CHILD SOLICITATION-PORNOGRAPHY

Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Provides that the Department of State Police shall establish a Project Safe Child pilot program to combat crimes against children facilitated by the Internet. Encourages the prosecution in federal court of all persons who use the Internet, directly or indirectly, to commit or attempt to commit illegal solicitation of a child or a sex offense if the sex offense is committed or attempted against a child. Provides that the program shall also encourage public outreach by law enforcement agencies. Creates the Project Safe Child Fund in the State treasury. Provides that moneys in the Fund, subject to appropriation, shall be used by the Department of State Police to develop and administer the program. Amends the Sex Offender Management Board Act, the Criminal Code of 1961, the Unified Code of Corrections, and the Sex Offender Registration Act. Creates the offense of illegal solicitation of a child. Provides that a person commits the offense of illegal solicitation of a child when he or she intentionally solicits, lures, or attempts to solicit or lure a child under 18 years of age to any location without the consent of the parent or lawful custodian of the child for other than a lawful purpose or intentionally contacts or communicates with, or attempts to contact or communicate with a child, for the purpose of engaging in an unlawful act with the child. Provides that a violation is a Class 4 felony for a first offense and a Class 3 felony for a second or subsequent offense. Changes the elements of the offense relating to distributing harmful material for a child. Makes it child pornography to solicit, persuade, induce, entice, seduce, or coerce a child under 18 years of age to pose for a photograph, videotape, or a digital image in any posture or setting that could be construed as child erotica. Makes other changes. Effective immediately.

DPR-LICENSE EXAM CONTRACTS

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois and the Illinois Procurement Code. Provides that the Department's procurement of license examination administration services is subject to the Illinois Procurement Code.

WRK COMP-MANAGEMENT AUDIT

Amends the Workers' Compensation Act. Provides that the Industrial Commission shall procure a management audit of its operations and a report of the findings of the management audit shall be published no later than March 1, 2005. Effective immediately.

PATIENT HEALTH INFO ACT

Creates the Patient Health Information Act. Provides that every patient may examine and receive a reasonable explanation of his or her total bill for health care services rendered by his or her health care professional or health care provider. Provides for the disclosure of the nature or details of health care services provided to patients to specified parties. Requires that every health care professional and health care provider, upon written request of a patient, permit the patient or other specified parties to examine and copy the patient's records. Provides for a health care professional or health care provider's responsibility for maintaining and transferring patient medical records. Provides for implementation by the Department of Public Health. Amends the Code of Civil Procedure. Replaces provisions regarding the availability of patient records with a provision stating that patient health care records are available from health care professionals and health care providers in accordance with the Patient Health Information Act. In a provision concerning attorney's records, provides that any requested fees must be paid to receive copies of the attorney's records and that entities legally authorized to receive copies, including via a subpoena, must comply with the provisions concerning attorney's records. Effective immediately.

LIFE-HLTH GUARANTY ASSOCATION

Amends the Life and Health Insurance Guaranty Association Article of the Illinois Insurance Code. Prohibits health care providers from seeking payment from insureds until a final determination of the Association's liability has been made. Excludes from coverage certain variable rate instruments. Excludes from coverage certain self-funded employer and employee benefit plans. Removes authority of the Association to loan money to an impaired insurer. Sets forth conditions under which coverage is provided to residents and nonresidents. Makes changes with respect to the manner assessments are made upon insurers. Limits the liability of the Association and the Director of Insurance with respect to the operation of the Association. Effective January 1, 2004.

CRIM CD-LIMITATIONS

Amends the Criminal Code of 1961. Provides that the statute of limitations for an offense based upon misconduct in office by a public officer or public employee may be extended to 6 (rather than 3) years beyond the expiration of the period otherwise applicable. Effective immediately.
