PEN CD-CHIC POLICE-ANNUITY INC

Amends the Chicago Police Article of the Illinois Pension Code. Increases the minimum monthly annuity payment to $1,250 for any policeman who retired from the service before January 1, 2010, at age 50 or over with 20 or more years of service, and for any policeman who retired from service due to termination of disability and who is entitled to an annuity on January 1, 2010. Increases the minimum amount of a widow's annuity to $1,200 per month. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

LOCGOV-TAX INCREASES

Amends the Counties Code and the Illinois Municipal Code. Provides that home rule counties and municipalities with more than 500,000 inhabitants may not adopt an ordinance or resolution making an appropriation or containing a substantial tax increase unless (i) a copy of that ordinance or resolution, in its final form, has been made conveniently available on the county or municipality's Internet website for at least 7 days before the ordinance or resoulution is considered for final passage and (ii) notice of the ordinance is given by publication in a newspaper of general circulation in the county or municipality not less than 7 nor more than 30 days before the ordinance or resolution is considered for final passage. Provides that, by a motion adopted by a record vote of at least three-fifths of the members elected, the county board or corporate authorities of the municipality may provide that those restrictions do not apply with respect to any one or more ordinances or resolutions specified in the motion. Defines "substantial tax increase" as an aggregate increase in one or more State taxes that will result in increased revenues that are equal to 1% or more of the most recently adopted county or municipal budget. Preempts home rule powers. Effective immediately.

PENCD-CHIC FIREFIGHTER-MIN ANN

Amends the Chicago Firefighter Article of the Illinois Pension Code. Increases the minimum widow's annuity to $1,100 (was, $1,000). Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Allows the employer to authorize by resolution an early retirement without discount program for specified periods beginning July 1, 2010 and ending June 30, 2015. CNTY CD-TAX INCREASE

Amends the Counties Code. Provides that an ordinance or resolution that would result in the increase of revenue to a home rule county by an increase of any tax of that county may be adopted only with the concurrence of three-fifths of the members elected to the county board. Preempts home rule powers and functions. Effective immediately.

PEN CD-ART 3-DISABILITY INCR

Amends the Downstate Police Article of the Illinois Pension Code. Provides that certain disabled police officers who are receiving a disability pension on the effective date of the amendatory Act and who apply within 60 days after that effective date and annually thereafter while the pension remains payable shall be eligible to receive an annual noncompounded increase in his or her disability pension equal to 3% of the original pension. Effective immediately.

PENCD-ART 5-DUTY DISABILITY

Amends the Chicago Police Article of the Illinois Pension Code. Beginning January 1, 2010, increases the duty disability benefit to 75% of the current salary attached from time to time to the rank held by the policeman at the time of removal from the police department payroll. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PEN CD-CHGO POL-INCR RETMT-80%

Amends the Chicago Police Article of the Illinois Pension Code to provide an increase in the retirement benefit formula. Changes the maximum annuity from 75% to 80% of average salary. Provides for 2.5% (rather than 2%) of average salary for each year of service beyond 20. Applies to persons withdrawing from service after the effective date. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PEN CD-CHI POLICE-ADMIN REVIEW

Amends the Chicago Police Article of the Illinois Pension Code. Provides that if any policeman whose application for either a duty disability benefit or an occupational disease disability benefit has been denied by the Retirement Board brings an action for administrative review challenging the denial of disability benefits and the policeman prevails in the action in administrative review, then the prevailing policeman shall be entitled to recover from the Fund court costs and litigation expenses, including reasonable attorney's fees, as part of the costs of the action. Effective immediately.
