FOOD DRUG COSM ACT-GROWTH HORM

Amends the Illinois Food, Drug, and Cosmetic Act. Provides that whoever uses human growth hormone in connection with his or her participation in professional or amateur sporting activities, is guilty of a Class 3 felony, and may be fined an amount not to exceed $50,000. Effective immediately.

PEN CD-CHGO POL-SALARY

Amends the Chicago Police Article of the Illinois Pension Code to base retirement benefits on the highest 36 months, rather than 4 years, of salary within the last 10 years of service, for persons retiring after December 31, 2005. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PENCD-CHI POL-HEALTH EQUALITY

Amends the Chicago Police Article of the Illinois Pension Code. Provides that retiree members of the city health care plans shall pay no higher premium, and shall receive no lower level of benefits, than the active employee members with the same Medicare status. Pre-empts home rule. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PEN CD-CHI POLICE-ADMIN REVIEW

Amends the Chicago Police Article of the Illinois Pension Code. Provides that, if any policeman whose application for either a duty disability benefit or an occupational disease disability benefit has been denied by the Retirement Board brings an action for administrative review challenging the denial of disability benefits and the policeman prevails in the action in administrative review, then the prevailing policeman shall be entitled to recover from the Fund court costs and litigation expenses, including reasonable attorney's fees, as part of the costs of the action. Effective immediately.

ILL HS ATHLETICS TASK FORCE

Establishes the Illinois High School Athletics Task Force to study the feasibility of forming a high school athletics association other than the Illinois High School Association.

GOVT-NOTARY PUBLIC ACT-JOURNAL

Amends the Illinois Notary Public Act. Requires that a notary public keep a journal as to notarization of documents concerning real property. Specifies the information to be entered in the journal in order to identify the witnesses who or documents that affirmed the identity of persons whose acknowledgements were notarized. Specifies the manner in which the journal must be kept and the conditions under which journal entries must be disclosed. Makes violations by a notary public punishable by fines imposed by the Secretary of State and revocation of the notary’s commission. Amends the Conveyances Act. Provides that rights and interests may be acknowledged or proved outside Illinois but within the United States and its territories by a notary public in substantial compliance with the Illinois Notary Public Act (now, by a notary public).

CONSUMER FRAUD-DISCOUNT CARDS

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that, if a grocery store offers a reduced price on an item to consumers who present discount cards, it must also offer the same reduced price on that item to a consumer who does not present a discount card but pays for the item with a Link Card or other access device issued by a government agency to recipients of food stamp benefits or other assistance. Provides that a violation is an unlawful practice within the meaning of the Act. Effective immediately.

CIRCUIT BREAKER ELIGIBILITY

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In a provision concerning eligibility for grants under the Act, increases the household income eligibility limitations for grant year 2005, and provides that, for grant years 2006 and thereafter, the limitations shall be increased annually by the percentage increase in the Consumer Price Index for the previous calendar year. Effective immediately.

FUNERAL DIRECTOR-BODY REMOVAL

Amends the Funeral Directors and Embalmers Licensing Code. Provides that a licensed funeral director or a licensed funeral director and embalmer may not remove a deceased human body from its place of death, institution, or other location without another person present (now, a licensed funeral director and embalmer intern may remove a deceased body from its place of death, institution, or other location without another licensee being present). Effective immediately.

PENCD-CHI POL-PURCHASE CREDITS

Amends the Chicago Police Article of the Illinois Pension Code. Authorizes an active member with at least 5 years of creditable service to establish up to 10 years of additional service credit for certain employment as a law enforcement officer with a downstate municipal police department, the Cook County Police Department, the State of Illinois, or the Chicago Housing Authority. Requires the applicant to pay employee and employer contributions, plus interest. Permits the use of rollover contributions. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
