SALES TAX-CLOTHING TAX HOLIDAY

Amends the Use Tax Act and the Retailers' Occupation Tax Act. Provides that, notwithstanding any other provision to the contrary, no tax shall be imposed under those Acts upon the privilege of using in this State (for the Use Tax Act) or persons engaged in the business of selling at retail (for the Retailers' Occupation Tax Act) an individual item of clothing or footwear designed to be worn about the human body that (i) is purchased for a selling price of $200 or less and (ii) is purchased from 12:01 a.m. on the first Friday in August through midnight of the Sunday that follows 9 days later. Provides that a unit of local government may, by ordinance adopted by that unit of local government, opt out of the tax holiday and continue to collect and remit the tax imposed under those Acts during the tax holiday period. Provides that articles that are normally sold as a unit cannot be priced separately and sold as individual items in order to be subject to the holiday. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

DPH-COUNTRFEIT DRUG TASK FORCE

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code. Requires the Department of Public Health to create a task force to explore the use of modern technologies and other measures that will make it more difficult for counterfeit drugs to get distributed with, or deliberately substituted for, safe and effective drugs. Effective immediately.

MEDICAID-PHARMACY-SR DISCOUNT

Amends the Illinois Public Aid Code. Provides that a Medicare beneficiary or a beneficiary of pharmaceutical assistance under the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act is entitled to obtain prescription drugs at prices based on a pharmacy's Medicaid reimbursement rates. Requires that pharmacies implement this prescription drug discount benefit as a condition of participating in the Medicaid program. Requires the Department of Public Aid to make certain reports to the General Assembly and to execute necessary interagency agreements with the Department on Aging and the Department of Revenue. Provides for evaluation of the prescription drug discount benefit if prescription drugs are covered by Medicare. Repeals these provisions on July 1, 2007.

DUI-PASSENGER UNDER 16-PENALTY

Amends the Illinois Vehicle Code and the Unified Code of Corrections. Increases the penalties for driving under the influence of alcohol, drugs, or intoxicating compounds while transporting a child under the age of 16 years.

FINANCE-FUND TRANSERS

Amends the State Finance Act. Provides that no transfers may be made, in order to help defray the State's operating costs for the fiscal year, from the Road Fund or the State Construction Account Fund on or after the effective date of this amendatory Act. Effective July 1, 2004.

TAXES-TAXPAYER RIGHTS

Amends the Taxpayers' Bill of Rights Act. Allows a taxpayer to sue the Department of Revenue if the Department negligently (now intentionally or recklessly) disregards tax laws or regulations in collecting taxes. Creates a certified public accountant-client or public accountant-client privilege for non-criminal proceedings before the Department. Provides that in the case of a taxpayer receiving a protestable notice, a bill, a claim denial, or a reduction of a refund regarding any tax, the taxpayer's position shall be presumed to be the correct position and the burden of proof shall be on the Department to prove otherwise. Amends the Illinois Income Tax Act, the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, the Retailers' Occupation Tax Act, the Cigarette Tax Act, the Cigarette Use Tax Act, the Hotel Operators' Occupation Tax Act, the Motor Fuel Tax Law, the Coin-Operated Amusement Device and Redemption Machine Tax Act, the Cannabis and Controlled Substances Tax Act, the Messages Tax Act, the Gas Revenue Tax Act, the Public Utilities Revenue Act, the Water Company Invested Capital Tax Act, the Telecommunications Excise Tax Act, and the Uniform Penalty and Interest Act to make corresponding changes. Amends the Illinois Income Tax Act to create a civil action against the Department for the knowing or negligent disclosure of confidential information. Provides penalties. Amends the Illinois Public Accounting Act to make changes regarding confidentiality. Effective immediately.

COUNTERFT DRGS-PEDIGREE PAPERS

Amends the Illinois Food, Drug and Cosmetic Act. Prohibits various acts related to counterfeiting drugs. Requires that legend drugs be accompanied by pedigree papers. Provides minimum requirements for those pedigree papers. Creates various criminal offenses related to counterfeiting drugs and pedigree papers. Makes other changes. Amends the Wholesale Drug Distribution Licensing Act. Adds maintaining pedigree papers as a condition for receiving and renewing a wholesale drug distributor license. Adds violation of the Illinois Food, Drug and Cosmetic Act as a grounds for discipline under the Act. Increases the fine the Department may impose on licensees. Effective January 1, 2006.

CIV PRO-MED MALPRACTICE-SANCTN

Amends the Civil Practice Law of the Code of Civil Procedure. In provisions concerning pleading in healing art malpractice cases, allows the court to impose sanctions against a party or attorney if it determines that (i) there has been a willful failure to comply with those provisions or (ii) the action is frivolous or otherwise not commenced in good faith. Provides that appropriate sanctions include a bar against presenting a claim or defense and an order to pay damages and costs. Effective immediately.

WRK COMP-NEUTRAL FORCE

Amends the Workers' Compensation Act and the Workers' Occupational Diseases Act. Provides that, for purposes of those Acts, "...an injury (or disease) arises out of the employment if the injury (or disease) would not have occurred but for the fact that the conditions or obligations of the employment placed the employee in the position where the employee was injured (or exposed to the disease) by a neutral force. A neutral force is a force that is neither personal to the employee nor distinctly associated with the employment." Effective immediately.

PUBLIC LIBRARIES-IMPACT FEES

Amends the Counties Code and the Illinois Municipal Code. Authorizes the county boards of certain counties to establish rules and regulations for the provision of public grounds for public libraries and authorizes certain municipal plan commissions and planning departments to implement a comprehensive plan by an ordinance concerning the provision of public grounds for public libraries. Defines "public libraries" for the purposes of implementing ordinances regarding developer donations or impact fees. Makes the provisions of the bill applicable to all impact fees or development donations paid into a public library or library district or held in a separate account or escrow fund by any public library, library district, county, or municipality for a public library or library district. Effective immediately.
