Creates the Retail Consumer Protection Act. Provides that all businesses engaged in retail commerce shall have a designated employee who has the responsibility for ensuring the accuracy of all posted and advertised prices. Provides that the person designated for ensuring the accuracy of all posted and advertised prices shall keep a written record of any customer complaints received concerning any overcharging or other acts of consumer fraud, unfair methods of competition, and deceptive business practices. Requires the record to be kept for no less than 2 years and made available to investigators of the Department of Agriculture Bureau of Weights and Measures upon request. Provides that any person engaged in retail commerce that is alerted by a customer of any overcharging shall immediately report the overcharge to the person designated for ensuring the accuracy of posted and advertised prices, who shall investigate the alleged error. Provides that, if the customer was charged more than the advertised or posted price, and the value of the item in question was less than $3, the customer shall be given the item for free. Provides that, if the value of the item in question was $3 or more, the customer shall be sold the item at the correct price and $3 shall be deducted from the price charged. Requires the designated person to ensure that the correct price is posted and programmed into all payment systems within 30 minutes of receiving a customer complaint. Establishes penalties. Provides that the Director shall provide an annual written report to the Attorney General and the Governor describing the activities undertaken by himself or herself and any city sealers of weights and measures to implement the Act, and any substitute local ordinances. Amends the Weights and Measures Act to grant city sealers the powers established in the Retail Consumer Protection Act.
Amends the Workers' Compensation Act. Makes a technical change in a Section concerning the application of the Act.
Creates the Service Station Road Safety Act. Provides that, on and after January 1, 2008, every service station in this State shall provide, during operating hours, water, compressed air, and a gauge for measuring air pressure to the public for use in servicing any passenger vehicle or any commercial vehicle with an unladen weight of 6,000 pounds or less, and shall make these services available at no cost to customers who purchase motor vehicle fuel. Requires every service station in this State to display, at a conspicuous place on, at, or near the dispensing apparatus, at least one clearly visible sign that states that the service station is required to provide free air and water for automotive purposes to its customers who purchase motor fuel and that contains the toll-free number for complaints. Requires the State Fire Marshal to maintain a toll-free number for complaints. Sets civil penalties for violation of the Act. Creates the Service Station Road Safety Fund with the money in the Fund to be appropriated to the State Fire Marshal for enforcement of the Act. Requires the State Fire Marshal to submit a written report on the compliance rate and the enforcement costs of the Act to the General Assembly no later than March 1, 2009. Amends the State Finance Act to create the Service Station Road Safety Fund. Effective January 1, 2008.
Amends the Food Handling Regulation Enforcement Act. Provides that any establishment dealing in the sale of food items and that has an indoor playground on its premises must comply with regulations involving the inspection of indoor playground areas for sanitation purposes. Provides that the Director of Public Health shall promulgate rules for the inspection of indoor playgrounds at any establishment dealing in the sale of food items, including standards of proper sanitation and frequency of playground inspection. Provides that any establishment that does not comply with the regulations concerning indoor playground sanitation shall be enjoined from doing business in the manner described in the Act. Effective January 1, 2009.
Amends the Municipal Code. Provides that territory may not be disconnected from the municipality unless at least 25% of the boundary of the territory is located on the border of the municipality (now, territory may not be disconnected unless the territory is located on the border of the municipality). Provides that territory may not be disconnected if zoning and public health ordinances (instead of zoning ordinances only) will be unreasonably disrupted. Requires public notice of a petition to disconnect. Provides that taxpayers may appear and defend against the petition. Provides that the petition shall be denied if the court finds that the future development of the property may be inconsistent with the municipality's comprehensive land use plan or inconsistent with the trend of development. Provides that land that has been disconnected shall not be subdivided into lots and blocks within 5 years (instead of 1 year) from the date of disconnection. Effective immediately.
Amends the Counties Code. Provides for binding referenda (instead of advisory referenda) concerning (i) the number of members of the county board to be elected, (ii) whether the board members should be elected from single-member districts, multi-member districts, or at-large, (iii) whether voters will have cumulative voting rights in the election of county board members, or (iv) any combination of the preceding 3 questions. Effective immediately.
Amends the Civil Administrative Code of Illinois. Makes technical changes in a Section creating the civil administrative agencies.
