BREAST ULTRASOUND SCREENING

Amends the Illinois Insurance Code and the Health Maintenance Organization Act. Requires coverage for a mammogram at the age and intervals considered medically necessary by the woman's health care provider for women under 40 years of age and having a family history of breast cancer, prior personal history of breast cancer, positive genetic testing, or other risk factors (now, only for women under 40 years of age and having a family history of breast cancer or other risk factors). Also requires coverage for a comprehensive ultrasound screening of an entire breast or breasts if a mammogram demonstrates heterogeneous or dense breast tissue based on the Breast Imaging Reporting and Data System established by the American College of Radiology or if the woman is believed to be at increased risk for breast cancer due to family history or prior personal history of breast cancer, positive genetic testing, or other indications as determined by a woman's health care provider. Effective immediately.

DCFS-CILA-ADOLESCENTS-AUTISM

Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Provides that, subject to appropriation, the Department of Children and Family Services shall implement a project in 3 separate geographical areas of the State for the operation of 3 CILA homes for adolescents diagnosed with autism. Requires that a single service provider operate all 3 homes and have on its staff a behavior therapist. Effective July 1, 2007.

PB HEALTH-DIABETES INITIATIVE

Creates the Diabetes Initiative Act. Provides that the Department of Human Services shall develop a strategic plan to slow the rate of diabetes as a result of obesity and other environmental factors by the year 2010. Provides certain guidelines for the development of the plan. Provides that the Department shall deliver the plan to the Governor and to the General Assembly on or before December 31, 2008. Provides that the Act is repealed on January 1, 2010. Effective immediately.

SCH CD-K ENROLLMNT-MUST ATTEND

Amends the School Code. Requires a person having custody or control of a child who is below the compulsory school age and who is enrolled in kindergarten in a public school to cause the child to attend the public school. Includes in the definition of "dropout" a child enrolled in kindergarten. Effective June 30, 2007.

SCH CD-PRIV SCH-BACKGRND CHECK

Amends the School Code. Provides that a non-public elementary or secondary school may not obtain "Non-public School Recognition" status unless (i) the school requires all applicants for employment with the school, after July 1, 2007, to authorize a fingerprint-based criminal history records check as a condition of employment to determine if such applicants have been convicted of specified criminal or drug offenses and (ii) the school performs a check of the Statewide Sex Offender Database for each applicant for employment, after July 1, 2007, to determine whether the applicant has been adjudicated a sex offender. Provides that no non-public school may obtain recognition status that knowingly employs a person, hired after July 1, 2007, for whom a Department of State Police and Federal Bureau of Investigation fingerprint-based criminal history records check and a Statewide Sex Offender Database check has not been initiated or who has been convicted of certain criminal or drug offenses. Contains provisions concerning a fee for the criminal history records check and reimbursement, confidentiality, and checks of employees of persons or firms holding contracts with the school. Effective July 1, 2007.

CRIM CD-FALSE PERSONATION

Amends the Criminal Code of 1961. Provides that a person who falsely represents himself or herself to be a public officer or a public employee or an official or employee of the federal government commits a Class A (rather than a Class B) misdemeanor. Provides that if the false representation is made in furtherance of the commission of a felony, the penalty for a violation of this provision is a Class 4 felony.

VEH CD-GRADUATED LICENSE

Amends the Illinois Vehicle Code, School Code, Child Passenger Protection Act, and Unified Code of Corrections. Makes various changes regarding: driver education requirements; graduated driver's licenses; instruction permits for minors; curfews for drivers under a specified age; the number of passengers under a specified age allowed in a vehicle driven by a newly licensed driver under a certain age; the use of seat safety belts; the use of wireless telephones by graduated driver's license holders; suspensions of driver's licenses of drivers under age 21 under specified circumstances; required appearances before the presiding judge with a parent or guardian under specified circumstances; vehicle impoundment for drivers arrested for street racing; and other matters. Repeals provisions creating the offense of drag racing. Creates the offenses of street racing and aggravated street racing, and makes conforming changes. Makes other changes. Effective January 1, 2008, except that the provisions amending the School Code are effective July 1, 2008.

CONTROLLED SUB-FENTANYL

Amends the Illinois Controlled Substances Act. Establishes penalties for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, fentanyl. Provides that 3 years shall be added to the term of imprisonment and the maximum sentence shall be increased by 3 years if the substance containing a controlled substance contains any amount of fentanyl (except for violations in which the controlled substance is fentanyl). Amends the Unified Code of Corrections. Provides that probation, periodic imprisonment, or conditional discharge may not be imposed for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, more than 5 grams of a substance containing fentanyl. Effective immediately.
