that chamber with respect to any one or more bills specified in the motion by bill number. Effective immediately.

CIGARETTE RETAIL LICENSE

Creates the Cigarette Delivery Sales Reporting Act. Imposes reporting requirements on persons who sell cigarettes for delivery by mail or a delivery service. Includes civil penalties for noncompliance. Amends the Cigarette Tax Act and the Tobacco Products Tax Act of 1995. Requires a retailer of cigarettes or tobacco products to obtain a retailer's license from the Department of Revenue; specifies qualifications, fees, and penalties for noncompliance; provides for mandatory suspension or revocation of a retailer's license for repeated violations of the Sale of Tobacco to Minors Act. Also makes changes in definitions, reporting requirements, and civil and criminal penalties. Amends the Illinois Lottery Law, the Department of Revenue Law of the Civil Administrative Code of Illinois, the Cigarette Use Tax Act, the Liquor Control Act of 1934, and the Sale of Tobacco to Minors Act to make corresponding changes.

DEBT RELIEF CONSUMER PRO ACT

Amends the Debt Management Service Act and renames the Act to the Debt Relief and Consumer Protection Act, including all cross-references in various other Acts. Changes the requirements for a license to include someone who operates a debt relief service (instead of debt management service). Changes the requirements concerning the (1) application for, (2) qualification for, (3) examination of, (4) renewal of, (5) fees for, and (6) revocation or suspension of a license from the Department of Financial and Professional Regulation. Changes provisions concerning the display and location of a license. Adds provisions concerning a written debt relief agreement between a debtor and licensee. Adds (1) disclosure requirements, (2) required terms, (3) accounting, and (4) the debtor's right to cancel with respect to debt relief services. Changes provisions concerning prohibited actions by a licensee. Adds provisions concerning the advertisement and solicitation of debt relief services. Requires the Department to post an annual report concerning debt relief agencies. Makes other changes. Effective immediately.
