MOBILE HOME LANDLORD TENANT

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that a park owner shall present a lease to a prospective tenant at least one day before signing the lease. Provides that when a mobile home park is owned by an entity that is publicly traded on any national stock or securities exchange, then the following conditions apply: 1) the park owner is to have a refund procedure for a lease or purchase agreement that a prospective tenant cancels within 3 days after signing the lease or purchase agreement; 2) if a tenant leaves the park because of a temporary illness or disability, the park owner shall allow qualified, including age in a park that has "housing for older persons", relatives designated by the tenant or the tenant's guardian to live in the home; 3) automatic lease renewal for 2 years unless certain requirements are met, such as a 30-day notice and a notice of reasons for the non-renewal of the lease; 4) the park owner is to give 12 months notice of a decision to close all or part of the park. Provides that a park owner may enter into a month-to-month rental agreement with a tenant if the agreement requires that there must be a rent increase notice given at least 90 days in advance of any increase and the tenant signs a statement that acknowledges that he or she wanted a shorter lease and was offered a longer lease. Provides a 90 day period following the effective date of the statutory changes to allow leases to be issued or modified in order to conform to the statutory changes. Provides for delivery of notices by first class mail. Provides that if the only change in a lease for a new term is the amount of the rent, the park owner may issue a rent increase notice, rather than issue a new lease.

ANTI-PHISHING ACT

Creates the Anti-Phishing Act. Makes it unlawful for a person, by means of a Web page, e-mail message, or otherwise through use of the Internet, to solicit, request, or take any action to induce another person to provide identifying information by representing oneself to be a business without the authority or approval of the business. Provides that a person who is engaged in the business of providing Internet access service to the public, owns a Web page, or owns a trademark and is adversely affected by a violation may bring an action to recover the greater of actual damages or $500,000. Provides that an individual who is adversely affected by a violation may bring an action against a person who has directly violated the Act to enjoin further violations of the Act and to recover the greater of 3 times the amount of actual damages or $5,000 per violation. Provides that the Attorney General or a State's Attorney may bring an action against a person who violates or is in violation of the Act to enjoin further violations and to recover a civil penalty of up to $2,500 per violation. Provides that a court may increase the recoverable damages to an amount up to 3 times the damages otherwise recoverable if the defendant has engaged in a pattern and practice of violating the Act and award costs of suit and attorney's fees to a prevailing plaintiff. Provides that these remedies do not preclude the seeking of remedies, including criminal remedies, under any other applicable provision of law. Provides that multiple violations resulting from any single action or conduct shall constitute one violation.

GREEN BLDG-ENTERPRISE ZONES

Amends the Illinois Enterprise Zone Act. Provides that a private development is qualified to become and is an enterprise zone and eligible for all the benefits of an enterprise zone if it (i) achieves certification using nationally recognized and accepted green building and sensible growth guidelines, standards, or systems, and (ii) is selected through a request for proposals by the Capital Development Board. Amends the Capital Development Board Act. Provides that the Capital Development Board shall issue a request for proposals by December 31, 2008 to select 3 model private developments that are designated by specified organizations as achieving certification using nationally recognized and accepted green building and sensible growth guidelines on a neighborhood scale. Provides that the model projects shall be designated as such to receive the benefits attained through Illinois Enterprise Zones for a period of 5 years.

VEH CD-GRADUATED LICENSE

Amends the Illinois Vehicle Code, School Code, Child Passenger Protection Act, and Unified Code of Corrections. Makes various changes regarding: driver education requirements; graduated driver's licenses; instruction permits for minors; curfews for drivers under a specified age; the number of passengers under a specified age allowed in a vehicle driven by a newly licensed driver under a certain age; the use of seat safety belts; the use of wireless telephones by graduated driver's license holders; suspensions of driver's licenses of drivers under age 21 under specified circumstances; required appearances before the presiding judge with a parent or guardian under specified circumstances; vehicle impoundment for drivers arrested for street racing; and other matters. Repeals provisions creating the offense of drag racing. Creates the offenses of street racing and aggravated street racing, and makes conforming changes. Makes other changes. Effective January 1, 2008, except that the provisions amending the School Code are effective July 1, 2008.

CRIM CD-PROSTITUTION PROBATION

Amends the Criminal Code of 1961. Provides that when a person who has not previously been convicted of or placed on probation for felony prostitution is guilty of felony prostitution, the court, without entering a judgment and with the consent of the person, may sentence the person to probation. Provides that when a person is placed on probation for felony prostitution, the court shall order a period of probation of 24 months and defer further proceedings until the conclusion of the period or until the filing of a petition alleging violation of probation. Provides that the conditions of probation shall be that the person: not violate any criminal statute of any jurisdiction; refrain from possessing a firearm or other dangerous weapon; submit to periodic drug testing at a time and in a manner as ordered by the court, but no less than 3 times during the period of the probation, with the cost of the testing to be paid by the probationer; and perform no less than 30 hours of community service if community service is available in the jurisdiction and is funded and approved by the county board. Provides that the court may impose other conditions of probation. Provides that upon fulfillment of the terms and conditions of probation, the court shall discharge the person and dismiss the proceedings. Provides that there may be only one discharge and dismissal under this provision. Provides that if a person is convicted of prostitution within 5 years after a discharge and dismissal under this provision, the discharge and dismissal shall be admissible in the sentencing proceeding for that conviction as evidence in aggravation. Effective immediately.

NEWBORN INFANT PROTECTN-SIGNS

Amends the Abandoned Newborn Infant Protection Act. Provides that every hospital, fire station, emergency medical facility, and police station that is required to accept a relinquished newborn infant in accordance with the Act must post a sign in a conspicuous place on the exterior of the building housing the facility informing persons that a newborn infant may be relinquished at the facility in accordance with the Act. Requires the Department of Children and Family Services to prescribe specifications for the signs and for their placement that will ensure statewide uniformity. Effective immediately.

SMOKE FREE ILLINOIS ACT

Creates the Smoke Free Illinois Act. Sets forth the findings of the General Assembly. Creates several definitions. Prohibits smoking in public places, places of employment, and governmental vehicles. Requires "No Smoking" signs to be posted in each public place and place of employment where smoking is prohibited. Requires ashtrays to be removed from any area where smoking is prohibited. Prohibits smoking in student dormitories, including, but not limited to, sleeping rooms, dining areas, restrooms, laundry areas, lobbies, and hallways, of a building used in whole or in part as a student dormitory that is owned and operated or otherwise utilized by a public or private institution of higher education. Provides that the Department of Public Health, State-certified local public health departments, and local law enforcement agencies shall enforce the provisions of the Act. Sets forth fines for violations of the Act. Provides that the Department, a State-certified local public health department, local law enforcement agency, or any individual personally affected by repeated violations may institute, in a circuit court, an action to enjoin violations of the Act. Prohibits discrimination against individuals who exercise their rights afforded by the Act. Provides that a home rule unit may regulate smoking in public places, but that regulation must be no less restrictive than the provisions in the Act. Prohibits smoking within a minimum distance of 15 feet from entrances, exits, windows that open, and ventilation intakes that serve an enclosed area where smoking is prohibited. Amends the State Mandates Act to require implementation without reimbursement. Repeals the Illinois Clean Indoor Air Act.
