REG TITLES TORRENS-LEAD PAINT

Amends the Registered Titles (Torrens) Act. Deletes a provision concerning excess funds in a county indemnity fund that states that the county may transfer and expend excess indemnity fund monies for the benefit of real property owners as the county deems appropriate, if at least 50% of the excess monies are transferred to the lead poisoning prevention fund but the county may not expend excess indemnity fund monies for any purpose other than lead poisoning prevention until it first designs, implements, and starts making loan or grant payments under the lead poisoning prevention program. Provides that this amendatory Act does not preempt, rescind, modify, or revise any local, State, or federal laws or rules governing lead paint mitigation or abatement or lead poisoning prevention. Effective immediately.

CAPITAL CRIMES LIT-EXPENSES

Amends the Capital Crimes Litigation Act. Provides that each provider of proposed capital litigation services must specify the best preliminary estimate that can be made in light of information received in the case at that point, and the provider must sign this estimate under the provisions of the Code of Civil Procedure relating to verified statements made under the penalty of perjury. Provides that a provider of proposed services must also specify (1) his or her hourly rate; (2) the hourly rate of anyone else in his or her employ for whom reimbursement is sought; and (3) the hourly rate of any person or entity that may be subcontracted to perform these services. Provides that the court must certify reasonable and necessary expenses of the petitioner for travel and per diem (lodging, meals, and incidental expenses). Provides that these expenses must be paid at the rate as promulgated by the United States General Services Administration for these expenses for the date and location in which they were incurred, unless extraordinary reasons are shown for the difference. Provides that if the State Treasurer finds within 14 days of his or her receipt of a certification that the compensation and expenses to be paid are unreasonable, unnecessary, or inappropriate, he or she may return the certification to the court setting forth in detail the objection or objections with a request for the court to review the objection or objections before resubmitting the certification. Provides that the State Treasurer may only seek a review of a specific objection once. Provides that the claimant has 7 days from his or her receipt of the objections to file a response with the court. Provides that with or without further hearing, the court must promptly rule on the objections.

BLIND VENDORS ACT

Creates the Blind Vendors Act. Creates the Business Enterprise Program for the Blind and provides that the Secretary of Human Services, through the Bureau Director of the Bureau for the Blind in the Department of Human Services, shall continue, maintain, and promote the Program. Provides that the Program must provide that: priority is given to blind vendors in the operation of vending facilities on State property; tie bid preference is given to blind vendors in the operation of cafeterias on State property unless the cafeteria operations are operated by employees of a State agency; vending machine income from all vending machines on State property is assigned as provided in the Act; no State agency may impose a commission, service charge, rent, or utility charge on a licensed blind vendor who is operating a vending facility on State property; and vending facilities operated by the Program use reasonable and necessary means and methods to maintain fair market pricing in relation to each facility's given demographic, geographic, and other circumstances. Contains provisions concerning: intent; compliance with federal law; rules; establishment of vending facilities on State property; other vending facilities; creation of a Blind Vendors Trust Fund as a separate account managed by the Department of Human Services for the State's blind vendors; set-aside funds; vending machine income; issuance of licenses; creation of a Committee of Blind Vendors to participate in the development and implementation of all policies, plans, program development, and major administrative and management decisions affecting the Program; hearings; arbitration; reports and surveys; and other matters. Repeals the Blind Persons Operating Vending Facilities Act.

PTELL-DEBT SERVICE EXTENSION

Amends the Property Tax Extension Limitation Law in the Property Tax Code. Provides that the debt service extension base must be increased each year by the percentage increase, for the previous calendar year, of the Consumer Price Index. Effective immediately.

EPA-COMPOSTING FACILITIES

Amends the Environmental Protection Act. Redefines the term "compost" to mean compostable material that has, by composting, decomposed to the degree that it will not, when subjected to optimal thermal conditions and optimal levels of oxygen, moisture, and nutrients, reheat significantly due to the action of microorganisms, and that is also suitable (i) for use as a soil conditioner, (ii) for use as a cover material for a municipal solid waste landfill, or (iii) for another use approved by the Agency (now, the humus-like product of the process of composting waste, which may be used as a soil conditioner). Redefines the term "composting" to mean the decomposition of compostable material into compost by a biological process that produces carbon dioxide and water as primary by-products (now, the biological treatment process by which microorganisms decompose the organic fraction of waste, producing compost). Excepts food scrap from the definition of the term "garbage". Exempts certain types of facilities, sites, portions of facilities, and portions of sites from regulation as pollution control facilities. Defines "compostable material" and "food scrap". Effective immediately.

SCH CD-RETIREMENT TRUSTEE LEAV

Amends the School Code. Provides that each school board employing an employee who is an elected trustee of the Illinois Municipal Retirement Fund shall make available to the elected trustee at least 20 days of paid leave of absence per year for the purpose of attending meetings of the Fund's Board of Trustees, committee meetings of the Board, and seminars regarding issues for which the Board is responsible. The Illinois Municipal Retirement Fund shall reimburse affected school districts for the actual cost of hiring a substitute employee during such leaves of absence. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PESTICIDE APPLICATION-SCHOOLS

Amends the School Code. Requires each school superintendent to create a program to ensure that students attending the schools that he or she manages cannot access those schools' grounds for at least 12 hours after those grounds are treated with a lawn care product. Requires each district superintendent to appoint a Lawn Care Coordinator whose duty it shall be (i) to implement that program, (ii) to supervise the provision of notice under subdivision (f)(2) of Section 3 of the Lawn Care Products Application and Notice Act, and (3) if the district adopts a pesticide-free turf care program, to supervise that program. Amends the Lawn Care Products Application and Notice Act. Requires applicators for hire to provide additional types of information to customers. Requires the owners or operators of day care centers to provide parents with one of two types of notice before applying pesticide or having pesticide applied to day center grounds (now, only school districts must provide that notice). Requires the Illinois Department of Public Health to inform school boards and the owners and operators of day care centers about these requirements. Requires the Illinois Department of Public Health to report violations to the Department of Agriculture for enforcement. Effective immediately.

HFS-MEDICAID-DISABLED PERSONS

Amends the Illinois Public Aid Code. In provisions concerning the Medicaid eligibility of persons with disabilities who are employed, adds (subject to federal approval) persons with a medically improved disability who are employed and eligible under a specified provision of the Social Security Act. Effective immediately.
