Amends the Registered Titles (Torrens) Act. Deletes a provision concerning excess funds in a county indemnity fund that states that the county may transfer and expend excess indemnity fund monies for the benefit of real property owners as the county deems appropriate, if at least 50% of the excess monies are transferred to the lead poisoning prevention fund but the county may not expend excess indemnity fund monies for any purpose other than lead poisoning prevention until it first designs, implements, and starts making loan or grant payments under the lead poisoning prevention program. Provides that this amendatory Act does not preempt, rescind, modify, or revise any local, State, or federal laws or rules governing lead paint mitigation or abatement or lead poisoning prevention. Effective immediately.

Amends the Mental Health and Developmental Disabilities Administrative Act, the State Property Control Act, and the Community Services Act. Provides that whenever a State mental health facility operated by the Department of Human Services is closed and the real estate on which the facility is located is sold by the State, the net proceeds of the sale of the real estate shall be deposited into the Community Mental Health Medicaid Trust Fund. Provides that whenever a State developmental disabilities facility operated by the Department of Human Services is closed and the real estate on which the facility is located is sold by the State, the net proceeds of the sale of the real estate shall be deposited into the Community Developmental Disability Services Medicaid Trust Fund. Provides that in determining whether any net proceeds are realized from such a sale of real estate, sufficient moneys shall be made available to ensure that there is an appropriate level of staffing and that life, safety, and care concerns are addressed so as to provide for persons with developmental disabilities or mental illness at the remaining State-operated facilities that will be expected to handle the individuals previously served at the closed facility. Requires the Department of Human Services to share and discuss its plan or plans for using the net proceeds with advocates, advocacy organizations, and advisory groups whose mission includes advocacy for persons with developmental disabilities or persons with mental illness. Effective immediately.
Amends the Hospital Licensing Act. Provides that the Department of Public Health shall investigate every allegation of abuse or neglect of a patient received by the Department. Provides that no administrator, agent, or employee of a hospital or a member of its medical staff may abuse or neglect a patient in the hospital, and provides that any hospital administrator, agent, employee, or medical staff member who has reasonable cause to believe that any patient with whom he or she has direct contact has been subjected to abuse or neglect in the hospital shall promptly report or cause a report to be made to a designated hospital administrator responsible for providing such reports to the Department of Public Health. Sets forth other provisions concerning protection of hospital patients from abuse and neglect. Provides that if no health care surrogate is available for a patient who lacks decision-making capacity, then the hospital may contact the Guardianship and Advocacy Commission to determine the need for a temporary guardian of the person.
Amends the Environmental Protection Act. Excludes the portion of a site or facility accepting exclusively general construction debris, located in a county with a population over 500,000 (now, 700,000) from regulation as a pollution control facility. Effective immediately.
Creates the Blind Vendors Act. Creates the Business Enterprise Program for the Blind and provides that the Secretary of Human Services, through the Bureau Director of the Bureau for the Blind in the Department of Human Services, shall continue, maintain, and promote the Program. Provides that the Program must provide that: priority is given to blind vendors in the operation of vending facilities on State property; tie bid preference is given to blind vendors in the operation of cafeterias on State property unless the cafeteria operations are operated by employees of a State agency; vending machine income from all vending machines on State property is assigned as provided in the Act; no State agency may impose a commission, service charge, rent, or utility charge on a licensed blind vendor who is operating a vending facility on State property; and vending facilities operated by the Program use reasonable and necessary means and methods to maintain fair market pricing in relation to each facility's given demographic, geographic, and other circumstances. Contains provisions concerning: intent; compliance with federal law; rules; establishment of vending facilities on State property; other vending facilities; creation of a Blind Vendors Trust Fund as a separate account managed by the Department of Human Services for the State's blind vendors; set-aside funds; vending machine income; issuance of licenses; creation of a Committee of Blind Vendors to participate in the development and implementation of all policies, plans, program development, and major administrative and management decisions affecting the Program; hearings; arbitration; reports and surveys; and other matters. Repeals the Blind Persons Operating Vending Facilities Act.
Amends the Department of Public Aid Law of the Civil Administrative Code of Illinois and the State Finance Act. Creates the Hunger Relief Fund as a special fund in the State treasury. Provides that, from appropriations to the Department of Healthcare and Family Services from the Fund, the Department shall make grants to members of the Illinois Food Bank Association for the purpose of making capital improvements, purchasing food, or acquiring other assets. Amends the Illinois Income Tax Act. Creates a tax checkoff for the Hunger Relief Fund. Amends the State Finance Act to create the Fund. Effective immediately.
Amends the Victims' Economic Security and Safety Act. Makes a technical change in a Section concerning posting of certain notices.
Amends the Illinois Sexually Transmissible Disease Control Act. Adds definitions for "health care professional" and "expedited partner therapy". Provides that the Department of Public Health shall provide information and technical assistance as appropriate to health care professionals who provide expedited partner therapy services for persons with sexually transmissible diseases. Provides that a health care professional who makes a clinical diagnosis of chlamydia or gonorrhea may prescribe, dispense, furnish, or otherwise provide prescription antibiotic drugs to the infected person's sexual partner or partners without physical examination of the partner or partners, if in the judgment of the health care professional, the partner is unlikely or unable to present for comprehensive health care. Provides that the health care professional shall provide counseling for the patient and written materials to be given by the patient to the partner or partners. Provides that a health care professional providing expedited partner therapy in good faith without fee or compensation and providing counseling and written materials shall not be subject to civil or professional liability, except for willful and wanton misconduct. Makes other changes.
Creates the 2-1-1 Service Act. Sets forth the findings of the General Assembly. Provides that "2-1-1" is created as the official State dialing code for public access to information and referral for health and human services and information about access to services after a natural or non-natural disaster. Contains provisions concerning the designation of a lead entity for 2-1-1. Contains provisions concerning the establishment or prohibition of new information services by specified parties. Contains provisions concerning 2-1-1 services, including the promotion of 2-1-1. Requires participants in 2-1-1 service to meet certain guidelines. Contains provisions concerning the liability of 2-1-1 providers. Amends the State Finance Act to create the 2-1-1 Account Fund in the State treasury to hold moneys from specified sources. Contains provisions concerning the use of moneys for projects and activities in support of 2-1-1-eligible activities. Provides that the lead entity shall provide an annual report to the General Assembly and the Illinois Commerce Commission beginning in calendar year 2010. Contains a severability clause.
Amends the Illinois Public Labor Relations Act and the Illinois Educational Labor Relations Act. Establishes a time frame within which an initial agreement must be reached or conciliation and arbitration attempted.
