CRIMINAL LAW-TECH

Amends the Unified Code of Corrections. Makes a technical change in a Section requiring the Department of Corrections to designate those institutions and facilities that are maintained for persons assigned as adults and as juveniles.

MERCURY REDUCTION ACT

Creates the Mercury Reduction Act. Provides that the Environmental Protection Agency may participate in the establishment and implementation of a multi-state clearinghouse to assist in carrying out the purpose of mercury reduction. Provides that beginning July 1, 2005, no mercury-added product may be offered for final sale or use or distributed for promotional purposes in the State without prior written notification to the Environmental Protection Agency by the manufacturer of the product. Sets forth the requirements for this notification. Sets forth restrictions on the purchase or sale of certain mercury-added products. Provides that beginning July 1, 2006, no person may crush, shred, flatten, or otherwise process a motor vehicle for scrap metal without first making a good faith effort to remove any mercury light switches and mercury headlights. Provides that, on or before January 1, 2006, the Pollution Control Board must modify its rules governing universal hazardous waste as appropriate to promote the recycling, recovery, and proper management of elemental mercury and mercury-added products on a statewide basis. Sets forth penalties for violations of the Act. Amends the Environmental Protection Act. Adds "vehicle recycler" to the list of persons who may not knowingly shred, scrap, dismantle, recycle, incinerate, handle, store, or otherwise manage any white good that contains any white components. Provides that no owner, operator, agent, employee of a junkyard or scrap dealership, or vehicle recycler may knowingly shred, scrap, dismantle, recycle, incinerate, handle, store, or otherwise manage any end-of-life motor vehicle that contains any mercury-added component. Defines "vehicle recycler", "end-of-life motor vehicle", and "mercury-added component". Effective immediately.

IDPH-CERVICAL CANCR TASK FORCE

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Creates the Task Force on Cervical Cancer Elimination within the Department of Public Health. Requires the task force to examine the prevalence and burden of cervical cancer, raise public awareness concerning the causes and nature of cervical cancer, identify prevention and control strategies and technologies, and perform other functions. Requires the task force to develop a statewide comprehensive cervical cancer prevention plan and to make annual reports. Provides for expiration of the task force on April 1, 2009 or upon the task force's submission of its final report, whichever is earlier. Effective immediately.

DOMESTC VIOLENCE-ORDER PROTECT

Amends the Code of Criminal Procedure and the Illinois Domestic Violence Act. Requires that, in an emergency order of protection and an interim or plenary order of protection, specified language be stated.

DAGING-OMBUDSMAN

Amends the Illinois Act on the Aging. Provides that regional long term care ombudsman programs may use trained volunteers to make routine visits to facilities licensed or certified under the Nursing Home Care Act, the Assisted Living and Shared Housing Act, and the Social Security Act or to any other facility for which long term care ombudsmen are obligated to visit either by federal or State law. Sets forth requirements for the volunteers. Amends the Health Care Worker Background Check Act. Includes a trained-volunteer program operated by a regional long term care ombudsman program within the definition of "health care employer". Effective immediately.

NURSING SCHOLARSHIPS

Amends the Nursing Education Scholarship Law. Authorizes scholarships for registered nurses pursuing graduate degrees in nursing and to students in areas identified as designated shortage areas. Provides that 20% of scholarships shall be for recipients pursuing graduate degrees and reduces percentages for other recipients. Removes provisions concerning scholarships for pursuing a hospital-based diploma in nursing.

DPT AGING-FAMILY CAREGIVERS

Creates the Family Caregiver Act, to be administered by the Department on Aging, for the purpose of encouraging family members to provide care for their elderly family members. Requires the Department to contract with area agencies on aging and other appropriate agencies to provide family caregiver support services to the extent of available funding. Provides that the services include counseling, training, and respite care. Requires the Department to seek federal funding for a demonstration project. Also authorizes caregiver support services for grandparents who are primary caregivers for their grandchildren. Amends the Respite Program Act. Deletes references to abused adults and to functionally disabled or cognitively impaired adults (so that the Act applies to "frail or disabled" adults). Defines a "frail or disabled adult" as a person who is age 60 (instead of 55) or older and who either (i) suffers from Alzheimer's disease or a related disorder or (ii) is unable to attend to his or her daily needs without assistance or regular supervision. Deletes references to the Council on Aging. Makes other changes. Effective July 1, 2004.

HIGHER ED-NATIONAL GUARD GRANT

Amends the Higher Education Student Assistance Act. Provides that if the recipient of an Illinois National Guard Grant ceases to be a member of the Illinois National Guard while enrolled in a course of study under that grant but (i) has served in the Illinois National Guard for at least 5 years and (ii) has served a cumulative total of at least 6 months of active duty, then that recipient shall continue to be eligible for a grant for one year after membership in the Illinois National Guard ended, provided that the recipient has not already received the exemption from tuition and fees for the equivalent of 4 years of full-time enrollment. Effective immediately.

CRIM CD-TRESPASS-THEATRE

Amends the Criminal Code of 1961. Creates the offense of criminal trespass to a motion picture exhibition facility. Provides that it is a Class 4 felony to knowingly possess, carry, bear, or transport an audiovisual recording device into a motion picture exhibition facility without the consent of the owner or lessee of that exhibition facility and the licensor of the motion picture being exhibited. Establishes immunity from civil liability for an owner, lessee, employee, or agent of a motion picture exhibition facility who in good faith detains a person suspected of a violation of these provisions until law enforcement officers arrive. Permits law enforcement officers to carry audiovisual equipment into a motion picture exhibition facility during a lawful investigation. Effective immediately.
