TOBACCO-POSSESSION-MINORS

Amends the Juvenile Court Act of 1987. Provides that, if a minor violates the provisions prohibiting minors from possessing any cigars, cigarettes, smokeless tobacco, or tobacco in any of its forms, the court may in its discretion, and upon recommendation by the State's Attorney, order the minor and his or her parents or legal guardian to attend a smoker's education or youth diversion program if that program is available in the jurisdiction where the offender resides. Provides that attendance at a smoker's education or youth diversion program shall be time-credited against any community service time imposed for a violation of the provision prohibiting tobacco possession by a minor. Imposes several penalties for a violation of the provision prohibiting tobacco possession by a minor. Amends the Sale of Tobacco to Minors Act. Changes the short title of the Act to the Prevention of Tobacco Use by Minors Act. Prohibits the possession of tobacco by minors and makes violation a petty offense. Amends other Acts to change references to the short title of the Prevention of Tobacco Use by Minors Act. Makes other changes. Effective immediately.

HUNTING-ACTIVE DUTY MILITARY

Amends the Wildlife Code. Provides that, if a person is currently serving on active-duty in the U.S. Armed Forces or Reserves and has a valid Firearm Owner's Identification Card, or the equivalent from another state, then there is no fee for a hunting license. Requires verification of active-duty service.

JOINT CUSTODY-CHILDS RESIDENCE

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that in a joint custodial situation, the parents of the child may agree, or the court may order, that the physical residence of the child shall be the former marital residence and that one parent shall reside at the residence with the child during the time that that parent has physical custody of the child pursuant to the Joint Parenting Agreement or Joint Parenting Order and the other parent shall reside elsewhere during that time. Provides that this provision may be referred to as the "child homestead stability" provision of the Act. Effective immediately.

INC TX-VETERANS' DEDUCTION

Amends the Illinois Income Tax Act. Allows qualified veterans to deduct, from their base income, any compensation, up to $50,000 per year, during the 5-year period directly following that qualified veteran's discharge from military service. Defines a "qualified veteran" as a veteran who was an Illinois resident at the time that he or she entered military service, who was honorably discharged from the Armed Forces of the United States, the Illinois National Guard, or any reserve component of the Armed Forces of the United States, and who served for at least 6 months in an active-duty capacity in a combat zone. Exempts the deduction from the Act's sunset provisions. Effective immediately.

PENSION-CONTINUING APPROPS

Amends the State Pension Funds Continuing Appropriation Act. Provides for appropriation of $13,000,000 on a continuing annual basis from the General Revenue Fund to the State Comptroller for deposit into the Teacher Health Insurance Security Fund in State fiscal years 2009 through 2011. Effective immediately.

CD CORR-DNA SEX OFFENDER

Amends the Unified Code of Corrections. Provides that any person on the effective date of this amendatory Act incarcerated in a facility of the Illinois Department of Corrections for any sex offense, or a prior sex offense statute as defined in any former version of the Criminal Code of 1961, or any offense that was sexually motivated, shall submit a specimen of blood, saliva, or tissue by July 1, 2007 for immediate inclusion in the State Offender DNA Identification System. Provides that after July 1, 2007, every person convicted of a sex offense, or a prior sex offense statute as defined in any former version of the Criminal Code of 1961, or any offense which at the time of sentencing the court finds to be sexually motivated shall within 45 days of his or her placement in a facility of the Illinois Department of Corrections submit a sample of blood, saliva, or tissue for immediate inclusion in the State Offender DNA Identification System. Effective immediately.

PROC CD-VETERAN PREFERENCE

Amends the Illinois Procurement Code. Requires that each chief procurement officer establish a goal of at least 12% of the total dollar amount of State contracts of agencies under the officer's jurisdiction to be awarded to veteran-owned businesses.

INC TX-EXEMPTIONS

Amends the Illinois Income Tax Act. Increases the basic amount of the standard exemption, annually, by the percentage increase in the Consumer Price Index for the previous calendar year. Effective immediately.

CRIME VICTIMS

Amends the Rights of Crime Victims and Witnesses Act. Provides that the victim of the crime for which the prisoner has been sentenced shall receive reasonable written notice not less than 30 (rather than 15) days prior to the parole hearing. Provides that if a victim or concerned citizen has registered an objection to parole of an inmate, the victim or concerned citizen may receive a copy of the most recent written submissions that the inmate filed in requesting parole. Amends the Sexually Violent Persons Commitment Act. Includes in the definition of sexually violent offense, first degree murder, if it is determined by the agency with jurisdiction that a sexually violent offense was committed during the same course of criminal conduct as the first degree murder and that relevant and reliable evidence shows that the sexually violent offense was committed by the inmate or by a person for whom the inmate was legally accountable if the inmate aided, encouraged, or abetted the sexually violent offense for the inmate's own personal sexual gratification. Amends the Unified Code of Corrections. Changes procedures relating to parole hearings. Effective immediately.

DCEO-ECON DEVELOPMENT GRANTS

Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Requires the Department of Commerce and Economic Opportunity to develop a program to make grants to local development organizations. Provides that under this program, a county or municipality may apply to the Department for a grant to be awarded to a local development organization in that county or municipality for the purpose of fostering local or regional economic development. Provides that these grants are subject to appropriation and sets forth the purposes for which the grants may be used. Authorizes the Department to make rules concerning the program. Effective on January 1, 2009.
