VEH CD-REVOKE-DRUGS & ALCOHOL

Amends the Illinois Vehicle Code. Provides that an offender's eligibility for a restricted driving permit depends on whether denial of all driving privileges would cause undue hardship, as defined by rules adopted by the Secretary of State. Provides that a person convicted of 4 or more offenses of driving under the influence, leaving the scene of an accident involving death or personal injury, or reckless homicide, or a combination of those offenses, is not eligible for a restricted driving permit. Provides that the Secretary shall revoke the driving privileges of any person under the age of 21 convicted of an out-of-state offense similar to DUI. Provides that a second suspension of a person's driving privileges for an out-of-state offense similar to DUI, or a single suspension of that type, if coupled with a summary suspension under the Code or a DUI or reckless homicide conviction, shall result in the person's being prohibited from driving a vehicle that is not equipped with an ignition interlock device. Provides that a conviction of reckless homicide (as well as a conviction of DUI) increases the limitations that shall be imposed on a person's driving privileges.

PAYDAY LOAN-LOAN TERMS

Amends the Payday Loan Reform Act. Changes the definition of "payday loan" to include any loan with a finance charge exceeding an annual percentage rate of 36% (instead of with a finance charge exceeding an annual percentage rate of 36% and with a term that does not exceed 120 days). Provides that no lender may make a payday loan with periodic payments unless the periodic payments are substantially equal term payments and, if paid as scheduled, result in full payment of the principal and interest owed on the loan at the end of the loan term. Requires the licensee, as part of the information that he or she must collect and maintain, to include the total number of lawsuits filed by the licensee or its agent against consumers to collect on payday loans from consumers during the preceding calendar year. Prohibits a licensee or a person making payday loans from evading the requirements and prohibitions of the Act by use of a device or subterfuge including, but not limited to, (i) disguising a payday loan as a different type of transaction, or (ii) characterizing a required fee as a purchase of a good or service in connection with a payday loan. Authorizes the Department to develop rules to determine if any person or entity seeks to evade the applicability of this Act by any device, subterfuge, or pretense. Effective immediately.

AGING-VENDORS OF SERVICES

Amends the Illinois Act on the Aging. Provides that beginning July 1, 2007, vendors of homemaker, chore, and housekeeping services shall receive a rate increase of $1.70 per hour if at least $1.00 of that increase is used to increase the wages of homemakers and chore housekeepers. Provides for subsequent rate increases. Requires vendors receiving this increase to submit proof to the Department that the vendors have increased homemakers' and chore housekeepers' wages by at least $1.00 per hour. Sets out methods for submitting proof. Effective July 1, 2007.

SCH CD-REG INSPECT GEN-BD MEMB

Amends the School Code. Makes changes with respect to requiring a regional superintendent of schools to employ a regional inspector general for school districts; a school board member having a fiduciary relationship with the district; allowing a school board member to be removed for negligent (rather than wilful) failure to perform his or her official duties, any violation of the School Code, or a breach of fiduciary duty; prohibiting a school board member from holding any other public office; requiring a district to establish a database listing all vendors who have contracts with the district; a school board employing a general counsel; prohibiting a school board member, employee of a school district, or general counsel from being interested in any contract, work, or business of any school district, in the sale of any article, or in the purchase of any property that belongs to any school district, is sold for taxes or assessments, or is sold by virtue of legal process at the suit of any district; and exceptions to the requirement that contracts involving an expenditure in excess of $10,000 be awarded to the lowest responsible bidder. Amends the State Mandates Act to require implementation without reimbursement.

$ IEMA VILLAGE 9-1-1 CENTER

Appropriates $2,000,000 from the general revenue fund to the Illinois Emergency Management Agency for a 9-1-1 center for the villages of Hillside, Maywood, Westchester, Berkeley, Bellwood, and Broadview. Effective July 1, 2008.

TOBACCO-SAMPLES PROHIBITED

Amends the Sale of Tobacco to Minors Act. Changes the title of the Act to the Sale and Distribution of Tobacco Products Act. Provides that a person shall not distribute without charge samples of any tobacco product to any other person, regardless of age: (1) at a retail establishment selling tobacco products; (2) from a lunch wagon; or (3) on a public way as a promotion or advertisement of a tobacco manufacturer or tobacco product. Provides that the prohibition applies even if the person who is intended to receive the tobacco product purchased another product from the person intending to distribute the tobacco product. Retains the same penalties as the penalties for distribution of tobacco products to minors. Amends the Liquor Control Act of 1934 and the Display of Tobacco Products Act to make conforming changes.

SMOKE FREE ILLINOIS ACT

Creates the Smoke Free Illinois Act. Sets forth the findings of the General Assembly. Creates several definitions. Prohibits smoking in public places, places of employment, and governmental vehicles. Requires "No Smoking" signs to be posted in each public place and place of employment where smoking is prohibited. Requires ashtrays to be removed from any area where smoking is prohibited. Prohibits smoking in student dormitories, including, but not limited to, sleeping rooms, dining areas, restrooms, laundry areas, lobbies, and hallways, of a building used in whole or in part as a student dormitory that is owned and operated or otherwise utilized by a public or private institution of higher education. Provides that the Department of Public Health, State-certified local public health departments, and local law enforcement agencies shall enforce the provisions of the Act. Sets forth fines for violations of the Act. Provides that the Department, a State-certified local public health department, local law enforcement agency, or any individual personally affected by repeated violations may institute, in a circuit court, an action to enjoin violations of the Act. Prohibits discrimination against individuals who exercise their rights afforded by the Act. Provides that a home rule unit may regulate smoking in public places, but that regulation must be no less restrictive than the provisions in the Act. Prohibits smoking within a minimum distance of 15 feet from entrances, exits, windows that open, and ventilation intakes that serve an enclosed area where smoking is prohibited. Amends the State Mandates Act to require implementation without reimbursement. Repeals the Illinois Clean Indoor Air Act.
