Amends the Illinois Housing Development Act to authorize the Illinois Housing Authority to establish and administer a foreclosure prevention counseling program using moneys in the Foreclosure Prevention Counseling Fund, appropriated for that purpose, to make grants to HUD-certified housing counseling agencies to support pre-purchase and post-purchase home ownership education and foreclosure prevention counseling. Amends the State Finance Act to create the Foreclosure Prevention Counseling Fund. Provides that 75% of the moneys in this Fund shall be used for housing counseling outside Chicago and 25% of the moneys shall be used for such counseling in Chicago. Effective immediately.
Amends the Election Code. Provides that, if a provisional voter is registered at an address other than the address contained in his or her affidavit, then the county clerk or board of election commissioners shall verify that there is no record of the provisional voter having cast a ballot at that election in the precinct associated with his or her previous address. Effective immediately.
Amends the Illinois Insurance Code. Provides that no policy of automobile insurance may be cancelled where the basis for such cancellation is the insured's lack of a valid drivers license or valid instruction permit if the insurer failed to ask the insured for proof of a valid drivers license or valid instruction permit at the time the insured applied for coverage.
Amends the Illinois Income Tax Act. Provides that, within 60 days after the Department of Revenue issues a final decision that any elected official has (i) failed to file a return required under the Act or (ii) failed to pay all or a portion of the tax due under the Act, that elected official must either (A) pay all such delinquent amounts, together with any penalties and interest, or (B) resign from that elective office. Effective immediately.
Amends the Tax Increment Allocation Redevelopment Act in the Illinois Municipal Code. Provides that all accumulated tax incremental revenues not specifically appropriated for defined costs for projects within a redevelopment project area by the end of a municipality's fiscal year shall be deemed "surplus" funds. Provides that all surplus funds in the special tax allocation fund shall be distributed annually within 60 (instead of 180) days after the close of the municipality's fiscal year. Effective immediately.
Creates the Consumer Contract Plain Language Act. Requires consumer contracts to be written in a simple, clear, understandable, and easily readable manner. Establishes the requirements necessary for compliance with the Act. Authorizes the Attorney General to enforce the Act. Provides remedies, including statutory damages. Effective immediately.
Amends the Residential Mortgage License Act of 1987, the High Risk Home Loan Act, and the Interest Act. Limits the imposition of prepayment penalties in connection with high risk home loans. Limits the size of balloon payments in connection with high risk home loans. Limits the imposition of late fees. Effective January 1, 2013.
