DPT OF CHILD SUPPORT SRVCS ACT

Creates the Department of Child Support Services Act. Creates the Department of Child Support Services and the position of Director of Child Support Services. Designates the Department of Child Support Services as the single State agency to administer the State's Title IV-D State plan for securing child and spouse support and determining paternity; transfers those functions from the Department of Public Aid to the Department of Child Support Services. Provides for the confidentiality of records to facilitate and enhance the child and spouse support enforcement program, and makes a violation of the confidentiality provisions a Class A misdemeanor. Provides that the Department of Child Support Services is the successor agency to the Department of Public Aid for purposes of child and spouse support enforcement. Provides for the transfer of functions, employees, and property from the Department of Public Aid to the Department of Child Support Services. Amends the Departments of State Government Law of the Civil Administrative Code of Illinois to add the Department of Child Support Services as a department of State government and the Director of Child Support Services as the head of the Department. Amends various Acts to change references from the Department of Public Aid to the Department of Child Support Services in connection with child and spouse support enforcement. Effective immediately.

FOSTER CARE TASK FORCE

Creates a Task Force to review the operations of the Illinois Department of Children and Family Services Foster Care Division and related laws and rules impacting the Illinois foster care system.

PENCD-FUNDING STATE SYSTEMS

Amends the Illinois Pension Code. In provisions concerning the 5 State-funded retirement systems, deletes language specifying dollar amounts for the State contribution to each System required for FY 2007 and provides that State contributions to the systems for fiscal years 2007 through 2010 shall be increased in equal annual increments from the required State contributions in State fiscal year 2005 until the State is contributing at a rate that will result in the systems being 90% funded. Changes how certain calculations related to the required State contributions are made. Provides that the Board of Trustees of the retirement systems must re-certify, on or before July 1, 2006, the amount of the required State contribution for FY 2007, taking into account the changes made by this amendatory Act. In the State Employee Article of the Illinois Pension Code, provides that increases as a result of certain early retirement incentives shall not be included in the calculation of the required State contribution under that Article, but shall be appropriated separately. Creates a 4-member task force to study the issue of repayment of that portion of the required State contribution mandated by Public Act 88-593 that was reduced as a result of the passage of Public Act 94-4 and to make recommendations on the development of a way to repay the amount by which the contributions were reduced within a 10-year period. Effective immediately.

LOBBYIST-HEARING OFFICERS

Amends the Lobbyist Registration Act. Prohibits a person required to be registered, his or her spouse, and his or her immediate family member living with that person from serving as an arbitrator or a hearing officer for certain boards, commissions, authorities, and task forces.

DCEO FOLLOW-UP PROGRAM AUDIT

Direct the Auditor General to conduct a follow-up management and program audit of the Department of Commerce and Economic Opportunity's administration of its economic development programs in FY05 and to distribute a report upon completion of the audit.

INC TAX-DEDUCT DEPENDENT CARE

Amends the Illinois Income Tax Act. For taxable years ending on or after December 31, 2005, provides for a deduction from adjusted gross income of up to $5,000 paid by an individual taxpayer for dependent care provided for a child, disabled spouse, or other dependent adult during the taxable year. Provides that the amount may not be deducted unless certain information identifying the person providing the services is included on the return. Excepts the deduction from the sunset requirements. Effective immediately.
