Mourns the passing of former Illinois State Senator Adeline Geo-Karis.
Amends the Downstate Forest Preserve District Act. Provides that a forest preserve may sell certain vacant, subdivided residential outlots if the board of commissioners determines that the sale is advantageous to the district. Sets forth other criteria for the sale of the lots. Provides that the proceeds from the sale must be set aside and used only for certain capital improvements or for the payment of bond indebtedness. Effective immediately.
Amends the Mental Health and Developmental Disabilities Code. Provides that "person subject to involuntary admission" includes (i) a person with mental illness and who because of his or her illness is reasonably expected to engage in dangerous conduct (instead of reasonably expected to inflict serious physical harm upon himself or herself or another in the near future) and (ii) a person with mental illness who, because of the nature of his or her illness, is unable to understand his or her need for treatment and who, if not treated, is reasonably expected to suffer or continue to suffer mental deterioration or emotional deterioration, or both, to the point that the person is reasonably expected to engage in dangerous conduct. Defines "dangerous conduct" as threatening behavior or conduct that places another individual in reasonable expectation of being harmed, or a person's inability to provide, without the assistance of family or outside help, for his or her basic physical needs so as to guard himself or herself from serious harm.
Amends the School Code. Repeals Sections in relation to the examination of a school treasurer's books, accounts, and vouchers; furnishing a township treasurer with a list of school districts; the posting of maps of congressional townships and educational service regions at polling places; the report of certain employment information by a teacher to the regional superintendent; and State reimbursement for the installation of passenger seat backs of a certain height in school buses. Makes related changes. Effective immediately.
Amends the Department of Natural Resources Act. Provides that the Department of Natural Resources shall formulate and implement a 10-year program that shall be in place by January 1, 2008 for the maintenance and reconstruction of the Adeline Jay Geo-Karis Illinois Beach Marina. Amends the State Finance Act. Provides that transfers from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the General Revenue Fund shall not exceed $1,000,000 (now, $2,000,000) in any fiscal year. Transfers an amount equal to the amount transferred from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the General Revenue Fund under certain provisions of the State Finance Act during fiscal years 2004, 2005, 2006, and 2007 from the General Revenue Fund to the Adeline Jay Geo-Karis Illinois Beach Marina Fund. Excludes the Adeline Jay Geo-Karis Illinois Beach Marina Fund from a provision of the State Finance Act that allows the Governor to transfer moneys from certain special funds into the General Revenue Fund. Effective immediately.
Amends the Election Code. Provides that when a qualified elector's precinct polling place is a school and the elector will be unable to enter the school to vote because the elector is a child sex offender, the elector may vote early or by absentee ballot. Requires that an election authority that designates permanent or temporary early voting polling places must designate at least one that a child sex offender may lawfully enter. Requires that an election authority provide election-day voting at its principal office for child sex offenders who cannot lawfully enter their assigned precinct polling place. Amends the Criminal Code of 1961. In the provision prohibiting a child sex offender from entering a school, removes language providing that a child sex offender has the right to be present in a school building to vote. Provides that it is a Class 4 felony for a child sex offender to knowingly be present within 100 feet of a site posted as a pick-up or discharge stop for a conveyance owned, leased, or contracted by a school to transport students to or from school or a school related activity when one or more persons under the age of 18 are present at the site. Effective immediately.
Creates the Illinois Cool Cities Act. Provides that the Environmental Protection Agency shall provide technical assistance, if needed, to units of local government in the State that have endorsed the U.S. Conference of Mayors Climate Protection Agreement. Provides that any unit of local government may request designation as an Illinois Cool City if the unit of local government has (i) endorsed the U.S. Conference of Mayors Climate Protection Agreement and (ii) prepared and approved a plan to achieve a 7% reduction in greenhouse gas emissions from 1990 levels by the year 2012. Provides for designation of Illinois Cool Cities upon certain findings by the Director of the Environmental Protection Agency. Effective immediately.
Amends the Nursing Home Care Act. Makes a technical change in a Section concerning the short title.
Amends the Illinois Vehicle Code and the Unified Code of Corrections. Increases the penalties for the offense of driving with a revoked driver's license, permit, or privilege to operate a motor vehicle, if the revocation was because of the offense of reckless homicide. Provides that a first violation is a Class 4 felony and provides for mandatory imprisonment or community service. Provides that the revocation is extended a minimum of 3 years. Provides that if the person is granted a restricted driving permit, the person may not drive a vehicle not equipped with an ignition interlock device. Requires the defendant to undergo a drug or alcohol evaluation. Provides that a second violation is a Class 2 felony, for which a mandatory prison sentence shall be imposed. Provides that revocation of the person's driving privileges extends at least 5 years from the date of his or her release from prison. Provides that the person is not eligible for a restricted driving permit. Provides that a third violation is a Class 1 felony, for which a mandatory term of imprisonment shall be imposed. Provides that the person's driver's license is revoked for life. Provides that a fourth or subsequent violation is a Class 1 felony for which a mandatory prison term shall be imposed, and the defendant is eligible for an extended term of imprisonment.
