USE/OCC TAX-DATA CENTERS

Amends the Use Tax Act, the Service Use Tax, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that tangible personal property used in the construction or operation of a data center that has been granted a certificate of exemption by the Department of Commerce and Economic Opportunity is exempt from the taxes imposed under those Acts. Amends the Electricity Excise Tax Law. Provides that business enterprises that are certified as qualifying Illinois data centers by the Department of Commerce and Economic Opportunity are exempt from the taxes imposed under the Act. Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois to provide for certification of qualified data centers. Effective immediately.

SENIOR TAX DEFERRAL-INTEREST

Amends the Senior Citizens Real Estate Tax Deferral Act. Provides that the rate of interest for taxes deferred on or after the effective date is equal to the most recent yield on a 30-year treasury bond as of the date the taxes were deferred, but not to exceed 6% per year (currently, the rate is 6% per year). Effective immediately.

EDGE-WITHHOLDING

Amends the Economic Development for a Growing Economy Tax Credit Act. Provides that, for agreements entered into on or after the effective date of the amendatory Act, no Taxpayer may elect to apply the credit against its withholding tax liability unless certain conditions are met. Provides that each application for credits must contain an affidavit signed by the Taxpayer's chief executive officer or chief financial officer, or an individual holding an equivalent position, stating that, but for the Credit, the Taxpayer would not locate the project in the State. Requires the Department to post the taxpayer's tax information on its website. In the case of all EDGE credits, provides that, if the Applicant's project includes retained employees, the Credit may also include an amount agreed to between the Department and the Applicant based on the severity of the poverty or unemployment in the geographic area in which the Applicant's project is located or the retained employees reside. Provides that that amount may not be more than 40% of the total amount withheld from the compensation of retained employees. Amends the Illinois Income Tax Act to allow the Department of Revenue to provide information to the Department of Commerce and Economic Opportunity for the purpose of confirming the tax information submitted by the Taxpayer. Effective immediately.

$STATE POLICE-OSFM-ICJIA

Makes appropriations from the Statewide 9-1-1 Fund to the Department of State Police, Division of Administration for costs pursuant to the Emergency Telephone System Act. Makes various appropriations from the Fire Prevention Fund to the Office of the State Fire Marshal for ordinary and contingent expenses and grants for costs and services related to ILEAS/MABAS administration, and to the Board of Trustees of the University of Illinois for maintaining the Illinois Fire Service Institute. Makes appropriations from the Traffic and Criminal Conviction Surcharge Fund to the Law Enforcement Training Standards Board for specified training. Makes appropriations from the Death Penalty Abolition Fund to the Illinois Criminal Justice Information Authority for the training of law enforcement personnel and services for families of victims of homicide or murder. Effective July 1, 2016.

LEG LEADER TERM LMT REFERENDUM

Creates the Legislative Leader Term Limit Referendum Act. Requires the State Board of Elections to cause a statewide advisory public question to be submitted to the voters at the 2016 general election asking whether there should be term limits for the offices of Speaker of the House of Representatives, President of the Senate, Minority Leader of the House of Representatives, and Minority Leader of the Senate. Provides that if the provision of the Act conflicts with any other law, the Act controls. Repeals the Act on January 1, 2017. Effective immediately.

CONAMEND-REDISTRICTING

Proposes to amend the Legislature Article of the Illinois Constitution. Provides that the boundaries of Legislative and Representative districts may be separate. Requires that both types of districts, in addition to being compact, contiguous, and substantially equal in population, must reflect minority voting strengths, promote competition, and consider political boundaries. Replaces the current method of redistricting of the Senate and House of Representatives with the following: an 8-member Independent Redistricting Commission, appointed by the Chief Justice and the most senior Justice of the Supreme Court who is not affiliated with the same political party as the Chief Justice, shall hold at least 15 public hearings throughout the State before adopting any redistricting plan; requires the Commission to adopt a report explaining the compliance of the proposed redistricting plan with the U.S. and Illinois Constitutions; and provides for the Chief Justice of the Supreme Court and the most senior Justice of the Supreme Court who is not affiliated with the same political party as the Chief Justice to appoint a ninth member to the Commission, if the Commission fails to adopt and file a redistricting plan by the required date. Specifies the schedule for redistricting activities. Effective upon being declared adopted and applicable to redistricting beginning in 2021 and to the election of General Assembly members beginning in 2022.

Amends the Property Tax Code. In a Section granting a Senior Citizens Assessment Freeze Homestead Exemption, provides that the maximum income limitation is $60,000 for taxable year 2016 and thereafter. Effective immediately.

PEN CD-OFFSETS-CONTINUATION

Amends the General Provisions Article of the Illinois Pension Code. Provides that a member or participant of a retirement system or pension fund established under the Code who is receiving a retirement annuity or retirement pension and becomes employed in a similar position within the same agency on or after the effective date of the amendatory Act in a position in which he or she is eligible to accrue service credit or creditable service under any Article of the Code shall, in the month immediately after commencing that employment, have the amount of his or her monthly retirement annuity or retirement pension offset by the amount of his or her compensation, earnings, or salary (whichever is applicable) in the immediately preceding month as certified to the applicable retirement system or pension fund by his or her employer, unless the payment of that retirement annuity or retirement pension is already suspended or terminated during that period. Provides that these provisions do not apply to the first $2,000 per month of retirement annuity payments. Contains a statement of legislative intent. Effective immediately.
