Amends the Assisted Living and Shared Housing Act, the Hospital Licensing Act, and the Board and Care Home Registration Act to change the name of the Board and Care Home Registration Act to the Board and Care Home Act. In the Board and Care Home Registration Act, provides for the licensure (rather than the registration) of board and care homes by the Department of Public Health. Provides that a board and care home must be licensed as a shared housing or assisted living establishment under the Assisted Living and Shared Housing Act in order to be licensed under the Board and Care Home Registration Act. Makes other changes. Effective immediately.
Amends the Public Library District Act. Provides that the balance in the working cash fund may not exceed 0.2% of the equalized assessed value of the taxable property in the district (instead of 0.2% of the equalized assessed value of taxable property for the year the fund was established or, for funds established after January 1, 1979, for the year 1978). Provides that the library district board may invest temporarily idle moneys from the district's working cash fund. Provides that the interest earned from the investments may be transferred to the general fund or may remain in the working cash fund, provided that the balance of the working cash fund does not exceed the statutory maximum. Provides that, if a working cash fund is abolished, it may be reestablished in the same manner as the fund was originally created. Effective immediately.
Amends the Public Utilities Act. Provides that if a unit or units of local government in which a qualified solid waste energy facility is located purchases all or a portion of its electricity from a supplier other than the electric utility that purchases electricity generated by the qualified solid waste energy facility, then the calculation of the purchase rate paid by the electric utility to the qualified solid waste energy facility shall be based on the amounts that the unit or units of local government would have paid to the electric utility if the unit or units of local government purchased all of its electricity from the electric utility. Effective immediately.
Creates the Regulation of Phosphorus in Detergents Act. Provides that on and after January 1, 2010, no person may use, sell, manufacture, or distribute for sale any cleaning agent containing more than 0.5% phosphorus by weight, expressed as elemental phosphorus, in Illinois, except as provided under this Act. Sets forth certain exceptions. Provides that the Pollution Control Board may authorize the use of certain cleaning agents containing phosphorus under certain conditions and shall promulgate rules for the administration and enforcement of this Act. Provides that no home rule unit may regulate phosphorus in detergents. Effective immediately.
Amends the Metropolitan Water Reclamation District Act. Provides that the District may lease certain property to others for an initial annual rental of less than 6% of the parcel's fair market value if the parcel contains a special development impediment. Provides that the initial annual rental amount shall be for the first 10 years of the lease. Provides that every lease must be awarded to the highest bidder upon free and open competitive bids. Provides that, if property is leased for an annual rental of less than 6% of the parcel's fair market value because of a special development impediment, the first redetermination of the fair market value shall not occur until the twentieth year of the lease (instead of the tenth year). Provides that the District may lease property to certain parties upon mutually agreeable terms, regardless of whether those terms comply with the provisions of the Act. Makes other changes. Effective immediately.
Amends the Department of Veterans Affairs Act. Subject to appropriations, requires the Department to pay veterans service organizations for services provided by veterans service officers in processing claims and other benefits for veterans and their spouses or other beneficiaries residing in Illinois. Requires payment at the rate of $0.010 for each dollar of benefits obtained for veterans or their spouses or other beneficiaries. Sets forth criteria that a veterans service organization must meet.
Amends the Mental Health and Developmental Disabilities Code. Provides that "person subject to involuntary admission" includes (i) a person with mental illness and who because of his or her illness is reasonably expected to engage in dangerous conduct (instead of reasonably expected to inflict serious physical harm upon himself or herself or another in the near future) and (ii) a person with mental illness who, because of the nature of his or her illness, is unable to understand his or her need for treatment and who, if not treated, is reasonably expected to suffer or continue to suffer mental deterioration or emotional deterioration, or both, to the point that the person is reasonably expected to engage in dangerous conduct. Defines "dangerous conduct" as threatening behavior or conduct that places another individual in reasonable expectation of being harmed, or a person's inability to provide, without the assistance of family or outside help, for his or her basic physical needs so as to guard himself or herself from serious harm.
Amends the Civil Rights Act of 2003. Provides that gender (at present, race, color, or national origin) is a characteristic for which a person shall not be discriminated against by any unit of State, county or local government in Illinois.
Creates the Carnival Worker Registration Act. Requires carnival workers who work during those hours in which the carnival is open to the public to obtain a Carnival Worker Identification Card from the Department of Labor. Sets forth rules and procedures for obtaining an identification card. Provides that an application for an identification card shall be denied if the applicant (i) has ever been convicted of any sex offense, (ii) is a registered sex offender, or (iii) has ever been convicted of any homicide offense. Contains other carnival worker requirements. Provides that a carnival owner, upon the request of the fair board or the municipality or county within which the carnival is to be set up, run, operated, or conducted, must provide copies of all Carnival Worker Identification Cards for carnival employees who will work at the site. Amends the Illinois Municipal Code to make a corresponding change. Amends the Carnival and Amusement Rides Safety Act. Requires the Department, in conjunction with the Carnival-Amusement Safety Board, to establish training standards for carnival employees responsible for the operation of amusement rides or amusement attractions regulated under the Act. Effective immediately.
