CIRCUIT BREAKER-REVENUE-AGING

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In connection with the pharmaceutical assistance program under the Act, provides that to become a beneficiary under the program, a person must have a maximum household income equal to or less than 239% of the Federal Poverty Level (instead of less than specified amounts or equal to or less than 200% of the Federal Poverty Level. Provides for 4 (instead of 5) Eligibility Groups (eliminates current Eligibility Group 3). For persons in the Eligibility Group consisting of persons who have a diagnosis of HIV or AIDS, provides for an alternative co-payment according to whether or not a drug is covered by the Medicare Part D Prescription Drug Plan in which the beneficiary is enrolled (in addition to whether or not the drug is included in the formulary of the Illinois AIDS Drug Assistance Program operated by the Illinois Department of Public Health). Makes changes in the definitions of "covered prescription drug" for each Eligibility Group. Makes other changes. Effective immediately.

HUMAN RTS-EMPLOYER REPORT FORM

Amends the State Finance Act. Creates the Department of Human Rights Special Fund. Provides that moneys in the Department of Human Rights Special Fund are not subject to transfer to the General Revenue Fund. Amends the Illinois Human Rights Act to provide that the registration fee for filing an Employer Report Form is $75, and that the Department of Human Rights Special Fund is not subject to sweeps, administrative charges or charge-backs, or any other fiscal or budgetary maneuver that would in any way transfer any funds from the Fund into any other fund of the State. Effective January 1, 2010.

ST INVESTMENT-COMMUNITY COMMIT

Amends the Deposit of State Moneys Act. In provisions authorizing the State Treasurer to consider a financial institution's commitment to its community in deciding whether to deposit State funds in that institution, provides that the State Treasurer shall not deposit funds in the institution (i) if the current rating under the federal Community Reinvestment Act of 1977 is less than "outstanding" and (ii) unless the financial institution certifies that it does not make refund anticipation loans and does not make operating loans to payday lenders.

COM COL-NEW JOBS TRAINING-BOND

Amends the Public Community College Act. Allows a board of trustees of a community college district to enter into an agreement with an employer concerning an arrangement to provide new jobs training program services, including (1) new jobs training; (2) adult basic education and job-related instruction; (3) vocational and skill-assessment services and testing; (4) training facilities, equipment, materials, and supplies; and (5) on-the-job training. Requires the agreement to provide for program costs that may be paid from property taxes, tuition, student fees, or special charges. Allows the board to borrow money and issue and sell certificates payable from a sufficient portion of the future receipts of payments authorized by the agreement to provide funds for the present payment of the costs of a new jobs training program. Provides that the board shall, by resolution, provide for the assessment of an annual levy of a standby tax upon all taxable property within the community college district to further secure the payment of the certificates.

DHS-AGING-ADVISORY COMMITTEES

Amends the Prevention of Unnecessary Institutionalization Act. Repeals a provision requiring the Department of Human Services and the Department on Aging to jointly establish an Advisory Committee for the Prevention of Unnecessary Institutionalization Program to advise the Secretary of Human Services and the Director of Aging on rulemaking, policies, and procedures under which the Program shall operate. Amends the Community Senior Services and Resources Act. Repeals a provision requiring the Department on Aging to establish the Community Senior Services and Resource Center Advisory Committee. Amends the Family Caregiver Act. Repeals a provision requiring the Department on Aging to seek federal funding for the establishment and assessment of a Family Caregiver Training and Support Demonstration Project. Effective immediately.

OLDER ADULT SRVCS ADVISOR COMM

Amends the Older Adult Services Act. Changes the composition of the Older Adult Services Advisory Committee from 32 to 30 by providing that one member shall represent a municipality, township, or county (rather than, one member representing township officials, one member representing municipalities, and one member representing county officials). Effective immediately.

CHILD CUSTODY-KINSHIP CUSTODY

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that a child custody proceeding may be commenced by a person who provides "kinship care", by filing a petition that alleges that it is in the best interest of the child to live with him or her, if the person is the "de facto custodian" of the child. Provides that "de facto custodian" means the person who has been the primary caregiver for, and financial supporter of, a child who has resided with the person: for a period of 6 months or more, if the child is under 3 years of age; or for a period of one year or more, if the child is 3 years of age or older. Provides that "kinship care" means the care, nurturing, and protection of a child by a relative, grandparent, godparent, stepparent, or any adult who has physical custody and a kinship bond with a child. Provides that any notice of hearing in the proceeding shall be served by personal service or sent by certified or registered mail to all persons who have appeared of record in the proceeding. Amends the Probate Act of 1975. Provides that unless excused by the court for good cause shown, a petition for guardianship of a minor and a notice of hearing on the petition shall be given by personal service or by certified or registered mail to the minor, the minor's relatives, and the person having custody of the minor (instead of giving notice of the hearing on the petition, in person or by mail, to the minor and to the minor's relatives). Provides that the requirement that a copy of the petition and notice be served on or delivered to the person having custody of the minor is jurisdictional, but failure to provide copies to any relative is not jurisdictional (instead of providing that the failure to provide copies to any relative is not jurisdictional). Provides that a notice of hearing in a proceeding concerning guardianship of a minor shall be sent by certified or registered mail, return receipt requested, to all persons who have appeared of record in the proceeding.
