Amends the Authorized Electronic Monitoring in Long-Term Care Facilities Act. Includes an establishment under the Assisted Living and Shared Housing Act in the definition of "facility". Makes a conforming change in a the definition of "resident's representative".
Amends the Secretary of State Act. Provides that the Secretary of State shall establish a program to be known as the Blue Envelope Program through which the Office of the Secretary of State shall design and make publicly available blue envelopes that may be used by individuals who have been diagnosed with autism spectrum disorder to hold documents required for the operation of a motor vehicle. Sets forth additional requirements. Provides that an individual diagnosed with autism spectrum disorder may voluntarily participate in the program. Provides that any information provided on the outside of the envelope shall be used solely to support safe and effective communication during interactions with first responders and law enforcement officers and shall not be entered into any federal, State, or local database. Provides that the Secretary of State may adopt rules to implement and administer the program.
Amends the Criminal Code of 2012. Provides that the statute prohibiting elephants from performing in traveling animal acts applies to "covered animals" rather than just elephants. Defines "covered animal" as any of the following animals, and hybrids of those animals: (1) elephantidae; (2) felidae, but excluding a domestic cat; (3) non-human primate; or (4) ursidae. Provides that the provisions of the amendatory Act are in addition to, and not in lieu of, any other laws protecting animal welfare. Provides that the provisions may not be construed to limit any State law or rules protecting the welfare of animals or to prevent a unit of local government from adopting and enforcing its own animal welfare ordinances and regulations. Contains a severability provision. Effective July 1, 2026.
Creates the Charitable Organization Beneficiary Act. Requires a holder of property in which a charitable organization that is exempt from taxation as a 501(c)(3) entity is a designated beneficiary in a nonprobate instrument (excluding wills or trusts) to notify each charitable organization within 30 business days that it may have a right to the property. Creates a process in which the charitable organization may request that it be given information about the property or that the property be delivered to the charitable organization or both. Provides duties and obligations of the holder of the property. Provides the holder of the property protection from liability for a good faith reliance on the information it receives from a designated beneficiary. Provides remedies against a holder of property for a failure or refusal to provide the requested information or transfer of property if the provisions of the Act are followed. Defines terms.
Creates the Reproductive Health Records Privacy Act. Requires health information exchanges to implement policies and technical capabilities by July 1, 2027, to segregate medical information related to abortion care, restrict access by out-of-state entities, and limit disclosure. Provides enforcement through private actions and civil actions by the Attorney General, including injunctive relief and civil penalties. Defines terms. Amends the Medical Patient Rights Act to clarify patient privacy rights and allow segregation of abortion-related information in health information exchanges. Provides for severability.
Amends the Unified Code of Corrections. Creates the Department of Corrections Independent Ombudsperson Law. Provides that the Corrections Oversight Committee shall appoint the Independent Corrections Ombudsperson. Provides that the Independent Corrections Ombudsperson shall serve a term of 6 years and may be only removed from office by the Governor for cause. Provides that the Independent Corrections Ombudsperson shall not be a current or former employee of the Department of Corrections, the Department of Juvenile Justice, or a contractor for those departments. Establishes the duties of the Independent Corrections Ombudsperson. Provides that the Independent Corrections Ombudsperson shall: (1) monitor and inspect facilities of the Department of Corrections; (2) investigate unresolved complaints from committed persons, their families, and corrections staff regarding correctional facility conditions and treatment of committed persons; (3) create a uniform reporting system and collect and analyze data related to deaths, suicides, sexual and physical assaults, lockdowns, staff vacancies and committed persons-to-staff ratios, visits to committed persons, and use of solitary confinement in correctional facilities; (4) conduct regular inspections of correctional facilities at least once every year for facilities not meeting standards, and at least once every 36 months for facilities that are meeting standards; and (5) publicly issue periodic facility inspection reports and an annual report with recommendations and a summary of data. Establishes other duties of the Independent Corrections Ombudsperson. Provides that the Independent Corrections Ombudsperson shall report regularly on its activities, investigations, and inspections, including an annual report, which shall be presented to and discussed at a meeting of the Corrections Oversight Committee and make other reports on topics of special interest. Provides that all reports of the Independent Corrections Ombudsperson shall be made available to the public online and provided to the Director of Corrections, the Governor, the Attorney General, and the House and Senate Judiciary Committees. Effective July 1, 2026.
Amends the Business Corporation Act of 1983. Provides that nothing in the Act shall grant or recognize the power of a corporation to engage in activities related to the nomination or election of candidates for public office or the initiation, submission, or consideration of questions of public policy.
Amends the Children's Mental Health Act. In provisions concerning the Children's Mental Health Partnership, makes changes to the Partnership's list of duties to include (i) reviewing or facilitating needs assessments (rather than conducting research assessments) to better understand the challenges and gaps of programs, services, and policies related to children's mental health; (ii) monitoring policy development related to children's mental health in Illinois at the local, State, and federal level; and (iii) regularly reviewing aggregate and de-identified data on the need for children's behavioral health services in Illinois that is collected by the Behavioral Health Care and Ongoing Navigation (BEACON) portal to ensure that system transformation can continue to be driven by data. Provides that the Partnership's membership shall include public members who reflect a diversity of sexual orientation; and that all Partnership members shall serve without compensation and with no entitlement to reimbursement for expenses incurred in the performance of their duties. Removes a provision permitting the Partnership to convene study groups. Expands the membership of the adjunct council to include up to 10 youth aged 16 to 25 (rather than up to 6 youth aged 14 to 25) and up to 4 (rather than a minimum of 4) representatives of 4 different community-based organizations that focus on youth mental health. Makes other changes.
Creates the Disposable Food Service Container Act. Provides that, beginning January 1, 2030, a person may not sell or distribute in this State a disposable food service container that is composed in whole or in part of polystyrene foam. Specifies that the prohibition does not apply to any activity authorized under an ordinance or resolution adopted by a unit of local government on or before January 1, 2024 or with respect to sales made to a unit of local government for use by the unit of local government for its internal operations. Sets forth penalties for violations of the Act. Limits home rule powers. Effective immediately.
Acknowledges the accomplishments and implementation progress of the Kinship in Demand (KIND) Act. Urges the Illinois Department of Children and Family Services (DCFS) to aggressively continue implementation of the KIND Act to deliver permanency to more children and to keep families together even when reunification is not possible. Urges DCFS to execute needed revisions to Rule 415 one year after all statutory provisions went into effect. Urges DCFS to actively pursue the recently announced federal funding opportunities by the U.S. Department of Health and Human Services Administration for Children & Families to support kinship navigator services and to bolster the implementation of the KIND Act. Urges DCFS to provide continual, updated training opportunities and resource materials for staff. Urges the Administrative Office of the Illinois Courts to provide effective statewide judicial education on the KIND Act. Supports the judiciary's efforts to diligently implement the components of the KIND Act.
