SCH CD-TUITION VOUCHERS

Amends the School Code. Creates the Illinois School Choice Program, which shall be administered by the State Board of Education. Provides that any State-certified, non-public school wishing to enroll eligible students and be reimbursed for vouchers available under specified provisions shall notify the State Board of Education in writing of its intent. Specifies the eligibility for reimbursement of vouchers. Specifies reporting requirements for non-public schools that are participating in the Program. Contains provisions concerning the calculation of vouchers and how they may be used by parents. Contains provisions concerning the verification of the household income of participating parents. Provides that the State Board of Education may adopt rules for administration of the Program. Amends the State Finance Act to create the School Choice Fund as a special fund in the State treasury and provides that permitted fees collected by the State Board of Education shall be deposited into the Fund and shall be used by the State Board of Education to cover the administrative costs of the Program. Effective immediately.

CRIM CD-JUDICIAL SALE

Amends the Criminal Code of 1961. Creates the offense of unlawful manipulation of a judicial sale. Provides that a person commits the offense when he or she knowingly and by any means makes any contract with or engages in any combination or conspiracy with any other person who is, or but for a prior agreement is, a competitor of such person for the purpose of or with the effect of fixing, controlling, limiting, or otherwise manipulating (1) the participation of any person in, or (2) the making of bids, at any judicial sale. Provides that unlawful manipulation of a judicial sale is a Class 3 felony. Provides that a mandatory fine shall be imposed for a violation, not to exceed $1,000,000 if the violator is a corporation, or, if the violator is any other person, $100,000. Provides that a second or subsequent violation is a Class 2 felony. Establishes injunctive relief and a private right of action for damages or injunctive relief. Effective immediately.

MHDD-CHIPS PROGRAM

Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that beginning July 1, 2010, the Department of Human Services' Division of Mental Health shall reinstate and fully operate the Community Hospital Inpatient Psychiatric Services ("CHIPS") Program in the same manner as it had been operated on May 1, 2009. Further provides that the Division of Mental Health shall establish and pay adequate and timely reimbursement for private community hospitals, psychiatrists, and other mental health professionals who render care under the CHIPS program using the same reimbursement methodology that was in effect on May 1, 2009, and that the Division shall adopt such regulations as shall be necessary to implement this amendatory Act. Effective immediately.

IDPH-PRESCRIPT DRUG REPOSITORY

Creates the Prescription Drug Repository Program Act. Requires the Department of Public Health to establish a prescription drug repository program, under which a healthcare facility may donate a prescription drug or supplies needed to administer a prescription drug for use by an individual who meets eligibility criteria specified by the Department. Sets forth requirements that prescription drugs or supplies must meet in order to be accepted and dispensed under the program. Provides that no drugs or supplies donated under the prescription drug repository program may be resold. Provides that nothing in the Act requires that a pharmacy or pharmacist participate in the prescription drug repository program. Provides for civil and criminal immunity for drug and supply manufacturers and pharmacists in relation to the donation, acceptance, or dispensing of prescription drugs or supplies under the prescription drug repository program. Amends the Pharmacy Practice Act, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in donating or accepting, or packaging, repackaging, or labeling, prescription drugs to the extent permitted or required under the Prescription Drug Repository Program Act are exempt from provisions of those other Acts that might prohibit or otherwise regulate such activity.

ELEVATOR SAFETY-EXEMPTION

Amends the Elevator Safety and Regulation Act. Exempts from the Act any municipality that has had a conveyance program in place since June 1, 2003 (the effective date of the Act). Effective immediately.

Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that records and communications may be disclosed when a therapist determines that certain disclosures are necessary to initiate or continue civil commitment or involuntary treatment proceedings (instead of only civil commitment proceedings). Effective immediately.
