Amends the Criminal Code of 1961. Provides that a person also commits robbery when he or she withdraws, takes, or transfers funds from the financial account of another or obtains the account number, personal identification number, or other information used to access the financial account of another by the use of force or by threatening the imminent use of force, by, or for the purpose of, accessing any financial account through the use of an automatic teller machine. Provides that a person convicted of such robbery is not eligible to receive a sentence of probation or conditional discharge. Effective immediately.
Amends the Environmental Protection Act. Makes a technical change in a Section concerning the short title.
Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.
Amends the Property Tax Code and the School Code. Sets forth procedures for calculating certain adjustments and recomputations with respect to the Property Tax Extension Limitation Law.
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. In provisions concerning rural community development, requires the Department of Commerce and Economic Opportunity to develop a program to make grants to municipalities and counties to fund local development organizations. Provides that under this program, a county or municipality may apply to the Department for a grant to be awarded to the municipality or county to be used by a local development organization in that county or municipality for the purpose of fostering local or regional economic development. Provides that these grants are subject to appropriation and sets forth the purposes for which the grants may be used. Authorizes the Department to make rules concerning the program.
Amends the Counties Code and the Illinois Municipal Code. Provides that any cause of action or claim for refund of cash contributions paid in lieu of land donations and any cause of action or claim for return of a land donation pursuant to a county or municipal ordinance must be commenced by filing the cause of action or claim (i) within one year after the date of payment or a longer period specified in a county or municipal ordinance or an annexation agreement if the request is based on an objection to the validity of an ordinance or to the manner in which donations or contributions are calculated under an ordinance or (ii) within one year after the money was spent or development on the land was commenced if the request is based on an objection that the contribution was spent in a manner inconsistent with the county or municipal ordinance. Effective immediately.
Amends the Election Code. Provides that a municipality having a population under 500,000 is not subject to the Section regarding the events by which an elective office becomes vacant. Amends the Illinois Municipal Code. Provides that a person who resides in a newly incorporated municipality or who resides in an area of a municipality that has been redistricted is eligible for elective municipal office, notwithstanding that the person has not lived in the new municipality or the different district for at least one year. Describes the events upon which a municipal elective office becomes vacant, such as unconditional resignation, conditional resignation, death, disability, and abandonment. Provides for the election of an acting mayor and an acting president in the event of a vacancy. Provides for the appointment of an alderman or trustee to fill a vacancy. Provides when a vacant position with an unexpired term must be filled by an election. Provides for filling a vacancy in an office of a municipal officer or an alderman. Provides for filling the vacancy of the office of a village alderman or trustee. Effective January 1, 2006.
