Amends the Open Meetings Act. Makes a technical change in a Section concerning the short title.
Amends the School Code. Establishes the State Seal of Biliteracy program to recognize public high school graduates who have attained a high level of proficiency in listening, speaking, reading, and writing in one or more languages in addition to English. Provides that the State Seal of Biliteracy shall be awarded by the State Board of Education beginning with the 2014-2015 school year. Provides that school district participation in this program is voluntary. Sets forth the purposes of the State Seal of Biliteracy. Sets forth requirements for the State Board of Education and participating school districts. Provides that no fee shall be charged to a pupil. Effective July 1, 2013.
Amends the Mortgage Escrow Account Act. Makes a technical change in a Section concerning the Act's short title.
Amends the Criminal Code of 2012. Deletes provision that enhances the penalty for prostitution to a Class 4 felony if the offense is committed within 1,000 feet of real property comprising a school. Deletes provision that a second or subsequent prostitution violation, or any combination of convictions for prostitution and solicitation of a sexual act, promoting prostitution, promoting juvenile prostitution, soliciting for a prostitute, soliciting for a juvenile prostitute, pandering, keeping a place of prostitution, keeping a place of juvenile prostitution, patronizing a prostitute, patronizing a juvenile prostitute, pimping, juvenile pimping, aggravated juvenile pimping, or exploitation of a child, is a Class 4 felony. Effective immediately.
Amends the Animal Welfare Act. Provides that certain disclosure requirements apply to the sale or exchange of each dog and cat within the State (rather than the sale of dogs and cats by pet shop operators). Provides that, if there is an outbreak of distemper, parvovirus, or any other contagious and potentially life-threatening disease affecting more than 2 dogs at a seller's pet shop or kennel within a 60-day period, then the seller shall provide each customer that purchases a dog a written notice stating the nature of the outbreak, and shall notify the State Veterinarian of the outbreak within 2 business days after becoming aware that a third animal has contracted the disease. Provides that a customer who purchased a dog from a seller is entitled to a remedy if certain conditions relating to a disease, illness, condition, or death of the dog are met. Sets forth conditions that a customer shall meet to obtain a remedy from a seller and a timeframe in which the seller shall provide a reimbursement to the customer. Provides that a customer may not be entitled to a remedy if the customer fails to meet certain requirements. Provides that a seller may contest a remedy sought by a customer. Provides that if a customer and seller do not reach an agreement within 10 business days, then the parties may agree to binding arbitration or the customer may bring suit in a court of competent jurisdiction. Changes certain references from "pet shop operator" to "seller".
Amends the Title Insurance Act. Excludes limited liability companies from the requirement that every title insurance agent registration applicant must be 18 years or more of age. Provides that included in every application for registration of a title insurance agent, including a firm, partnership, association, limited liability company, or corporation, shall be an affidavit of the applicant title insurance agent, signed and notarized in front of a notary public, affirming that the applicant and every owner, officer, director, principal, member, or manager of the applicant has never been convicted or pled guilty to any felony or misdemeanor involving a crime of theft or dishonesty. Provides that no person who has had a conviction or pled guilty to any felony or misdemeanor involving theft or dishonesty may be registered by a title insurance company, and no such person may serve as an owner, officer, director, principal, or manager of any registered title insurance agent. Includes additional factors whereby the Secretary of Financial and Professional Regulation may refuse to grant or may suspend or revoke any certificate of authority, registration, or license issued pursuant to the Act or impose a fine for a violation of the Act. Effective January 1, 2014.
Amends the Payday Loan Reform Act and the Consumer Installment Loan Act. Provides that the Department of Financial and Professional Regulation shall set rules for the imposition and amount of fines.
Amends the Illinois Vehicle Code. Raises the penalty for a violation of the restriction on driving while a license is suspended or revoked if the violation results in an accident that causes bodily injury to a Class 4 felony if the driver has no prior violations, a Class 3 felony if the driver has previously been convicted of violating this Section, and a Class 2 felony if the driver has been convicted of violating this Section on 2 or more prior occasions.
Amends the Code of Civil Procedure. Replaces the provisions of the Section concerning actions for damages for personal injury based on childhood sexual abuse with language providing that an action for damages based on childhood sexual abuse may be commenced at any time. Provides that the changes made by the amendatory Act apply to actions pending on the effective date of the Act and to actions commenced on or after that date.
