Amends the Real Estate Appraiser Licensing Act of 2002. Provides that a license is not required under the Act to perform valuations if the valuations are performed by an employee of a municipality if the valuation is in an amount not to exceed $10,000 and meets other specified conditions. Effective immediately.

Creates the Toxin-Free Toddler Act. Provides that, beginning January 1, 2013, no manufacturer or wholesaler may sell or offer for sale in this State a children's food or beverage container that contains bisphenol A (BPA). Provides that, beginning January 1, 2014, no retailer may sell or offer for sale in this State a children's food or beverage container that contains bisphenol A (BPA). Provides for enforcement by the Attorney General. Authorizes the imposition of a $200 civil penalty for violations of the Act. Defines "child", "children's food or beverage container", "manufacturer", "retailer", and "wholesaler". Effective immediately.
Amends the Illinois Income Tax Act. Provides that any fund that received less than $100,000 but more than $90,000 by October 1, 2011 shall also be included on the individual income tax form for the taxable year beginning on January 1, 2012. Provides that, if a fund that received less than $100,000 but more than $90,000 by October 1, 2011 does not receive at least $100,000 in contributions by October 1, 2013, or by October 1 of any subsequent year, then the fund shall be removed from the individual income tax return forms for each year following the year in which the fund did not receive at least $100,000, and all subsequent contributions to the fund shall be refunded to the taxpayer. Effective immediately.
Amends the Criminal Identification Act and the Unified Code of Corrections. Provides that the Prisoner Review Board, upon a petition by a person who has been convicted of a Class 3 or 4 felony and who meets other eligibility requirements, shall hear by a panel of at least 3 members and, with the unanimous vote of 3 members, issue a certificate of eligibility recommending that the court order the sealing of all official records of the arresting authority, the circuit court clerk, and the Department of State Police concerning the arrest and conviction of the person for the Class 3 or 4 felony. Excludes from eligibility persons convicted of violent crimes, sex offenses, or DUI.
Amends the Public Utilities Act. Provides that the Illinois Commerce Commission shall require all regulated utilities under its authority to submit a quarterly report on all procurement goals and actual spending for minority-owned, women-owned, veteran-owned, and small business enterprises. Provides that each regulated utility shall submit the rules, regulations, and definitions used for their procurement goals in their quarterly report, and the Commission shall publish each quarterly report on its website and shall maintain each quarterly report for at least 5 years. Effective immediately.
Amends the Criminal Identification Act. Provides that criminal records sealed by the Department of State Police may be disseminated by the Department only to the arresting authority, the State's Attorney, and the court upon a later arrest for the same or similar offense or for the purpose of sentencing for any subsequent felony. Strikes provision that permitted the dissemination to other parties of criminal records sealed as required by law.
Amends the Equal Pay Act of 2003. Provides that in addition to an individual who is deemed to be an employer, any officers of a corporation or agents of an employer who knowingly permit such employer to violate the provisions of the Act shall be deemed to be the employers of the employees.
Amends the State Finance Act and the Public Utilities Act. Creates the Energy Efficiency Portfolio Standards Fund. Provides that all moneys received by the Department of Commerce and Economic Opportunity under specified provisions of the Public Utilities Act related to energy efficiency shall be deposited into the Energy Efficiency Portfolio Standards Fund and shall be used only for the purposes authorized by those provisions of the Public Utilities Act. Further amends the Public Utilities Act. Provides that the Department of Commerce and Economic Opportunity is authorized to adopt any rules necessary and prescribe procedures in order to ensure compliance by applicants in carrying out the purposes of rebate agreements for energy efficiency measures implemented by the Department. Makes other changes. Effective immediately.
Amends the Wholesale Drug Distribution Licensing Act. Provides that any person who practices, offers to practice, attempts to practice, or holds oneself out to practice as a wholesale drug distributor or pharmacy distributor without being licensed under the Act shall pay a civil penalty to the Department of Financial and Professional Regulation in an amount not to exceed $10,000 (instead of $5,000) per violation for each offense. Provides that any pharmacy investigator authorized by the Department has the right of entry that includes the business premises of a person licensed pursuant to the Act. Permits the authorized pharmacy investigator unfettered access to the entire business premises. Provides that the most recent 12 months of record must be kept on the premises where the drugs are stored. Allows the Department to take action, including imposing fines not to exceed $10,000 per violation, if the individual meets the requirements for grounds for disciplinary action. Provides that if any person violates the provisions of the Act, the Secretary may petition for an order enjoining the violation or for an order enforcing compliance with the Act. Provides that the Department may issue a rule to show cause why an order to cease and desist shall not be entered against that person. Makes other changes. Amends the Regulatory Sunset Act to extend the repeal of the Wholesale Drug Distribution Licensing Act from January 1, 2013 to January 1, 2023. Effective immediately.
Creates the Consumer Alternatives Program Act. Directs the Department of Human Services to implement the Consumer Alternatives Program to prevent or avoid the unnecessary institutional care treatment of individuals with mental disorders or a co-occurring disorder of mental illness and substance abuse or addiction and to provide cost effective, community alternatives and supports that enable these individuals to live successfully in the community. Requires implementation of the Program during fiscal year 2013. Makes implementation of the Program dependent upon funds appropriated by the General Assembly. Provides that participants in the program may receive certain services such as a comprehensive evaluation that includes an assessment of skills, abilities, and potential for living in the community and work placement; family or individual support services; case coordination services; and vocational training. Prohibits the denial of program services because of age, sex, ethnic origin, marital status, ability to pay (except when contrary to law), degree of disability, or illness. Requires the Department of Commerce and Economic Opportunity to assist the Department of Human Services in developing housing assistance programs aimed at promoting the ability of individuals with a mental disorder to move from institutions to the most integrated community residence. Effective July 1, 2012.
