FUEL TEMP-DELIVERY STUDY

Amends the Weights and Measures Act. Provides that the Department of Agriculture shall conduct a survey on the effect of temperatures on fuel deliveries. Provides that the survey shall be conducted during routine dispenser inspections by determining the accuracy of fuel delivery and by recording fuel temperature, air temperature, and storage tank temperature at fuel stations and other fuel facilities subject to inspection. Provides that the Department shall submit the results of the survey to the Illinois Environmental Protection Agency, which shall conduct a cost-benefit analysis and comparison of various options relative to temperature-corrected gallonage temperatures. Provides that the Agency shall evaluate how different reference temperatures or temperature correction devices apply to alternative fuels and low-carbon fuel standards. Provides that the Agency shall convene an advisory group no later than January 25, 2009, that includes, but is not limited to, equipment manufacturers, consumer groups, fuel industry representatives, agricultural commissioners, appropriate government agencies, and other interested parties to provide guidance on the study pursuant to specified provisions and to provide guidance on the analysis and recommendations. Provides that the Agency, in partnership with the Department, shall conduct public hearings on the cost-benefit analysis and report to the General Assembly regarding recommended legislation and regulations based on the results of the study not later than December 31, 2009. Effective immediately.

GENETIC INFORMATION PRIVACY

Amends the Genetic Information Privacy Act. Adds several definitions. Provides that the Act applies to the State and local governments. Provides that an employer, employment agency, labor organization, and licensing agency shall not directly or indirectly do any of the following: (1) solicit, request, require or purchase genetic information of a person or administer a genetic test to a person as a condition of employment, preemployment application, labor organization membership, or licensure; (2) affect the terms, conditions, or privileges of employment, preemployment application, labor organization membership, or licensure, or terminate the employment, labor organization membership, or licensure of any person because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); (3) limit, segregate, or classify employees in any way that would deprive or tend to deprive any employee of employment opportunities or otherwise adversely affect the status of the employee as an employee because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); or (4) retaliate through discharge or in any other manner against any person alleging a violation of this Act. Makes other changes. Preempts home rule.

VICTIM NOTICE-SEX OFFENDERS

Amends the Rights of Crime Victims and Witnesses Act and the Sexually Violent Persons Commitment Act. Provides that notice to a victim, of a sex offender's release from custody, shall be made at least 60 days before release. Amends the Sex Offender Community Notification Law. Provides that notice that a sex offender is registered, residing, employed, or attending an institution of higher education in the jurisdiction shall be provided to the victim of the sex offense, upon written, facsimile transmission, or e-mail request of the victim, by the sheriff of the appropriate county or in Chicago by the Chicago Police Department.

CON AMEND-RECALL ELECTIONS

Proposes to amend the Legislature Article of the Illinois Constitution to authorize recall elections and to provide for the appointment of a Public Advocate. Effective upon being adopted.

VEH CD-MOTORCYCLE REGISTRATION

Amends the Illinois Vehicle Code. Provides that: the Secretary of State shall not register, renew the registration of, or issue a title for a motorcycle intended for highway use unless its owner possesses a valid driver's license with the proper classification; the application for a certificate of title for, or registration of, a motorcycle intended for highway use shall include the driver's license number and classification of the owner; the Secretary of State shall refuse registration or any transfer of registration of a motorcycle intended for highway use if the owner does not possess a valid driver's license with the proper classification; and the Secretary of State may suspend or revoke the registration of a vehicle or a certificate of title, registration card, registration sticker, registration plate, disability parking decal or device, or any nonresident or other permit if the vehicle is a motorcycle intended for highway use and its owner does not possess a valid driver's license with the proper classification. Effective January 1, 2009.

RETAIL SALE OF DOGS AND CATS

Creates the Retail Sale of Dogs and Cats Act. Imposes various requirements on pet dealers who sell dogs or cats. Provides that an animal must be examined by a licensed veterinarian before being placed with other animals by a pet dealer. Provides that a pet dealer must give the purchaser of a dog or cat a written statement containing certain information about the animal purchased and maintain a record of that information. Requires certain standards of care for animals. Imposes civil monetary penalties on a pet dealer for violations. Provides remedies for a purchaser if an animal becomes ill or dies as a result of an illness that existed in the animal at the time of purchase. Sets out a notice of an animal purchaser's rights, and requires that notice to be given to each purchaser of an animal from a pet dealer. Provides penalties for pet dealers who sell diseased or ill animals. Effective January 1, 2008.
