HFS-MEDICAID-SMOKING CESSATION

Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that in implementing the tobacco use cessation program covered under the medical assistance program, the Department of Healthcare and Family Services may develop a formulary of covered medications, which may include over-the-counter medications if they are prescribed by a physician, a physician's assistant, or an advanced practice nurse with prescriptive authority delegated under the Nurse Practice Act who issues a prescription for such a medication in accordance with a written collaborative agreement under the Nurse Practice Act. Provides that there shall be no co-payment or other cost-sharing requirement for any prescribed tobacco use cessation medication under the medical assistance program, the Children's Health Insurance Program, or the Covering ALL KIDS Health Insurance Program. Requires the Department of Healthcare and Family Services to make any changes in the State's approved plan under Title XIX of the Social Security Act necessary to ensure that these provisions apply to the Children's Health Insurance Program and the Covering ALL KIDS Health Insurance Program. Effective immediately.

INC TAX-DEDUCT MEDICAL EXPENSE

Amends the Illinois Income Tax Act. Provides that, for taxable years ending on or after December 31, 2009, an individual taxpayer may deduct from adjusted gross income an amount equal to the medical, dental, and other expenses allowed as a deduction under Section 213 of the Internal Revenue Code to the extent allowed as a deduction from adjusted gross income in computing federal income taxes. Provides that to obtain this subtraction modification the taxpayer must submit to the Department, along with his or her tax return, a copy of the Schedule A form or any successor form completed and submitted for federal income tax purposes. Excepts the deduction from the sunset requirements. Effective immediately.

JUDGE-BOONE COUNTY

Amends the Circuit Courts Act. Creates an additional Boone County resident judgeship in the 17th judicial circuit (Boone and Winnebago counties), to be elected first in 2010. Requires the judge to continue to reside in Boone County. Authorizes the Illinois Supreme Court to fill the judgeship by appointment until then. Specifies that the judgeship is not a subcircuit judgeship. Effective July 1, 2009.

SCHOOL BUS DRIVERS-REFRESHER

Amends the School Code and the Illinois Vehicle Code. Provides that school bus drivers must complete a semiannual (rather than annual) refresher course to maintain a valid school bus driver permit. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

INC TAX-MILITARY CHILD CARE

Amends the Illinois Income Tax Act. Authorizes a credit to each individual taxpayer for qualified child and dependent care expenditures by the taxpayer during the taxable year, but not to exceed $1,000 per year, incurred while the taxpayer is a member of the United States Armed Services, including the Illinois National Guard or any reserve component of the Armed Forces of the United States, and is mobilized to active duty and deployed outside Illinois. "Qualified child and dependent care expenditures" are defined as those that qualify under the Child and Dependent Care Tax Credit under the federal Internal Revenue Code. Provides that the credit may not reduce the taxpayer's liability to less than zero and may not be carried back or carried forward. Exempts the credit from the Act's sunset provisions. Effective immediately.

PROCUREMENT-LEASE RENEWALS

Amends the Illinois Procurement Code. Requires that the conditions of a State lease renewal must be agreed upon within 30 days after lease expiration. Requires that a State agency report a holdover lease to the Procurement Policy Board. Requires that a lessor's failure to negotiate a lease renewal in good faith must be documented and may be considered in the future award of State leases.

VEH CD-POLICE VEHICLES-LIGHTS

Amends the Illinois Vehicle Code. Provides that the driver of a police vehicle must: (1) activate oscillating lights, rotating or flashing lights, sirens, or any combination of such lights or sirens during a high speed vehicle response; (2) use lights and sirens to warn pedestrians and other persons of his or her approach during an emergency response situation; and (3) drive with due regard for the safety of other persons and exercise due care when operating a police vehicle. Permits the driver of a police vehicle to use a covert approach when the situation dictates, but requires the driver to comply with all traffic laws if not utilizing lights and sirens as required by the Illinois Vehicle Code. Effective immediately.

CRIME VICTIMS

Amends the Rights of Crime Victims and Witnesses Act. Provides that the victim of the crime for which the prisoner has been sentenced shall receive reasonable written notice not less than 30 (rather than 15) days prior to the parole hearing. Provides that if a victim or concerned citizen has registered an objection to parole of an inmate, the victim or concerned citizen may receive a copy of the most recent written submissions that the inmate filed in requesting parole. Amends the Unified Code of Corrections. Changes procedures relating to parole hearings. Effective immediately.
