Amends the Victims' Economic Security and Safety Act. Makes a technical change in a Section concerning posting of certain notices.
Amends the Illinois Sexually Transmissible Disease Control Act. Adds definitions for "health care professional" and "expedited partner therapy". Provides that the Department of Public Health shall provide information and technical assistance as appropriate to health care professionals who provide expedited partner therapy services for persons with sexually transmissible diseases. Provides that a health care professional who makes a clinical diagnosis of chlamydia or gonorrhea may prescribe, dispense, furnish, or otherwise provide prescription antibiotic drugs to the infected person's sexual partner or partners without physical examination of the partner or partners, if in the judgment of the health care professional, the partner is unlikely or unable to present for comprehensive health care. Provides that the health care professional shall provide counseling for the patient and written materials to be given by the patient to the partner or partners. Provides that a health care professional providing expedited partner therapy in good faith without fee or compensation and providing counseling and written materials shall not be subject to civil or professional liability, except for willful and wanton misconduct. Makes other changes.
Amends the Elder Abuse and Neglect Act. Provides that "self-neglect" includes compulsive hoarding, which is characterized by the acquisition of, and unwillingness or inability to discard, large quantities of seemingly useless objects that create a significantly cluttered living space and cause considerable distress or impairment in functioning. Provides that the Department on Aging's program of services for persons age 60 or older shall include the following services for eligible adults who have been removed from their residences for the purpose of cleanup or repairs: temporary housing; counseling; and caseworker services to try to ensure that the conditions necessitating the removal do not reoccur.
Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code to provide that beginning on July 1, 2009, reimbursement for dental services provided in accordance with the respective Acts may not be lower than 64% of the reimbursement level that the State of Illinois reimburses dentists for dental services provided to State employees under the State Employees Group Insurance Act.
Amends the Elder Abuse and Neglect Act. Eliminates a reference to a repealed Act. Provides that upon sufficient appropriations to implement a statewide program, the Department on Aging shall implement a program, based on the recommendations of the Elder Self-Neglect Steering Committee, in connection with reports of possible self-neglect; eliminates a provision requiring the Department to take certain actions by January 1, 2008. Adds the following as persons entitled to access to records: (1) an executor or administrator of the estate of an eligible adult who is deceased; and (2) a coroner or medical examiner having proper jurisdiction, pursuant to a written agreement between a provider agency and the coroner or medical examiner, under which the provider agency may furnish to the office of the coroner or medical examiner a list of all eligible adults who may be at imminent risk of death as a result of abuse, neglect, financial exploitation, or self-neglect. Provides for a consent to services by an agent having authority under a power of attorney. Makes other changes.
Amends the School Code. Requires each school superintendent to create a program to ensure that students attending the schools that he or she manages cannot access those schools' grounds for at least 12 hours after those grounds are treated with a lawn care product. Requires each district superintendent to appoint a Lawn Care Coordinator whose duty it shall be (i) to implement that program, (ii) to supervise the provision of notice under subdivision (f)(2) of Section 3 of the Lawn Care Products Application and Notice Act, and (3) if the district adopts a pesticide-free turf care program, to supervise that program. Amends the Lawn Care Products Application and Notice Act. Requires applicators for hire to provide additional types of information to customers. Requires the owners or operators of day care centers to provide parents with one of two types of notice before applying pesticide or having pesticide applied to day center grounds (now, only school districts must provide that notice). Requires the Illinois Department of Public Health to inform school boards and the owners and operators of day care centers about these requirements. Requires the Illinois Department of Public Health to report violations to the Department of Agriculture for enforcement. Effective immediately.
Amends the Higher Education Student Assistance Act and the Illinois Income Tax Act. Authorizes the Illinois Student Assistance Commission to establish systems and programs to encourage employers to match employee contributions to prepaid programs of college savings by making donations to the Commission for prepaid programs of college savings and its programs of grants and loans to make higher education affordable for all residents of the State and to receive, hold, and disburse all such funds made available through those programs for the purposes for which they are authorized by rule or by law. Creates an income tax credit for employers who, during the taxable year, make a matching donation on behalf of an employee. Provides that the credit is 25% of the matching donation, but not to exceed $500 per employee. Provides that the credit may be carried forward for 3 taxable years. Effective immediately.
Creates the Illinois Torture Inquiry and Relief Commission Act. Creates the Illinois Torture Inquiry and Relief Commission as an independent commission under the Illinois Human Rights Commission for administrative purposes. Provides that the Commission shall conduct inquiries into claims of torture with priority to be given to those cases in which the convicted person is currently incarcerated solely for the crime with respect to which he or she claims torture by Jon Burge or officers under his command, or both. Provides that if the Commission concludes there is sufficient evidence of torture to merit judicial review, the Chair of the Commission shall request the Chief Judge of the Circuit Court of Cook County for assignment to a trial judge for consideration. Provides that the Act applies to claims of torture filed not later than 5 years after the effective date of the Act. Effective immediately.
Amends the Technology Development Act. Authorizes the State Treasurer to segregate up to 2% of the Treasurer's investment portfolio in the Technology Development Account IIa. Authorizes investments from the account to provide venture capital to help attract, assist, and retain quality technology businesses in Illinois. Contains provisions concerning soliciting proposals from entities to manage and be the General Partner of Technology Development Account IIb, consisting of investments from the private sector that must invest, at the direction of the Treasurer, in tandem with TDA IIa. Sets restrictions and conditions. Effective immediately.
