STUDENT ONLINE PERSONAL INFO

Amends the Student Online Personal Protection Act. Provides that a student, school, or parent that has been injured or aggrieved by a violation of the Act may bring an action in a court of competent jurisdiction against the person or entity that violated the Act. Specifies that the provisions establishing a private right of action do not limit the Attorney General's enforcement authority under the Act.

MEDICAID-PBM-PROCUREMENT

Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Chief Procurement Officer for General Services, in consultation with the Department of Healthcare and Family Services, to conduct and complete, no later than one year after the effective date of the amendatory Act, any procurement necessary to select a third-party administrator to serve as the single State pharmacy benefit manager for the medical assistance program and to be used by all Medicaid managed care organizations under contract with the Department. Provides that, beginning on January 1, 2028, the selected pharmacy benefit manager shall be responsible for managing and processing all pharmacy claims under the medical assistance program, including pharmacy claims from contracted Medicaid managed care organizations. Provides that the Department is responsible for enforcing the pharmacy benefit manager contract after the procurement process. Sets forth certain activities the Director of Healthcare and Family Services must do as part of the procurement process, including: (i) establishing eligibility criteria an entity must meet in order to become the State pharmacy benefit manager; and (ii) developing a master contract that incorporates all pharmacy benefit manager contract requirements under the Illinois Insurance Code, with some exceptions. Requires a prospective State pharmacy benefit manager to disclose certain information during the procurement process, including, but not limited to: (i) any conflicts of interest; (ii) any common ownership, board membership, or other control the pharmacy benefit manager has over a Medicaid managed care organization or other specified entities; and (iii) any financial terms and arrangements between the pharmacy benefit manager and a prescription drug manufacturer or labeler. Effective immediately.

DIGITAL LIBRARY PROTECTION ACT

Amends the Digital Library Protection Act. Provides that no publisher shall enter into a contract or license agreement to distribute electronic literary materials to a library that: (1) restricts the library from performing customary operational functions; (2) restricts the library from performing customary lending functions; (3) restricts the library from disclosing the terms of the contract or license agreement to any other library in the State; or (4) requires the library to violate the Library Records Confidentiality Act. Provides that a violation of the Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Provides that any contract to license electronic literary materials to a library that includes a provision prohibited under the Act is deemed unenforceable and void. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. Effective immediately.

INS-LUNG CANCER SCREENING

Amends the Illinois Insurance Code. Provides that no policy of accident and health insurance shall be issued, amended, delivered, or renewed in this State on or after January 1, 2027 unless the policy provides coverage for annual lung cancer screenings for any beneficiary currently employed as an active firefighter or any person eligible for or currently receiving a retirement annuity, retirement pension, disability pension, or disability benefit pursuant to the Downstate Firefighter or Chicago Firefighter Article of the Illinois Pension Code. Requires the coverage to be provided without cost sharing. Amends the Counties Code, the Township Code, the Illinois Municipal Code, and the Illinois Public Aid Code to require coverage under the provisions of those Acts.

INS CD-MENTAL HEALTH PARITY

Amends the Illinois Insurance Code. Establishes reimbursement rates for mental health and substance use disorder treatment services for all group or individual policies of accident and health insurance or managed care plans that are amended, delivered, issued, or renewed on or after January 1, 2027 or for any contracted third party administering the behavioral health benefits for the insurer. Requires a group or individual policy of accident and health insurance or managed care plan that is amended, delivered, issued, or renewed on or after January 1, 2026 or any contracted third party administering the behavioral health benefits for the insurer to cover certain medically necessary mental health and substance use disorder treatment services. Provides that, if the Department of Insurance determines that an insurer or a contracted third party administering the behavioral health benefits for the insurer has violated a provision concerning mental health and substance use parity, the Department shall by order assess a civil penalty of $1,000 for each violation. Excludes certain health care plans serving Medicaid populations who are enrolled under the Illinois Public Aid Code or under the Children's Health Insurance Program Act from provisions concerning mental health and substance use parity. Requires the Department to review the impact of the proposed mental health and substance abuse mandate on network adequacy for mental health and substance use disorder treatment and access to affordable mental health and substance use care. Permits the Department to examine out-of-network utilization and out-of-pocket costs for insureds for mental health and substance use treatment and services for all plans to compare with in-network utilization. Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, and the School Code to require coverage under those provisions. Effective immediately.

POW MIA RECOGNITION DAY

Amends the State Commemorative Dates Act. Provides that the Governor shall annually designate by official proclamation the third Friday of September in each year as POW/MIA Recognition Day (rather than the third Friday of September in each year is designated as POW/MIA Recognition Day) to be observed in honor and remembrance of the men and women who, as POWs, have suffered captivity in foreign countries while in active service with the United States armed forces or who, as MIAs, have been recognized as missing in action in a time of war or during a period of hostilities (rather than who were recognized as POWs or MIAs in a time of war or during a period of hostilities). Provides that the Governor shall request, in the Governor's annual designation by official proclamation, that some portion of the third Friday of September be used for solemn contemplation on the plight of members of the United States armed forces who have been held prisoners of war and members of the United States armed forces who have been missing in action and the resolve of families and friends who continue to seek the fullest possible accounting for missing loved ones. Effective immediately.

SNAP-TRUMP ADMINISTRATION

Calls upon the Trump administration to end the government shutdown and restore funding to SNAP and other critical federal government programs rather than continuing to put partisan politics before their obligation to the American people. That if an expedient end to the shutdown cannot or will not be achieved, then the Trump administration is urged to release the reserve funds held by the United States Department of Agriculture specifically for just this eventuality, thereby enabling SNAP beneficiaries to retain access to adequate nutrition while negotiations continue. States that using hunger as a weapon to obtain a desired political outcome is reprehensible and unequivocally condemns the Trump Administration's actions in this regard.
