RECKLESS DRIVING

Amends the Illinois Vehicle Code. Authorizes municipalities to adopt procedures for the impoundment of vehicles used in the commission of a reckless driving offense (a) as part of a funeral procession or (b) in such a manner that interferes with a funeral procession. Effective immediately.

HOMELESS BILL OF RIGHTS-NEW

Creates the Bill of Rights for the Homeless Act. Sets forth certain rights of homeless persons. Provides that in any civil action alleging a violation of the Act, the court may award appropriate injunctive and declaratory relief, actual damages, and reasonable attorney's fees and costs to a prevailing plaintiff. Amends the Illinois Human Rights Act to make corresponding changes. Defines "housing status" as the status of having or not having a fixed or regular residence, including the status of living on the streets, in a shelter, or in a temporary residence.

AGING-DEPT CONFERENCES-FEES

Amends the Illinois Act on the Aging. Grants the Department on Aging the power to hold conferences, trainings, and other programs for which the Department shall determine by rule a reasonable fee to cover related administrative costs. Rules to implement the fee authority must be adopted in accordance with all provisions of the Illinois Administrative Procedure Act and all rules and procedures of the Joint Committee on Administrative Rules, and any purported rule not so adopted, for whatever reason, is unauthorized. Effective immediately.

OFFICE OF NEW AMERICANS

Creates the Governor's Office of New Americans Act. Creates the Office of New Americans in the Office of the Governor. Requires the Office to maintain and continue to develop on behalf of the people of the State of Illinois a New Americans Immigrant Policy that builds upon the strengths of immigrants, their families, and their institutions, and expedites their journey towards self-sufficiency. Requires the Office to identify strategic partnerships with State agencies. Requires each State agency under the jurisdiction of the Governor to develop a New American Plan that incorporates effective training and resources, ensures culturally and linguistically competent and appropriate services, and includes administrative practices that reach out to and reflect the needs of the immigrant populations and populations with limited English proficiency.

MENTAL HLTH:ADMISSION; RECORDS

Amends the Mental Health and Developmental Disabilities Code. Provides that if necessary in order to obtain the hospitalization of the respondent, a custodian may apply to the court for an order authorizing an officer of the peace to take the respondent into custody and transport the respondent to a mental health facility (instead of to the hospital specified in the agreed order). Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that a party to certain proceedings may also serve a subpoena seeking to obtain access to records or communications under the Act if it is accompanied by the written consent of the person whose records are being sought (instead of only when accompanied by a written order issued by a judge). Provides that each subpoena (instead of subpoena duces tecum) shall contain language informing the person being served of the requirement for the subpoena to be accompanied by a written order or consent.

HUMAN RIGHTS: E-VERIFY PROGRAM

Amends the Illinois Human Rights Act. Changes references to "the Basic Pilot Program" to "the E-Verify Program" in order to conform to changes made by federal Public Law 111-83, Title V, Sec. 551. Effective immediately.

MUNI CD-FOOD ESTABLISHMENTS

Amends the Illinois Municipal Code. Provides that a requirement that a municipality in a county with 2,000,000 or more inhabitants must regulate and inspect retail food establishments does not apply to a municipality that is served by a local health district. Effective immediately.

DRIVER'S LICENSE CANCELLATION

Amends the Illinois Vehicle Code. Allows the Secretary of State to cancel the driver's license of a nonresident or former Illinois resident who has submitted satisfactory documentation to the Secretary of State to be released from the requirement of showing proof of financial responsibility. Limits the Secretary of State's authority to deny renewal upon notification that a driver has an unpaid fine in another state to only those states that are members of the Nonresident Violator Compact of 1977. Allows the Secretary of State to suspend the registration, plates, and registration sticker of a judgment debtor's motor vehicle if that vehicle was involved in the crash leading to the judgment as indicated by the authenticated crash report. Allows the Secretary of State to transfer the balance of a security posted with the Secretary to the State Treasury if, after releasing security to a judgment debtor or claimant, the balanced is $5 or less. Requires the Secretary to compile a list of all security amounts $5 or less annually and file this list with the State Treasurer.

INC TX-EX OFFENDER

Amends the Illinois Income Tax Act. In a Section concerning a credit for wages paid to ex-felons, removes a provision providing that the credit may not exceed $600 for each qualified ex-offender. Provides that the credit is exempt from the Act's automatic sunset. Amends the Economic Development for a Growing Economy Tax Credit Act. Provides that each Agreement entered into on or after the effective date of the amendatory Act shall contain a provision stating that the Applicant shall establish a goal of hiring qualified ex-offenders so that no less than 10% of the jobs created or retained under the Agreement are filled by qualified ex-offenders. Effective immediately.

DHFS-ALLKIDS-3RD PARTY INSURER

Amends the Illinois Insurance Code, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that to the extent authorized under federal law, the Department of Healthcare and Family Services shall identify individuals receiving services under medical assistance programs funded or partially funded by the State who may be or may have been covered by a third party health insurer, the period of coverage for such individuals, and the nature of the coverage. Requires a third party health insurer to provide the Department with eligibility information in a federally recommended or mutually agreed-upon format that includes, at a minimum, the names, addresses, dates, and sex of primary covered persons, the policy group numbers of the covered persons, and other identifiable information. Permits the Department to impose an administrative penalty on a third party health insurer that does not comply with the request for information. Provides that the Attorney General may bring suit on behalf of the Department to collect the penalty. Provides that recoveries made by the Department in connection with the imposition of this administrative penalty shall be deposited into the Public Aid Recoveries Trust Fund. Effective immediately.
