VEH CD-ADULT-SIZE ATV-AGE 16

Amends the Illinois Vehicle Code. Provides that a person under the age of 16 years may not operate an all-terrain vehicle with an engine larger than 90 cubic centimeters. Provides that the owner or person in possession of an all-terrain vehicle of that type may not knowingly permit a person under the age of 16 to operate it.

CRIM CD-AGG BATTERY SPORTS OFF

Amends the Criminal Code of 1961. Provides that the commission of a battery on a person known to be a sports official or coach at any level of competition and in which the act causing harm to the sports official or coach occurred within an athletic facility or within the immediate vicinity of the facility at which the sports official or coach was an active participant in the athletic contest held at the facility is aggravated battery. Provides that the penalty is a Class 3 felony. Amends the Unified Code of Corrections. Requires a person convicted of or placed on supervision for a violation to undergo an alcohol or drug abuse evaluation. Also provides for mandatory minimum fines for a violation of this offense. Effective immediately.

PROP TAX-SCHOOLS-SUPPLEMENTAL

Amends the Property Tax Code. Provides that, notwithstanding any other provision of the Code, if a school district adopts, in a fiscal year, an additional or supplemental budget as a result of the voters in the school district having voted in favor of an increase in the annual tax rate for educational or operations and maintenance purposes or both at an election held after the adoption of the annual school budget adopted in that fiscal year, the county clerk shall include, in the extension of taxes made during that fiscal year, the extension of taxes for the supplemental or additional budget adopted by the school district.

CRIM CD-DECERTIFIED POLICE

Amends the Criminal Code of 1961. Provides that a municipal police department or a county sheriff may not hire a person for employment in the municipal police department or county sheriff's office in any capacity if that person had been a full-time, permanent, or part-time police officer in this State or any other jurisdiction and has been decertified as a police officer by the Illinois Law Enforcement Training Standards Board or has been decertified as a police officer under a similar law of another jurisdiction. Provides that a county sheriff or municipal police chief or other police officer in charge of hiring police officers who violates this provision is guilty of a Class A misdemeanor.

ELEC-INSTANT RUN-OFF

Amends the Election Code and the Illinois Municipal Code. Authorizes municipalities by referendum to adopt an instant run-off voting method for the offices of mayor, city clerk, city treasurer, and city councilman or alderman. Declares that a municipal election using instant runoff voting is valid if it otherwise conformed to law.

VEH CD-SOBRIETY TESTS

Amends the Illinois Vehicle Code. Authorizes and establishes procedures for the statutory summary suspension of driver's licenses of persons who are stopped for DUI and who refuse to submit to preliminary breath or field sobriety tests. Provides that any person in control of a motor vehicle in this State shall be deemed to have given consent to performing field sobriety tests and to providing a breath sample for testing. Provides that the results of a preliminary breath screening or field sobriety test may be used by the defendant in any DUI administrative or court proceeding and may be used by the State in rebuttal to an assertion that the test did not accurately reflect a person's alcohol concentration. Permits temporary impounding of vehicles in certain cases. Provides that after a statutory summary suspension has been imposed on a person who previously has never been convicted of or received a disposition of supervision for a DUI offense, the court may immediately grant the person a judicial driving permit, if the person also submitted to field sobriety tests before failing the test of breath or blood alcohol. Provides for a hearing and procedures for a person who has had his or her license suspended for a failure to submit to having a breath screening or field sobriety test. Authorizes the Secretary of State to issue a restricted driving permit to a person who has had his or her license suspended for specified reasons if the person consents to a breath-alcohol ignition interlock device installed in his or her car. Amends the Unified Code of Corrections. Prohibits the court from assigning supervision to a defendant charged with driving a motor vehicle on a revoked or suspended license when the suspension or revocation was for violating the field sobriety test provision of the Vehicle Code if the defendant was convicted or assigned supervision within the last 10 years for driving on a revoked or suspended license. Makes other changes. Effective January 1, 2005.

HOUSING-NEW TEACHERS

Amends the Illinois Housing Development Act. Authorizes the Illinois Housing Development Authority to develop and implement a program of financial assistance to recently hired Illinois teachers purchasing their first primary residence. Limits the program to teachers employed by school districts defined by the State Board of Education as financially needy or experiencing a teacher shortage. Limits eligibility to public school teachers with no more than 2 years of employment as teachers who commit to teach in their school district for at least 3 years after their closing date. Effective July 1, 2003.

LIQUOR-BASSET TRAINING

Amends the Illinois Liquor Control Act of 1934. Requires a person who applies for the issuance or renewal of a license authorizing the sale of alcoholic liquor to include, with his or her application, proof of completion of a State-certified Beverage Alcohol Sellers and Servers Education and Training (BASSET) program for all persons who sell or serve alcoholic beverages under that license, all management personnel working at the licensed premise, and anyone whose job description entails the checking of identification for the purchase of alcoholic beverages under that license.

ELEC CD-OVERSEAS VOTERS

Amends the Election Code. Authorizes (i) civilian citizens outside the U.S. voting for federal officials, (ii) Merchant Marines and their qualified spouses and dependents, (iii) federal government employees stationed outside the U.S. and their qualified spouses and dependents, and (iv) citizens temporarily residing outside the U.S. and their qualified spouses and dependents to register to vote, request absentee ballots, and vote by fax machine or other electronic means (now, only members of the Armed Forces and their qualified spouses and dependents). Redefines "Armed Forces" to include the Reserve component and the Illinois National Guard. Requires election authorities to have the means to send and receive fax and other electronic transmissions. Requires the State Board of Elections to adopt necessary rules. Effective immediately.
